Pike vests are shaken. Romance shared. All those who expected the thaw and hoped that with the advent of Medvedev to the so -called Politzam, primarily Mikhail Khodorkovsky, “relief would come out.” It did not work out. The convict’s statements did not help that he would not demand the company taken away from him. The calls within the country and in the West did not help. The mother of Khodorkovsky Marina Filippovna Dmitry Medvedev did not help. Why? The answer is clear: the convict failed. It must be squeezed. He is still resisting.
You can, of course, tear a shirt on yourself, once again asking yourself and others, why did everything happen this way, and not otherwise. You can believe or not believe the rumors that Dmitry Medvedev was not against parole (Udorovsky). It seems that Alexander Voloshin flew on a date with the MBH in Chita. Allegedly, conditions were discussed, some phrases that the Chita prisoner had to speak, but did not talk. And then in an instant all the agreements collapsed, the young judge with an intelligent person took out one of the two pre -prepared decisions from the folder. The one he read out on the judge’s slang is called “not Udo” or “Inappropriate”. The one that could read - if our All -Russian “good investigator” defeated the “Evil” - is called “Udo” or “Failure”. Unlike Interfax, which, by mistake, released a “lightning” that was satisfied with Khodorkovsky’s application, Judge Igor Faleleev did not confuse anything - he read out the decision that was made. Its meaning is that the convicted Mikhail Borisovich Khodorkovsky “did not take the path of correction, he has a reprimand with almost a year ago for failure to comply with the colony administration to remove his hands behind his back. He did not master the profession of a seamstress. ” Grigory Pasko, I remember, the colony administration reproached that he was not engaged in amateur performances.
The main thing here is that Khodorkovsky really did not embark on the path of correction. After all, we have correctional colonies. And this means that convicts who want to go out at UDU must admit their guilt, cooperate with the administration, repent of the deed. Better yet, if their relatives in the wild are slipped, they will put up money and give them to anyone. Then, you look, and the judge will be more fun to look, mercy will show and go out of the wild, as it should be - by parole.
It’s unnecessary to say that in the case of Khodorkovsky or other defendants in scandalous affairs, it will not work to “buy” the parole: if bargaining and takes place, then it is carried out at the highest level and operate here not by thousands of dollars, as is the case with ordinary prisoners. Waiting for a train to Moscow, at the Mordovian station of Potma, I heard the conversations of relatives of convicts returning from the camps from the camps. They called the specific amounts that need to be paid in order to get parole (several thousand dollars - the order of numbers was varied depending on the article and the deadline), even called the surnames of judges who are ready to take this money.
But either not all judges and not all colonies are 100 percent spoiled by corruption, or the vast majority of prisoners do not have enough money for bribes, but the fact remains: the number of those who go out earlier than earlier than the end of the deadline is very small. In the prison system, as well as in the judicial, the indictment is excessively high. Most jailers believe that their customers are criminals. More than once or twice had to hear from different colonies that even if, in the investigation and court, it was not possible to prove that a person is guilty, but since he came into the field of view of law enforcement agencies, it means that he is guilty anyway, and there is certainly such a criminal for him. And this despite the fact that the jailers know very well how things are being fabricated and how many innocent people are often behind bars.
Obviously, it is unrealistic to comply with all the requirements of the prison schedule. And any prisoner at some point admits certain violations. Another thing: if they are closely monitored for some convicts, then he can be accused of the slightest misconduct, because of which they are unlikely to be given a simple criminal.
The institute of parole works extremely poorly. The institute of pardon is generally paralyzed. As a rule, court trials are held quite formally. The judges for the most part listen to the opinion of the colony administration. And it gives good characteristics only to those convicts who deserve it in various ways, which have already been mentioned above. The recognition of guilt, awareness of a committed criminal act is especially welcomed. Such is the law enforcement practice, but not the law.
At the trial in Chita, the judge brilliantly simulated the competition process. He rejected two petitions of the prosecutors (the case is extremely rare!), Suggested the video from the colony to personally make sure that Khodorkovsky violated the internal schedule of the colony. In the trial, all coming journalists were able to attend. They broadcast Khodorkovsky’s statements that he was no longer interested in the oil business that, having been released, he would take care of his family and humanitarian activities. Evil languages say that the MBH should not stutter about “humanitarian activities”, because both social and political activity can be hidden behind this vague formulation. And this is exactly what the pursuers of Yukos would not want at all.
And despite the fact that Khodorkovsky said several times that he would not seek the abolition of unwinear decisions concerning the company Yukos, “those who ordered” him five years ago did not believe him. They calculated, apparently, that he had not yet submitted. I gave the money. But the soul is not.
And if so, then - not parole.
