There is no precedent right in Russia. Rather, we have an unprecedented law. But practically the case of Sychev is a precedent. His outcome can be approaching unscrupulously, as Sivakov’s lawyers, the Ministry of Defense and how state television made. That is: they fanned from the fly of the elephant, there was nothing special there - unpleasant, but accident. You can approach the verdict idealistically: this is not a sentence, but a shame proving that there is no justice in the country and is not expected. And you can try to look realistic.

It was important for me personally that Sivakov was simply imprisoned, so that when the verdict was announced, he would not hear the acquittal, so that the deadline is not conditional and does not coincide with the accuracy of the day with the period that he had already served in the isolator. Otherwise, two facts would become indisputable. Firstly, there is a young, until recently completely healthy guy who is now crippled. And secondly, there are no guilty ones in the fact that the young paren has a broken life, unless, of course, to consider Sychev himself to be guilty that he did not know how to sit on a squat, like all normal people.

So if no one really moved from the courtroom from the courtroom to the camp, then one precedent would be created. This would mean that even for the most vile crime, which has become (importantly) known to the whole country, it is impossible to punish! What then to say about the facts unknown to anyone, when someone was simply beaten-without consequences in the form of amputation of the legs, without a dozen operations.

However, Sivakov received four years , and he will go from the courtroom nevertheless in the right direction. And this creates another precedent. Let this case exceptional by any standards, let it really followed him half the country, let the court not dare to a really harsh sentence. But that is why I strive to be a realist. It is important that it is possible to put a person for grandfature in principle. As it was important at one time to plant the heroic Budanov, which also became a precedent, for nothing that other war criminals have not yet followed Budanov.

But so we live so that for us the tit is more important at least some kind of retaliation in his hand than the crane of complete justice in the sky. We will not catch the crane soon. All criminals will not answer us for all crimes. To call for an answer at least one thing is success. Then fight for the punishment of another. Then the third. To the very last, the villain will come up, I repeat, not soon, but how else? And sentences must “progress”.

So that of the three accused, two do not go on all four sides.
So that the Sivakovs do not have the right not to be the same for three years, but in general at all to occupy command posts in the army. (Speaking of conscience, this person has no right to serve in the army further and even more so to command someone-how is it possible? How could a court make such a decision?)
To change the criminal legislation itself. Because I believe that four years and six, and even the maximum ten according to this article are absolutely not adequate to the severity of the deed!

And here are the positive characteristics? What are the characteristics? What did he do public work, was initiative and politically literate? He almost sent a man to the next world, but in fact - yes, he sent, because they do not live with such injuries for a long time.

There was no intent? Well, probably, he was not going to purposefully achieve that Sychev was left without legs, with blood poisoning and damage to almost all internal organs. However, Sergeant Sivakov deliberately got drunk and deliberately laughed at the subordinate!

But these are emotions. Guided by which, I just want to kill such people. And a realistic reason says: four years are not the worst option, this is still a useful precedent. The main thing is that it does not work out, as with Budanov, so that this process laid the foundation for normal judicial practice.
