The process of the process
Court: Kromsky District Court of the Oryol RegionConvicted: Maria Polukhina
Article: Part 2 of Art. 81 of the Criminal Code, part 6 of Art. 175 PEC of the Russian Federation
Decision: Liberation refused
The village of Trosna, Oryol region, Pervomaiskaya street. The Kromsky district court, located here, looks like a matchbox. Convenience in the yard. There are also fallen ripe apples, which are sometimes collected by court officers.
At 11 a.m. on August 21, the court was supposed to consider the request of a convicted cancer patient for release (assets). It was likely that a woman with her petition was wrapped. The probability was justified.
“You can keep an audio recording, because publicity,” just in case, Judge Ruslan Erokhin (with gray hair, for 50) announced the situation in the country of uninvited guests.
The lawyer asked the judge to introduce to the case of the appeal of Amnesty International addressed to the Prosecutor General of the country and the head of the FSIN with a request to release the cancer patient due to illness. Judge Erokhin became noticeably bad:
- What does this have to do with the request for liberation? Are we just like waste paper, or something, should it be introduced? -The judge tried to preserve an extreme degree of equanimity on his face, but could not and waved to the Amnesty employee, who wanted to explain something from the place. - No need! You are as a listener!
The public defender explained that appeals say that "that the fate of a given person is not indifferent to many people."
- And what's next? Is this some kind of proof?
-Well, you read out the conclusion of the medical unit of the FSIN that the convicted person is not subject to release due to illness. Where in this conclusion is the proof that her disease is not included in the list of diseases that impede the serving of a sentence? There is no evidence. But you purchased the paper.
- This conclusion is a necessary document. It will be taken into account as evidence, and the judge turned to the convict: “They are these citizens who wrote these papers from this organization or what it is called ( Amnesty International is called. * - V. Ch. *), Know better than you, what are you discovered?!
The convict was scared, but also asked to introduce the papers. Actually, besides human rights activists, no one was more interested in her health over these two years. It was 61-year-old Maria Polukhina, a defendant of Voronezh poppy, three years ago, sentenced with the whole family-husband, daughter and sister for terms of 8.5 to 9 years-for the sale of food poppy, which the no longer existing FSKN declared a drug.
For the last decade, hundreds of criminal cases have been instituted for food merchants, and each specific history had its own operatives and their Feesbashniki, roofing markets, outlets and cafes. And who refused to cooperate, ran into the FSKN. As a family of Polukhins, who refused to first share cops with roofing cafes, and then with the investigation offering to close the case for a bribe.
This spring, Maria Polukhina underwent a difficult operation (oncology), then 24 courses of radiation therapy. Prior to this, for two years, she complained about severe pain and bleeding, but the IK-6 administration of the Oryol region referred to the lack of equipment and doctors, then to the lack of a convoy that could accompany the convicted to a civil hospital. When Polukhina asked to transfer her to a colony-settlement, IK-6 asked the Kromsky District Court not to do this: the convict “sharply reduced her social activity”, “does not plead guilty” and “does not experience a sense of repentance”. The court agreed.
Immediately after the meeting, Polukhina became bad and she (finally, two years later) was hospitalized in the hospital, whose doctors found her second-stage cancer and urgently operated on. Moreover, the civilian doctor cursed greatly due to the loss of time.
The colony in front of Polukhina did not apologize (something else). But the regional court, having urgently examined the defense complaint, transferred the woman into a colony-settlement.
By that time, the civilian doctors also discovered hepatitis C, according to her, according to her, she was infected immediately upon admission to IK-6, when the female doctor examined 13 arrived convicts with the same medical instrument, without disinfecting him (the relevant statement by M.V. Polokhina was at the disposal of the editorial office, as well as permission to announce the diagnoses).
None of the employees of the IK-6 were responsible for the unlimited negligence and nonsense, although their relatives wrote a statement about the crime in the UK.
In the summer of this year, the daughter of Maria Vasilievna Yana Oresh, as a public defender, filed everything in the same Kromsky district court to release her mother from serving a sentence due to illness (the so -called asset). Basic: the “List of diseases that impede the serving of sentences”. These include all cases of malignant neoplasms that require treatment in a specialized medical clinic. Meanwhile, an oncologist at the colony-settlement in the village of Shakhov never was and will never be, like a doctor who could take a biopsy.
But the medical unit of the Federal Penitentiary Service, the one who refused to take the woman for examination for two years, now brought to the district court the conclusion of the medical commission that the recently examined the convict showed that her disease did not fall into the government list at all and therefore it was not presented to the release "(in addition, the blood group was indicated in these papers, which was 60 years old, which was 60 years old Polukhina).
“Your honor, I was not examined,” Maria Vasilievna herself said from the colony. - This conclusion was made on the basis of previous documents. I did not pass the examinations. After the operation in February 2018, I was examined only once. I left the hospital four months ago. And for 4 months I have never taken blood for a biopsy, although I constantly asked ...
“I see,” the judge answered and asked for something to say a representative of the medical unit. The young blonde introduced herself as the head of the branch of the medical unit No. 3 of the FKUZ MSCh 57 of the Federal Penitentiary Service of Russia, Major of the Internal Service Tatyana Usacheva. She admitted: the commission studied only the outpatient card Polukhina, herself convicted of the medical board “was not exported”. Then I quote without bills:
- Yes, the convict has a disease. Eat. But given that at the moment she is serving a sentence in a colony-settlement, there is a kind of license for aid. Convicts receive the rest of the help for compulsory medical insurance - the compulsory medical insurance policy. Therefore, it is not presented for liberation. In a colony-settlement, she can donate blood according to the compulsory medical insurance policy. Can contact a paramedic.
- She even changed the diagnosis. At the moment, the stage of remission. We can say a disease in the process of attenuation. Well, that is, a lull.
“Lockery,” the judge repeated in the affirmative.
- Yes. But what will happen in the future, no one will say.
- Well, that is, you can state a certain improvement in the condition?
- Lockery.
- Lockery. Well, at least not a deterioration, right?
- Not a deterioration.
The public defender had questions for the head of medical part. Mrs. Usacheva repeated that the convicted person could calmly be served according to the compulsory medical insurance policy "on the basis of the city central district hospital."
- But there is no oncologist. Why do you think that specialized medical care can be provided at the place of serving? - asked Yana Nut. The head of the medical unit was true to herself: "Convicts, who are in the colony-settlement, provide assistance on the compulsory medical insurance policy."
Maria Polukhina herself could not stand:
- Your honor, when I just arrived at the settlement, I had an attack. The ambulance arrived. The doctor was injected with such injections that I got even worse.
A day later, the attack was repeated. And when the doctor arrived again, he said to me with the administration: "You do not call me, I can’t help her."
- I see, good. Prosecutor? - Erokhin turned to the girl in a pink tight sweater and with long red nails. That all the meeting was silent. Now it was extremely concise: "There are no grounds for liberation."
Judge Erokhin was in the deliberate room strictly 15 minutes: he did not let the pensioner Polukhin be treated to freedom.
... Two hours later we will be in the village of Shakhovo on a short -term date with Maria Polukhina herself, her daughter Zhenya and sister Nina Chursina. Despite the fact that this is a colony-settlement, it is impossible to move freely on its territory to the convicts, everywhere fences with barbed wire. More like a concentration camp.
We were given an hour to the meeting in the presence of an employee of the institution. The women told among other things about unsanitary conditions (for example, two shells in which convicts are erased and washed vegetables) about the fact that for two months they do not miss a “new newspaper” (and here they read it, “first we, a female detachment, are transmitted to the male”), and the number with the material about how Polukhin was not treated in IK-6, completely removed. Regarding the "provision of medical care":
Galina Muradyan, a doctor of the Oryol oncocenter,, where Maria Vasilievna is transported in three months, she cooperates so closely with the colony that, first of all, having not even examined the woman, asks: “What, I don’t want to sit? And you have to sit. ”
More: 9 months, Zhenya Polukhina sought to examine the dentist or at least the opportunity to go to a paid one. Finally, the other day they were allowed, but in the paid clinic “Dynasty” (G. Rel, 47 Gorky St.), they refused to accept it because they “do not work with convicts”.
The head of the planted family, 61-year-old Alexander Polukhin, is serving a sentence in a maximum security colony in the Voronezh region. He had not seen his family for three years, and his family. The dates of the imprisonment of them end in 2022–2023.
