Judge of the Zamoskvoretsky Court Andrei Fedin found athlete Rasul Mirzaev guilty of the death of student Ivan Agafonov. However, if earlier Mirzaev was accused of intentionally causing grievous bodily harm resulting in the death of the victim, now the charge has been reclassified as causing death by negligence. Sentence: two years of restriction of freedom. This is exactly what the prosecutor's office called for earlier. The court also heeded her call to count the athlete one day in a pre-trial detention center as two days of restriction of freedom. Thus, Mirzaev was released right in the courtroom, since he had been in jail for more than a year.
According to investigators, in August 2011, near the building of the Garage club, Mirzaev hit Agafonov as a result of a conflict that occurred due to the fact that Agafonov began joking with Mirzaev’s girlfriend - he offered to take her for a ride in a toy car (Mirzaev, apparently, interpreted This is not as a joke, but as harassment). Agafonov fell and lost consciousness, and died a few days later. The main topic of discussion was whether the head injury, which resulted in death, was actually directly related to the blow that the world champion in fighting without rules dealt to Agafonov. Five examinations were carried out, but no answer was received. The prosecutor's office considered that no connection had been established between the blow and Agafonov's death.
Mirzaev’s case became the reason for the activation of nationalists, who picketed the court on November 27. Among those detained is the leader of the “Russians” movement, Dmitry Demushkin. The nationalist claims that the matter became political because the Dagestan authorities intervened.
The defense of the victims - Agafonov's parents - intends to appeal the verdict.
