
Yesterday, the director of the Federal Migration Service (FMS) Andrei Chernenko said that his department, together with the presidential administration, was preparing a bill “On Migration Accounting in the Russian Federation” on the replacement of the permissive procedure for registering citizens at the place of residence and the claims. In fact, this means the abolition of the institute "registration" in its current repressive version, Kommersant writes today.
The essence of the bill is that the bodies of internal affairs will no longer be able to refuse to “registered” after the law. As in most countries of the world, they will only register a citizen at the place of stay on the basis of the application submitted by him. As the head of the FMS explained to the newspaper, the new order will be common to foreigners and Russian citizens. The security of citizens, according to Andrei Chernenko, the planned innovations do not threaten: "Not a single bandit at the place of registration has yet been caught." The head of the FMS refused to disclose the details of the new mechanism, citing the fact that while the bill is under development.
Now registration issues are regulated by the Federal Law "On the right of citizens of the Russian Federation to freedom of movement, choosing a place of stay and residence within the Russian Federation." It limits these freedoms in only five cases: if we are talking about finding a citizen in the border strip, in closed military towns, closed administrative-territorial formations, in environmental disaster zones and emergency regulations. However, this law is framed in nature, and specific registration rules are established by the constituent entities of the Russian Federation independently. For example, in the metropolitan region, they are established by a joint resolution of the governments of Moscow and the Moscow Region of March 30, 1999. Although formally they provide an opportunity to register in the capital to any law -abiding citizen, multiple restrictions make this procedure complex and, according to most of those who have encountered it, bribe and discriminatory.
Legislators who have to adopt the preparing bill reacted to the liberal ideas of the head of the FMS wary. “The question is more than difficult, especially for Moscow, St. Petersburg and the Krasnodar Territory-the fight will be terrible when discussing it,” Vadim Gustov, Chairman of the Council of the CIS Council, told Kommersant.
The representative of the densely populated Krasnodar Territory - the first deputy chairman of the local Legislative Assembly, Alexander Shukenkov, is not enthusiastic about the preparing bill: "There is a lot of money in Moscow, and we have a warm climate and, as a result, increased attention of certain ethnic groups. So I would urge to take this topic very carefully: we are not always applicable."
The Moscow authorities and the Moscow authorities speak with obvious irritation of the innovations of the migration service. “I can comment on this bill only when I see it on paper. It is one thing to proclaim ideas from the rostrum, another is to describe them in the language of the law,” the chairman of the Moscow City Duma Vladimir Platonov told Kommersant. The head of the capital's legislators insists that the declarative nature of registration in Moscow exists now, if, of course, it is not to understand the citizen’s right to register at any address indicated by him: “Imagine, you come and find out that someone has registered in your apartment and now does not let you go home,” Mr. Platonov outlined the gloomy prospects for the liberalization of the passport regime.
And the director of the Migration Research Center Zhanna Zhang Zaonchkovskaya reacted calmly to the impending bill: "In fact, the Moscow authorities are satisfied that hundreds of thousands of people live in the capital without registration: probably this situation is beneficial. After all, when a person has the need to hide, he has the opportunity to defend his rights to the authorities and employers."
