In the first part of the material, we talked about how the informant of the American drug fighting agency (DEA) Paddie McCay tried to organize the supply of the Guinea Party Party with the help of the Russian pilot Konstantin Yaroshenko. The undertaking failed because Yaroshenko, contrary to his own statements, did not have the necessary connections and was not previously familiar with the “death dealer” Viktor Butu. However, the Americans saw in Yaroshenko a key witness precisely on the process above Bout. And then the second part of the operation related to drug trafficking began.
7000 kilometers from Kyiv, in the city of Monrovia in Liberia, worked under the guise of another agent Dea. In May 2009, an international drug dealer named Chigbo's mind turned to Fombe Sirliph, the head of the Liberian National Security Agency (ANB) with a proposal. Mind wanted to use Liberia as a transshipment point for the transportation of cocaine from South America to Europe. European customs officers began to be suspicious of direct freight flights from Colombia and Venezuela, and West Africa looked like a less obvious source of cocaine. The mind offered an official Sirliph the percentage of profit if he provides him to cover. Sirlif agreed, but then contacted his American partners, who organized a special operation to capture the mind with red -handed.

The Americans sent a “financial adviser” to the Sirliph, and at the next meeting with the mind, the head of the NSA delegated the cocaine deal to this adviser. Thus, he met Nabil Heid, a “Lebanese businessman”, who secretly from the drug dealer was a Cyprus informant of Dea named Spiros Enotiades. The next thirteen months he filled, coordinating the scheme with his mind, and, as in the case of Macakey, his tape recorder was included in all their meetings, where his mind explained the details of his negotiations with Colombian suppliers.
Unlike Yaroshenko, his mind had a documented criminal story. In the 1990s, the mind was transported by heroin from Afghanistan to New Jersey through his hometown Lagos in Nigeria. He was arrested and served in prison for six years before he returned to his previous lesson. Now he is serving a twenty -five -year term in the United States for a conspiracy with the participation of Yaroshenko. And this despite the fact that Yaroshenko and his mind met only in mid -May 2010, two weeks before their arrest.
By February 2010, it became clear that, despite all his attempts, Konstantin Yaroshenko could not organize the illegal sale of weapons. So I got an invitation to Kyiv. The Colombian suppliers of the mind had problems with organizing the transportation of their goods, and filled him offered to unite with his partner, an “aviation expert”, who could provide “the necessary aircraft necessary for our work”. McCay told Yaroshenko that his boss was finally ready to come to Kyiv to meet, and if he remains impressed, favorable offers for work will follow: to fly regular flights from South America to Western Africa.
Before introducing Yaroshenko Nabil, McCay explained the situation:
“Serious people” needed to transport a “special cargo” from Bolivia to Liberia, and they need a reliable partner with experience in this kind of work.
“I have 1, 2, 3, 5, 10 aircraft,” Yaroshenko answered. McCay several times emphasized that Yaroshenko will have to convince “these serious people” that he is able to fulfill such a flight: “The main thing is that he wants to know was filled is that you are capable of such a job. They want to transport a large number of drugs and do not want to endure losses. ” Yaroshenko in broken English, as usual, using the past time, assured Mackeya that he is capable of: "I have been working all over Africa, I have been working in Angola for five years, I fly to Viktor Buta." McCay, who played a small role in the DEA against Buta, grinned and, ascending, said: “Yes, of course ... Victor ... I don’t know how he is doing. I have not heard any news from him for a long time. ” (McCay, of course, knew that at that moment Viktor Boot was in Thailand prison, waiting for extradition in the USA. McKay and Yaroshenko discussed this at the meeting in December 2009.)
McCay returned to the topic. If the meeting with the nabil is good, then some more work is possible: short flights within Africa-“50 kg, 100, 200, on a small plane between Monrovia and the Account.” Yaroshenko replied that he could: “Transfer the load from point A to point B. is my job. I am a professional. Point A, point B. no more. "
When he got into the hotel room InterContinental, he greeted Yaroshenko with the word "health" and spoke (already in English) about how in the 90s he drank with Georgians in Moscow. Then they got down to business: the Colombians needed transport. How many kilograms can Yaroshenko transport? What aircraft? How many weeks? Do Yaroshenko should rent Ilyushin-76 (Illusion in the DEA transcription), or can it use the An-12, which sells Mcake in Monrovia? Where and when can Yaroshenko meet the Colombians? This last paragraph was very important, because Konstantin will have to agree on the price with them, and not with a stuffed. The task filled only consisted in ensuring security in Liberia. The reward of the Nabil will be 300 kg of goods. Therefore, he wants to do everything possible so that the delivery is carried out as soon as possible. That is why he helps Yaroshenko.

And, by the way, adding the intrigue who changed the fate of the Rostov pilot, he stuffed this seemingly insignificant detail: “I know, it sounds stupid that we are going from Colombia to Africa, and then from Africa to America, but I have customers in America.” He filled it explained that Delta no longer serves Monrovia, but there is a direct flight from Akkra, the capital of Ghana. So, can Yaroshenko also make a short flight from Liberia to Ganu? He filled the packaging of his portion of goods to diplomatic packages, which will be transferred from Yaroshenko’s aircraft directly to the Delta aircraft right on the airport landing lane - without storage. Can Konstantin do this? Of course, he can - "point A, point B".
This last detail gave the American court jurisdiction against a Russian citizen who never stepped on American land.
The scheme of illegal turnover of cocaine was no more successful than the weapon turnover scheme. On March 7, he stuffed the Colombians that he had concluded an agreement with the "owner of the car ... He is a very serious person with great experience and a professional in this business." He filled the Colombian to come to Kyiv to agree on prices. But it turned out that it was difficult for them to get a visa, and, as in the case of the Guineans, this meeting did not take place.
McKay also filled, however, they made another trip to Ukraine at the end of March. Then it was decided that Yaroshenko should become the official owner of the An-12, located in Liberia. McCay insisted that “for tax reasons”, the aircraft would be sold Yaroshenko for 1 euro “and other compensation”, although the parties concluded a separate agreement that Yaroshenko ordered to pay 300,000 euros and cover the costs of all repairs on their own. Yaroshenko claims that he paid them in cash and that, of course, the Dea deleted the record of this moment - he certainly is not on the recording.
In any case, before the aircraft could officially use the airport runway, it had to be registered, and before he could physically climb into the air, he needed a new engine. In addition, even if the An-12 could fly, he probably did not have a range of opportunities to go entirely from Bolivia to Liberia with goods without refueling. That is why, at the end of the meeting, on March 30, McCay was asked Yaroshenko to calculate how much the preparation of the An-12 for a flight from Venezuela to Liberia would cost. The next day, Yaroshenko came prepared, with a detailed calculation of expenses: from fuel to eating for the crew. As a result, he counted an amount of $ 900,000. I got into an interest in how much he would like to get from the Colombians for the services, and in the notebook of the Hotel Intercontinental
Yaroshenko recorded prices: $ 4.5 million from Venezuela to Liberia, $ 1.2 million from Liberia to Ganu.
Both papers were given as evidence of the criminal plan of Yaroshenko.
On April 1, Nabil wrote Yaroshenko a letter by e -mail with an invitation to Liberia two weeks later for negotiations with the Colombians. Two days later, Yaroshenko replied that he was ready to come to Monrovia "for meetings, to inspect the car." DEA agents Milion, raspska and Stoach arrived in Monrovia to organize wiretap, and then arrest Yaroshenko and mind. Meanwhile, his mind stuck in Amsterdam as a result of the eruption of the Icelandic volcano Eyufyatlayokudl, and the Americans had to wait in Liberia until May.
The mind was indeed an experienced drug dealer: he used the present time to search for new opportunities. On May 2, Rapaska wrote to prosecutors involved in the operation in the Southern District of New York, which he changed all plans by organizing two cocaine deliveries to Liberia-one on a ship, another on a private plane of a familiar Colombian. Yaroshenko will still be necessary to fly from Liberia to Ganu, from where the share of the mind will be transported to Europe, and the share was filled with Delta flight, but now Yaroshenko did not need to look for a plane that could make a flight from South America to Africa.
Yaroshenko found out about this only on May 11, when he arrived in Monrovia. According to the Russian, upon arrival in Monrovia right at the plane of the aircraft, the officers of the ANB Liberia Aless and Joe took his passport and followed him everywhere in the next three weeks - they even spent the night in his room in the early days.

Before dinner, a few hours after the arrival of Yaroshenko, he filled the Russian pilot that the Colombians would be ready to send their parcel in four days. Yaroshenko complained that it was “impossible” to rent a plane and assemble the crew in such a short time. He complained to the lack of money, because customers so often canceled orders, and filled him to console him, assuring his services will still be necessary for flying from Monrovia in the battery in order to "coordinate logistics with the Delta aircraft."
In addition, he explained, the Colombians will still be interested in Yaroshenko’s services for future supplies, and therefore Yaroshenko should come to a meeting with them two days later, with a prepared list of aircraft that he could use for transatlantic flights.
On the afternoon of May 13, Yaroshenko was first introduced to his mind, his accomplice in a crime. The Colombians have not yet arrived, but stuffed he called one of them and transferred from Spanish into English. The mind also participated in the negotiations, and the parties agreed on the previously proposed price of 1.2 million dollars for a flight from Liberia to Ganu, and, in principle, agreed on a price of $ 4.5 million for future transatlantic transportation. Having hung the phone, I got it again mentioned that its share of cocaine would be loaded in the Accra “Delta flight”, but warned both accomplices not to tell anyone about it: “I don’t want anyone else to know that I was sending to the United States.”
Over the next two weeks, nothing special happened. Yaroshenko remained in Monrovia and periodically met with his mind and stuffed. In conversations, in the presence of his mind, Yaroshenko basically sat silently. When meeting with a stuffed, he continued to reason where he could find a plane suitable for a flight to Ganu. Problems with the AN-12 mechanics have not yet been eliminated, and the communications were filled in the Liberia Civil Aviation Department, in which they hoped to register the plane, were useless. Yaroshenko simply did not have an airplane in Liberia, and there was no crew. In conversations with the nabil, Konstantin often said how he could organize everything in two days, and after a couple of days this conversation was repeated again.
At this time, one dialogue was held, which was probably of great interest to DEA agents. On May 18, when I filled it again, I apologized for the difficulties in registering the bought An-12, Yaroshenko suggested: “It is probably difficult to register companies because of Viktor Buta.” He filled out that he was unfamiliar with the name, and then, as if suddenly remembering, he pretended to be surprised: "Aaa, Viktor Bout." Yaroshenko explained that Boot registered 50 aircraft in Liberia. He filled the assumption that Boot was probably a “friend of Taylor”, the former president who left the country in 2003 after a defeat in the civil war. Yaroshenko asked if he had been filled with a movie about Buta, and the informant immediately issued the name “Death Calm”, a Hollywood blockbuster with Nicholas Cage about a weapon trader, who actually has little in common with the real history of Viktor Buta.
In his broken English, Yaroshenko again said: “I work for this ten years ago” (I working to this ten Years ago). He filled the curiosity where the Bout was now, and Yaroshenko replied that Bout was in Thai prison. I filled again surprised: “God, with all the problems of Thailand? Maybe Victor made a civil war for them? Maybe he had a war to escape. Interesting. I did not know that. Does Paddy know about this? He didn’t tell me anything. ” In 2010, mass protests with the use of violence were really held in Thailand, but this was far from a civil war.
In the last week of May, Yaroshenko began to get nervous. The supply of cocaine from South America was still delayed, the Liberia Civil Aviation Department refused to register the An-12 aircraft, and he almost did not have enough money for a room at the Royal Hotel for $ 150 a day. A couple of times, Yaroshenko hinted to Nabil that he could successfully follow the plan, leaving Liberia to try to register the An-12 in Georgia, or return to Russia to dial the crew. According to Constantine, he did not have access to his passport. Under the pretext of a possible arrival at any moment, the Colombians with cocaine, he convinced Yaroshenko to be in the place to meet with them: it is better to gain patience and stay in Liberia, soon everything will work out.

Yaroshenko obeyed. Through Skype, he continued to try to find the plane, but to no avail. Among the things confiscated after his arrest, there was a notebook sheet with a manuscript list of five aircraft that he could rent for a flight from Monrovia in the battery. But not one of the options turned out to be affordable.
The penultimate meeting of Yaroshenko filled, recorded by agents, took place on May 25. They drank coffee, and very little of what was said, was heard in the record. At the beginning of their conversation, Yaroshenko was uncharacterly rude with the waiter. “For the first time I see how you are angry,” noted. Yaroshenko said something about the ending cigarettes, and nothing legible is heard for twenty minutes. Twenty minutes later, he filled the bag with the recorder, and within the next two minutes it is heard that Yaroshenko still does not have a crew for a flight in the battery, not to mention the plane. Then the sounds on the record again merge into an illegible hum.
But nothing of what they said during this meeting was important. On the same day, on May 25, shortly after the conversation, Yaroshenko and filled in the Southern District of New York, prosecutors brought a closed charge that officially incriminating Yaroshenko to participate in conspiracy in order to import drugs to the United States. At the Venezuela’s small airport, Colombian merchants have already agreed to pay 600 thousand dollars to a team of air traffic controllers, which would be on duty on the evening of May 26. Their cargo should arrive in Liberia early in the morning of May 27.
But, as usual, nothing happened. Nonal weather delayed the Colombians on Earth in Venezuela for one night, and then for the second. On the evening of May 27, the RASACE agent, who was in Monrovia and in touch with colleagues in South America, wrote to prosecutors in New York that the Cocaine party from South America was not sent again. Nevertheless, should the agents arrest the suspects how they have already planned? Raskaka was worried that even if they were arrested immediately, because of “some questions with the charter, it may not have been able to leave Liberia before Sunday” on May 30. That is,
Despite the fact that there was no aircraft, no crew, no cocaine, American law enforcement agencies planned to take Yaroshenko and transfer it to America as soon as possible
- Preferably no later than Sunday.
Yaroshenko was detained in Royal Hotel on Friday on May 28 in the afternoon. Judging by the correspondence in Skype, Yaroshenko spent Morning, trying to buy a plane. After lunch, the second in a row, almost completely inaudible on the record, ended the meeting once again with the hope that they finally found a way to register the An-12 in Liberia.
The DEA manuscript notes and the data of the clerk of the clerk in the Royal Hotel and the Liberian NSA agent tell the history of the pilot’s detention. On May 28, American agents paid the hotel lobby for $ 20 for going out for the street for fifteen minutes. During this time, agents of the Liberian NSA by force put Yaroshenko in a red jeep. Бесспорно, компании, связанные с Бутом, занимались операциями в Анголе в то же время, когда Ярошенко работал вторым пилотом в экипаже российских летчиков в разрушенной войной стране. Возможно, DEA полагало, что единственный самолет Ярошенко — «Виктория» — был связан с Бутом. Ярошенко купил самолет в июне 2008 года у Phoenix Avia, армянского филиала компании, связанной с давним партнером Бута Ричардом Чичакли. Согласно двустороннему соглашению, США обязаны уведомить российские власти в течение 72 часов о любом аресте одного из ее граждан, и наоборот. Вот почему был вызван дипломатический скандал, за который США 23 июля 2010 года официально принесли извинения, когда американский дипломат случайно отправил уведомление об аресте Ярошенко в посольство Румынии. «Мы сделали одну ошибку и нажали не на ту кнопку на факсе», — пояснил пресс-секретарь Госдепартамента Филип Кроули 23 июля, спустя почти два месяца после принудительного прибытия Ярошенко в США. Но не это самое вопиющее нарушение дипломатических норм.
Большее недоразумение возникло после разъяснения Госдепартамента: «Когда была сделана попытка консульского уведомления 2 июня, оно было случайно перенаправлено». 2 июня, в среду, через 5 дней после задержания. То есть американцы усвоили урок из дела Бута, и в деле Ярошенко они не рискнули затянуть процесс экстрадиции. Срочный перевод Ярошенко из Либерии в Нью-Йорк был не результатом «дипломатической ошибки», а частью плана. Даже если бы 2 июня была нажата «правильная кнопка», когда состоялась первая попытка отправить уведомление в Россию, это ничего не изменило бы в ситуации Ярошенко. Физически он уже находился на американской земле еще до того, как США попытались уведомить российские власти о его аресте и американцы не были готовы вернуть его ни при каких обстоятельствах.
Других возможных выводов нет: Константин Ярошенко был похищен правительством Соединенных Штатов Америки.
Супруга Константина Ярошенко продала и машину, и квартиру, чтобы нанять способного адвоката Ли Гинзберга, которому пришлось принять непростое решение. В американской правовой системе можно выстроить стратегию защиты «провокацией» (доказывать, что подсудимый совершил преступление только потому, что правоохранительные органы создали для него такую возможность), но одним из условий такой защиты является то, что характер обвиняемого становится частью рассмотрения присяжными. Чтобы победить с помощью этой стратегии, Гинзбергу пришлось бы доказать не только то, что Ярошенко спровоцировали на участие в криминальном сговоре, но и что он не был «склонен» совершать преступление на самом деле.
Проблема заключалась в том, что у прокуроров имелось несколько часов записей, на которых Ярошенко с энтузиазмом пытался организовать торговлю оружием и в которых он упомянул свою фиктивную связь с Виктором Бутом в прошлом. К апрелю 2011 года, когда процесс Ярошенко начался, Бут уже был экстрадирован в США и его часто упоминали в новостях. В ноябре 2010 года популярная воскресная вечерняя новостная программа на канале CBS даже показала хвалебный репортаж, в котором герой Луи Милионе сам рассказывал историю операции против Бута от начала до конца. Гинзберг беспокоился — наверное, не зря, — что если присяжные услышат, как Ярошенко хвастается на секретных записях своими связями с печально известным «торговцем смертью», его дело станет безнадежным.

Вот почему Гинзберг пошел на соглашение с прокуратурой. В ходе судебного процесса он не будет обвинять DEA в том, что они подставили его клиента, а лишь будет выступать против официального обвинения в «заговоре с целью ввоза наркотиков в Соединенные Штаты». Чтобы победить, ему нужно было доказать: Ярошенко не понимал, что, согласно плану, доля кокаина Набила будет отправлена из Аккры в Нью-Йорк. В обмен на это прокурорам было запрещено говорить о схеме оборота оружия, над которой работали Маккей и Ярошенко с сентября 2009 года по март 2010 года. Для Гинзберга эта сделка содержала скрытую выгоду: судя по тому факту, что Виктор Бут был известен как торговец оружием, а не торговец наркотиками, у прокуроров не было бы уместного аргумента, чтобы привести имя Бута в зале суда. Гинзбергу было запрещено напрямую оспаривать мотивацию DEA. Тем не менее судебное разбирательство выявило множество интересных деталей о методах, используемых для захвата Ярошенко. Например, за последние годы Маккею заплатили 450 000 долларов, еще 1,7 миллиона долларов «Набилу» за работу с DEA. Маккей и «Набил» не занимались стратегическим планированием, а следовали выдаваемым указаниям. И когда Набилу было сказано упомянуть в своих беседах с Ярошенко фразы о «рейсе Delta» и «клиентах в Нью-Йорке», именно это он и сделал. И, конечно, в соответствии с американским законодательством, именно «понимание» пилотом того, что часть товара окажется на территории США, сделало Константина Ярошенко, который никогда не ступал на американскую землю, виновным в глазах американской юриспруденции. Гинзберг, согласно его соглашению, не мог спорить в суде о «провокации», но, раскрывая контуры операции DEA, он намекнул на это.
У прокуратуры был свой аргумент. Ярошенко принимал активное участие в схеме торговли наркотиками. И когда согласился купить самолет за 1 евро и «другую компенсацию», летчик понял, что в условия сделки входит доставка партии кокаина. Гинзберг легко мог бы парировать, что Ярошенко согласился оплатить 300 000 евро за этот самолет, но не стал делать этого. Более того, и даже этот ложный аргумент подтвердил фразой «самолет — приманка». Его стратегия едва не сработала.
После прений, когда присяжные начали закрытое обсуждение приговора, их мнения о виновности разделились 10:2 против Ярошенко. Одна из них, писательница из Бруклина, понимала, как выстраивается сюжет. Учитывая обстоятельства его ареста, она не хотела голосовать против Ярошенко, и по сей день она сожалеет, что чувствовала себя обязанной проголосовать за его виновность. Но другие члены жюри напомнили ей инструкции судьи: они должны были решить только, «знал» ли подсудимый, что часть кокаина окажется в Соединенных Штатах. Все остальные вопросы были лишними. Десять присяжных указали на строку в стенограмме мартовских встреч в Киеве, на которой Набил сказал то, что ему было велено сказать, и согласие со стороны Ярошенко стало преступлением по законам США:
