It turns out that within the framework of the YUKOS case, the Russian themis committed illegal actions. In any case, this is what the Presidium of the Supreme Court ruled on December 23, overturning the decision of the Basmanny Court almost six years ago on the arrest of the former head of the MFO "MENATEP" Platon Lebedev on July 3, 2003. The Presidium also opened supervisory proceedings in Lebedev's first case, as the European Court of Human Rights found that his rights had been violated.
The decision of the European Court was made on October 25, 2007. The judges then unanimously ruled that Lebedev's detention from March 31 to April 6, 2004 was a violation of the Human Rights Convention. Four out of seven judges also found a violation in the detention from July 3 to August 28, 2003. And five out of seven ruled that there was a violation in the delay in considering the decision to extend the period of detention on December 26, 2003 by the Moscow City Court. In addition, the court unanimously ruled that there was a violation in the delays in considering the decision to extend the period of detention by the Moscow City Court on April 6, 2004 and in the fact that Lebedev himself was not present at the meeting dedicated to the next extension of the period of detention on June 8.
A court in Strasbourg ordered Russia to pay Lebedev ten thousand euros. Lebedev then stated that he would give this compensation to charity and would seek a complete review of the case and recognition of innocence.
Lebedev's lawyers, speaking in the Supreme Court, asked to cancel and declare illegal about ten decisions of Russian courts against their client. The court overturned four, including the cassation decision of the Moscow City Court on July 23, 2003 on the arrest of Platon Lebedev, the decision of the Meshchansky Court on June 8, 2004 and the ruling of the Moscow City Court on June 29, 2004, also concerning preventive measures.
