The last shot. The deceived equity holders of South Tushin was not in vain for 12 days. The Moscow authorities promised to build them a new house on the Mozhayskoye Shosse. The example of the desperate Muscovites inspired their comrades in misfortune in other regions on similar protests. In the near future, fan hunger strikes of equity holders throughout Russia are expected. The New Times sorted out why the number of deceived people is growing
The story of Lyudmila Polonskaya is very similar to the history of many of her comrades in misfortune. Unless at the end of her eight-year torment there was happiness: her house was finally handed over in Troitsk, and in the spring of 2011, she and her son and her elderly father began to live her long-suffering square meters. “The holiday did not work,” she says. - for too long the nightmare lasted. Bet on time ago, I would look for other options - even a room in the secondary market, but I would never contact the long -term construction. ”
The endless pit of Lyudmila is a candidate of sciences, a teacher of Russian literature in one of the universities of the capital. After a divorce with her husband, she moved to her father in a one -room apartment. By the summer of 2003, it became clear that living the three of the 30 square meters. m is impossible, it is necessary to expand housing. How? She accumulated only $ 8 thousand - even if you sell the living space to Pattsov, not like a “treshka” in Moscow, even for a “kopeck piece” will not be enough.
Friends advised me to think about the suburbs: they seemed to build a lot and quickly there. Troitsk liked-40 minutes on the minibus to the metro, under the windows-greens, three future 25-storey towers were already erected to almost the second floor. But the most important thing is the investment company “Capital Design”, which sold apartments, for starters, took only the first fee - just the same $ 8 thousand, the rest could be made in parts for six months at a small percentage. The deadline for delivery under the contract is the IV quarter of 2004. But barely Lyudmila paid all the money, the construction stopped. They said: temporarily, the contractor has some technical difficulties. They stretched for two years. Then the investor changed, the construction from the second floors rose to the fifth or sixth. And again everything died out. The interest holders were seriously alarmed, created an initiative group, walked, wrote. The prosecutor’s office did not react, the Troitsk authorities dismissed: sort it out yourself. Someone offered a mass hunger strike-to pay attention. But Lyudmila was already starving: lenders demanded a return of debts, but from her salary 18 thousand rubles could not be given them. I took loans at 18–20% per annum, gave it to someone, and the debts were still growing. And then the new investor raised the price per square meter. They paid extra how they were paying for the improvement of the territory: otherwise the delivery of the house would drag on for another year ...
This long -building pulled out of Lyudmila, including his father’s apartment: she was laid twice, and even when they sold it, this money was not enough to fully pay. According to Lyudmila’s estimates, the “cheapness” of a square meter at the initial stage ($ 350) over eight painful years increased for her by 20 times. But this is not the only price of these eight years of expectations: two hunger strikes, a heart attack, a son who grew up in a grandfather in the kitchen, and his grandfather himself, from long experiences finally chained to bed ...

Autumn 2011. The deceived equity holders rally on Square of the Krasnopresnenskaya Zastava in Moscow ...
The creator of the project "Odlodchikov.ru" Igor Guliev, such in the country at least 150 thousand.
The explanation for this is simple: buying an apartment on ordinary conditions for the majority of the population is absolutely inaccessible due to the fabulous high cost of square meters. Therefore, citizens are forced to go to the shared scheme, which becomes a kind of Russian roulette for them: someone is lucky, and someone will be tied for years.
The largest summary of the Besports from year to year is supplied by the construction complex of the Moscow Region. Now, according to
The lawyer of the Russian Law Chamber Oleg Sukhov, in the field of seven problematic cities - Sergiev Posad, Korolev, Pushkino, Balashikha, Troitsk, Zheleznodorozhny, Lobnya, where tens of thousands of families became victims of construction pyramids. However, the Russian hinterland does not lag behind: for example, in Krasnoyarsk, 11 multi -storey buildings are the second five -year plan at the pit level. Meanwhile, since 2005, the Federal Law “On Participation in shared construction ...” (No. 214-FZ) has been in force, and all sorts of pyramids are now forbidden to promote people for money under the tempting promises “to build apartments quickly and cheaply”. Now legislators are ordered to attract the funds of citizens solely after all the necessary permits and approvals are obtained, land rights were issued, design declarations have been published, and the procedure for state registration of shared participation contracts has been completed.
However, in reality, the law does not work. “People think that they are protected by the 214th law, and continue to invest money in shared construction,” explains
Daniil Volodin, coordinator of the Motioners.ru movement. “But they are protected only formally.” In fact, loopholes remained in the legislation. For example, you can organize shared construction through housing cooperatives: they have more powers, and there are fewer responsibility. And if such a developer deduced the money from the circulation from the turnover, no law will help here. ”
There is another reason. “When in the mid-2000s, due to the entry into force 214-ФЗ, prices for housing sharply jumped, the search for legal grounds for the use of alternative schemes to sell housing at more affordable prices began,” recalls
Alexey Zavyalov, commercial director of CJSC “Real Estate Foundation”. “And the buyers again rushed into the open arms of the developers.”
In an embrace with the authorities, not only the law, but also the authorities, as it turns out, do not protect citizens on the iot. According to the State Duma Committee on Budget and Taxes, only every 30th agreement on participation in shared housing construction in Moscow was concluded in accordance with the requirements of federal legislation (in Russia-20%), the rest-bypassing 214-ФЗ. It is clear that people who sign the papers may not know that most of them are unlikely to have funds to hire lawyers. But did not a single supervisor knew about this and the authorities were in ignorance?
It is hard to believe this, if only because without the knowledge of the authorities and without their permission, not a single developer could spud on the controlled territory, arbitrarily reduce tax deductions and avoid unpleasant necessity to pay to the equity for years in case of delay or termination of construction. In addition, in most “problematic” regions, the authorities themselves called the developers loved by them and did not hesitate to promote them through local media as reliable partners. It is enough to recall the scandalous-known company “Social Initiative”: in the early 2000s, its leadership fought under television and photo lenses with the authorities of 15 regions of Russia, raised money for the construction of 200 facilities with 30 thousand families. Shortly before the arrest of the head of the company Nikolai Karasev in 2006, he was very frank at one of the press conferences: “... they invited us to the eagle. I arrived, accepted me at the highest level, I lived in a cottage in which Yeltsin once rested. Velkovsky
* * Efim Velkovsky - in 1997–2001 mayor of the eagle. He brought me barbecue, saying: "The mayor does not fry every barbecue." The moonshine was treated, everyone is kind. The governor and I signed seven agreements, I did not need so much, but he insisted. "
"
Citizens are forced to go to the shared scheme, which becomes a kind of Russian roulette for them: someone is lucky, and someone will be tied for years
"
So when the construction sites “stall”, and the deceived equity holders take the “welcoming” governors by the throat, this is quite fair. And sometimes effective: in Tambov, for example, the authorities found financial opportunities to complete houses for equity holders. In Ryazan, they convey the “incomplete”, taking off all the encumbrances from it, the partnerships of homeowners, and even credit the affected equity holders on preferential conditions. But so far from everywhere. And therefore, the scope of the upcoming fan hunger strike in Russia is also expected considerable.
By the way, to get reliable information at least about the financial viability of the developer, before entrusting his money to him, is completely nowhere. Russian banks contrary to world practice are not engaged in project lending to construction. They credit equity holders counting on housing. Therefore, when the construction turns into a long-building or even stops due to the bankruptcy of the company, this, as they say, does not sink: they will always take their percentage for a loan from their borrower (he is a shareholder), despite the fact that he has already become twice injured.
The market - banks in this position are now at least half of 100 thousand “chronic” equity holders of Russia. Many have already said goodbye to a financial trap with the thought of an apartment-just to tear out at least some money to repay the loan from the developer. But this is very difficult.
“We must give the construction market to banks,” he believes
Lawyer of the Association of Association of Assembly Investors Sergey Yurchenko. “If banks are lending to the developer, then, firstly, they check all its summary, and secondly, they hold construction facilities, the movement of funds, including those attracted from individuals under the strictest control.” According to Yurchenko, with this practice, bankruptcy of construction companies, including false, is practically excluded. However, it is not possible to carry out this bill through the State Duma: “Many deputies believe that the control of banks will make the construction more expensive. Yes, perhaps he will. But then there will be less deception. ” We need control over shared construction sites and from the authorities, considers
Oleg Rephenko, Head of the Analytical Center "Indicators of the Real Estate Market": "If the construction sites begin to be problematic, it is necessary to identify them in advance, and not when the developer has already escaped with money." But it seems that no one is concerned about this. What remains the equity holders? Live for friends and relatives? Selling everything to the thread? Or - like the last shot - to go to the hunger strike. Like in South Tushin.
