But in the end, the perpetrators were not found there ...About the same thing is happening now in real life. From the very beginning of the “Second Chechen War,” human rights activists attracted the attention of the authorities and the public to the “disappearance” of people and extrajudicial executions. In fact, if the authorities claim that such and such is a terrorist, so lead the investigation, judge him, put him in prison, but by law! After all, it is not only about the rights of this person, not only that the activity of the "death squads" is a war crime and a crime against humanity. Other arguments are also important here.
Firstly, the relatives of the "disappeared", so far only suspected of terrorism, will compile a mobilization base for the existing organizers of terror. Secondly, the Code of Criminal Procedure and other delights of jurisprudence were invented not only to protect the suspect, but also to protect all of us from error. Under torture, you can confess to anything, as a result, an innocent may be killed, and a real terrorist will calmly go to the next "case".
But on February 6, on the central television channels in various kinds of "criminal chronicles" one plot passed with small variations.

And these records have already begun to study investigators. <...> Isa Gamaev was seduced by dollars. He received his first bloody salary for the shelling of the federal forces. Isa Gamaev, detained (operational survey of the Ministry of Internal Affairs of the Russian Federation):" Kazakh, Gaziev Tarkhan, from Gazyev Tarkhan. The grenade launcher shot. And I had an assault rifle 7.62 and two horns with cartridges. I shot two horns, I don’t know whether I got it or not. ”<...>“ And in Nalchik what you did? ” -“ The hotel was resting there. ”However, the investigation does not exclude that the detainee was not only for rest. headquarters] for conducting who [counter-terrorist operation] in the North Caucasus: "Participation in the murder of the head of the administration of the village of Zumsoy, the murder of the police inspector of the Itum-Kalinsky police department <...>"
It would seem that one must rejoice: the suspect was detained, interrogated, confessed and even suitable to appear in front of the television and, probably, before the court. Moreover, we are talking about the long -suffering village Zumsoy. On January 15-16, 2005, missile and bomb strikes were inflicted on the village, then a helicopter landing was planted there. Four villagers -Vakhu Mukhaev, Shakhran Nasipova, Magomed-emina Ibishev and teenager atabi Mukhaev, son of Vahi, were taken away by helicopters. Where they are unknown to this day. And on July 4, unknown people killed the head of the administration of the village of Abdul-Azim Yangulbaev-after that the last residents left Zumsa.
Only now one strangeness: why does the journalist say that Gamaev was detained in Dagestan, and the security forces - what's in Nalchik?
In fact, there are much more oddities.
But first - about another person, about the inhabitant of the same Zumso Mehti Makhmudovich Mukhaev . On the night of December 29 to 30, 2005, Mukhaev was kidnapped from the house of his cousin in the village of Gikalo. The security forces who arrived in camouflage and masks raised Mehti from bed, in underwear, barefoot, and took them in an unknown direction. December 31 (!) In Urus-Martan, he was given fifteen days "for petty hooliganism." They first kept it in the Shatoysky District Department of Internal Affairs, and then transferred to Grozny, to ORB-2 (in colloquial, this institution is called RUBOP, or the “sixth department”). On January 18, Mukhaev was transferred to an investigative insulator (pre -trial detention center), and on January 20, a lawyer, an employee of Memorial, received access to him.
Mukhaev told the lawyer that he was beaten in Shatu for eleven days - they showed the photo and asked if these people were familiar with him. He replied that no - they beat again, imitated the execution, "all my insides were sick, I could not breathe, but did not give testimony, since I had nothing to say." In Orb-2 for three days they were tortured with electric shock, beaten: "They asked if I knew these people, I answered that I did not. Then they began to beat me with a club on the head, ribs and kidneys, I could not breathe, repeated that I did not know, and lost consciousness." Here the doctor was found - he lubricated the abrasion of Mukhaev, and he was taken to the investigator: "I answered his questions that I did not know, after that they took me and tortured me again, threatened, endlessly repeated that I would be lost missing." And then he decided to confess that armed militants burst into his house on the farm in the mountains in the mountains and demanded food, he could not refuse and fed them. He was again taken to the investigator: "The investigator asked why I am changing the testimony, I did not answer. <...>"
Mukhaev was detained according to the testimony of Gamaev, which was mentioned above. The lawyer who attended the interrogation of Gamaev said that he could not stand on torture. On January 19, Gamaev was placed in Mukhava’s camera - he cried, asking for forgiveness for specifying him under torture.
On January 23, Memorial published information about the Mukhaev case, requests from Ombudsman Vladimir Lukin went to Grozny, from international organizations, and in Novaya Gazeta an article by Anna Politkovskaya about this case was published. On January 30, relatives of Isa Gamaev invited him a lawyer (before that he was appointed by the investigation).
But on February 1, Gamaev and Mukhaev was again transferred from a pre-trial detention center to Orb-2. There, Mukhaev was first examined by the doctor, and then they began to beat - with fists, legs, stool - demanding not to refuse the testimony that has been given earlier. Gamaev "in a good way" was advised not to aggravate his position. On February 2, the lawyer became aware of their transfer to Orb-2, and by the evening it was possible to achieve their transfer back to the pre-trial detention center. There, the doctors recorded the fresh "hematoma on the right shovel region in 6 cm" on the body of Mukhaev and "complaints of pain in the region of the heart."
On the same day, “to the will” came the statement of Gamaev, where he describes his business. He was detained in Nalchik on December 10. His eyes were blindfolded with adhesive tape, electric wires were brought to all parts of the body, beaten with a rubber club and legs. They brought into consciousness, dousing with cold water, after which the torture resumed. On the second day, torture, unable to stand it, he began to testify - he talked about those whose participation in the Jamaat group was well -known: “The names of Docks Umarov, Tarkhan, Azimov Anzor,“ Kazakh ”,“ Kazakh ”, Umara (“ Leo ”) were associated with“ Jamaat ”, all of our villagers and residents of nearby villages knew.” It was not possible to identify from the photo, and for this they beat again. Then he was transported in the trunk of a passenger car to Hankalu. There he refused to testify, but the torture resumed: "The medical needle entered the kidney area and carried out an electric current in it, laid the electric wire in the mouth, beat a wooden club on the heels, on the head and throughout the body." Gamaev said that he met with the militants in the cave near the village of Zumsa: "I was taken by a helicopter to the place I specified, however, as I should expect, the caves were neither indicated by me, nor somewhere nearby I could not be, since I said about the cave, because I had nothing to say, and I could no longer bear the torture."
But the "investigation" had no doubt. Gamaev was taken to Dagestan, to Khasavyurt, where two days “fixed the testimony” in the “sixth department”: a rubber club on the head, fists and legs throughout the body-“due to the fact that I did not add the readings in Nalchik and Khankala”. And after the “Mukhaev case” received publicity, and lawyers appeared at the suspects, a video was made that saw the light of February 6. It seems that they prepared the plot in a hurry - hence the inconsistency with Dagestan and Nalchik. But what was the purpose of this PR rider?
On February 7, the repeated confrontation of Mukhaev and Gamaev was supposed to take place. But in the morning, the investigator Petukhov called the lawyer Mukhaev and announced her discharge, and the investigator was called the Gamaev’s lawyer and announced that Gamaev refused her services. The Memorial immediately introduced another lawyer into the case of, and Gamaev’s lawyer achieved a meeting with him until a full -time bet - Gamaev asked her to stay. The confrontation took place in the presence of two lawyers, but the investigator took a non -disclosure subscription from them.
And on February 8, Mukhaev was charged under Art. 209 (banditry).
Indeed, a lot is changing in Chechnya. The two detainees have not “disappeared” - the investigation is being conducted, they have lawyers, they have charged ... But can they say that it has become better? During the years of “Big Terror”, except for hundreds of thousands of decorated “in a special order” - through “Troika”, “Two”, “Special Measures”, according to the “lists” - there were also convicted by courts, with lawyers and others. Take at least Moscow "big processes".
What can be added to what has already been said? Only one thing. After all, someone actually committed crimes of which Gamaev is accused. Today is not thirty -seventh, and terrorists are not only in the inflamed state brain. And if the investigation will not stop and turn on the “only true path”, then who will be responsible for the consequences?
