Human rights activist, member of the Bureau of the United Civil Front, chairman of the board of the Interregional Coordination Center “Forgotten Regiment”, which deals with the problems of the military, member of the board of the new All-Russian public movement “Civil Federation” Elena Vasilyeva was hospitalized in the intensive care unit of hospital No. 55 after a paroxysm of atrial fibrillation. By this time, Vasilyeva had been on a hunger strike for almost 14 days, speaking out against the arbitrariness of the bailiffs.
A petition addressed to Prosecutor General Yuri Chaika was timed to coincide with the hunger strike:
“To check compliance with the laws of the Russian Federation by bailiffs in all regions of the Russian Federation
Bailiffs everywhere violate the following articles of law:
1st Art. 4 of the Federal Law “On Enforcement Proceedings”: enforcement proceedings are carried out, including on the principles of respect for the honor and dignity of a citizen, the inviolability of the minimum property necessary for the existence of the debtor-citizen and members of his family.
2. part 2 tbsp. 99 of the said Federal Law: The amount of deduction from wages and other income of the debtor cannot exceed 50%, Article 26 of the Law “On Labor Pensions”, deductions are made in the amount specified in the resolution on the collection of funds, and can be no more than 50 percent of the pension . In case of simultaneous deduction for various reasons, the amount of recovery cannot exceed 50 percent of the pension due to the pensioner.
3. Art. 101 Federal Law “On Enforcement Proceedings”, which clearly stipulates the types of income that cannot be levied against.
4. para. 8 hours 1 tbsp. 446 of the Code of Civil Procedure of the Russian Federation: recovery cannot be made under executive documents for food and money for a total amount not less than the established subsistence level of the debtor citizen and his dependents.
From all regions of the country there are reports of bailiffs ruining family farms, leaving citizens without a livelihood, beating suspects, illegally evicting citizens, and bailiffs participating in raider takeovers.
On the other hand, bailiffs are in no hurry to implement court decisions in favor of citizens, for example, to allocate apartments to reserve military personnel.
The time has come to put an end to the arbitrariness of bailiffs and demand that they fully comply with the laws of the Russian Federation.
We demand that the Prosecutor General of the Russian Federation conduct an all-Russian prosecutorial audit of compliance with the legislation of the Russian Federation by bailiffs in all regions of the Russian Federation with coverage of the results of the audit in the official media.”
According to the White Press Center, doctors assess Vasilyeva’s condition as “moderate” and they put her on IVs.
