The fact that the Moscow authorities have finally officially recognized that problems with HOA in the capital really exist is certainly good. The bad thing is that the same people who created these problems will solve it.
One of the goals of the housing and communal services reform, which began long before Luzhkov's resignation, is to shift responsibility for the houses onto the shoulders of the tenants themselves, homeowners associations and management companies and withdraw the state from this process. Along with the need to solve numerous problems, residents have the opportunity to dispose of common property and receive income from it. Money for placing advertisements on facades and roofs, for renting attics and basements, bypassing the budget and bureaucratic pockets, had to go to the owners.
Officials could not accept this. Hundreds of fake HOAs appeared in the capital, dozens of those that were initially controlled by the residents were seized. And even if it is not possible to take control of the HOA, officials manage to rent out non-residential areas bypassing those to whom they belong. Invaders of non-residential premises do not disdain forgery of documents, seals, fraud...
“Another way to generate income from home is engineering networks,” explains Vladimir Fokin, deputy of the Basmannoye municipal assembly. - By controlling the HOA, someone can connect stalls, tents, shops to electricity at home. Who will pay for electricity in this case? That's right, residents! On the plots related to the house, you can build additional extensions and rent them out. The owners get nothing out of this money.”
Tatyana Lebedeva, deputy head of the Homeowners Association "House on Furmanny", got it from the invaders to the fullest. Together with the chairman and housemates, she fought for common shared ownership with two officials and two invaders of technical premises. For years, without documents, they rented them out. The capture scheme turned out to be classic: allegedly, a meeting was held in absentia to re-elect the leadership of the HOA, a fake protocol was signed by those same officials, a seal was made based on the imprint of the original, and statements went to all courts to stop the struggle of the partnership for common property. Residents in the last year received leaflets that the current chairman of the HOA sold the house to criminals. But the neighbors, fortunately, did not believe it.
One of the invaders beat Tatyana Lebedeva herself. In serious condition, she was admitted to the hospital.
In October 2009, this HOA sent a letter to the President of the Russian Federation. The answer came from the prosecutor's office: they say, the rights are on your side, go to court. In the Arbitration Court of Moscow, the HOA won, on the basis of a forensic technical examination, it was found that the rights of the city were issued illegally. However, the Federal Registration Service, the Department of Property and 4 “residential comrades” filed appeals. The HOA also won the Court of Appeal, but the city filed an appeal!
The head of the HOA "Rozhdestvensky Boulevard, 10/7" Mikhail Shulman spoke about the struggle in his house for the attic. Beatings took place in the entrances, cars were set on fire in the yard ... On the basis of false protocols, the invaders got control of the accounts of the HOA, somehow entering themselves into the register without permits. Shulman is sure that officials are behind all this.
“The owners have just begun to understand how to manage houses, regulate payments, and for this they began to get on the head, literally,” says Vladimir Fokin. “The talk of rallies has already begun.”
In the Basmanny district, the leaders of more than 40 HOAs have already joined forces to defend the rights to property, they are supported by the chairmen of homeowners associations throughout the capital.
PS Since the beginning of the year, six HOA leaders have been killed in Moscow.
