Vasily Aleksanyan already has one verdict - his diagnosis. On Monday, February 4, the newly appointed judge of the Simonovsky District Court of Moscow, Olga Nedelina, studies all 115 volumes of the criminal case. The second day is the trial on the merits. On the third day, a decision was made: Aleksanyan should be treated. The process has been suspended. A day later, they decided to transfer Vasily Aleksanyan from the pre-trial detention center to the hospital. Vasily Aleksanyan was sitting in a cage. He took off his gray knitted hat. Thick woolen socks were visible from under the trousers. The sneakers looked almost new and clean: it is clear that they did not have to walk through the dirty Moscow streets. A small bottle of mineral water protruded from the inside pocket of his sports jacket.
"I'd rather be patient"
Judge Olga Nedelina entered the courtroom accompanied by two more judges. Everyone stood up, the judge invited Aleksanyan to sit down, but in response she heard: “I was brought here in a paddy wagon. No one asked if I was comfortable there and how I felt. Therefore, despite my physical condition, I can stand and testify while standing.” When the judge asked him if he had read the indictment, Aleksanyan, holding the bars of the bars with both hands, replied: “I did not have the opportunity to familiarize myself with the indictment. Because I can't read, the doctors forbade me to read because I can hardly see. The lawyer told me that it had 347 sheets, but I still don’t know what it says.” He told the court that he had been examined by a council of civilian doctors at the Botkin hospital and that "they officially confirmed the fatal diagnosis."

And today I learn that the judge has changed. And no one can explain why." Aleksanyan's lawyer Elena Lvova stated her position on the removal of the judge, referring to the fact that she would not have had time to get acquainted with all the materials of the criminal case in one day. The court retired for deliberation. The bailiffs began to drive the journalists out of the hall - they did not get up from their seats.
Soon the judges returned. Everyone got up. Judge Nedelina considered the application for removal of Nedelina "unreasonable and subject to rejection." The meeting continued. It was announced that a certificate had been received from the pre-trial detention center "Matrosskaya Tishina". “According to this document, Aleksanyan was recommended chemotherapy and treatment. Defendant, do you agree to undergo a course of treatment and attach this document to the case file? asked Judge Nedelina. “I have always agreed to be treated, Your Honor, in the manner prescribed by law. What you just read out does not cause any objections in me, ”Aleksanyan replied. The court again retired to deliberate. People started to leave.

“There is no evidence that Aleksanyan should be in custody,” said lawyer Gevorg Dangyan after the break. - At the time of his arrest, Aleksanyan was charged with committing especially serious crimes. It was presented with gross violations and was subsequently withdrawn ... The only evidence that the investigation referred to at the time of Aleksanyan's arrest was a document that was developed in Yukos. It was possible to find out that he had nothing to do with Aleksanyan. This is actually the only written evidence that was presented to the court when choosing a preventive measure ... Then it was not known about a serious incurable disease. “This person cannot hide anywhere,” lawyer Yuri Terekhin continued the thought of his colleague. “We ask you to show an act of the highest humanism and change the measure of restraint. Dozens of people are ready to give their guarantee” 1 .
State prosecutor Nikolai Vlasov was not against the suspension of the process, but categorically objected to changing the measure of restraint and release from custody: “Aleksanyan can hide from the court and obstruct the judicial investigation. There are no significant grounds for changing the preventive measure for him.”

Everything was short the next day. Judge Olga Nedelina pointed out that in the pre-trial detention center Vasily Aleksanyan was examined by specialists from the hematology center, the AIDS center and the tuberculosis hospital, who considered that in the conditions of the pre-trial detention center "he can receive medical care and undergo a full course of treatment." The process has been suspended.
“Did you understand what happened? They left me in a pre-trial detention center, and there they don’t treat me at all, ”Aleksanyan managed to say from the cell. His brother Garnik was looking at him all this time, shrugging his shoulders and shaking his head. “It doesn't mean anything. No positive changes in treatment,” Garnik Aleksanyan told The New Times correspondent in the corridor. At this time, Vasily himself was taken. "Freedom! Freedom! Freedom! — spread throughout the room.
“That's why I'm against our parents coming to court,” Garnik continued after a pause. They are already 70 years old. Can you imagine how hard it is for them all? He is also almost blind. He had many eye surgeries as a child. In one there is an artificial lens, the second used to be a working one. Prison made it even worse.”
The decision is made
On the third day, the proceedings were suspended, but the defendant was sent back to the SIZO. On the fourth day, it became known that the seriously ill Vasily Aleksanyan would still be transferred for treatment to a specialized civilian hospital. The first step has been taken.
Now the whole question is whether the investigation will be interested in Aleksanyan to live to see the trial.
Vasily Aleksanyan previously worked as a lawyer for Mikhail Khodorkovsky, Vasily Shakhnovsky and some other participants in the Yukos case. On March 30, 2006, he took over as executive vice president of the company. But he only worked there for a week. On April 6, he was arrested. “He is accused of embezzlement of the property of Tomskneft and shares of a subsidiary of VNK, legalization of property and tax evasion,” his lawyer Elena Lvova told The New Times. - A criminal case was opened under paragraph "a, b" part 3 of Art. 160, part 3 of Art. 174, part 2 of Art. 198 of the Criminal Code of the Russian Federation. At the moment, he has a diagnosis: HIV infection, according to the modern classification - in stage 4B, this is the last stage, followed only by death; T-cell lymphoma (cancer of the lymphatic system) and, as I understand it, based on the fact that he is undergoing anti-tuberculosis therapy, he either has a suspicion of tuberculosis or tuberculosis. Besides, he's almost blind." Where exactly Vasily Aleksanyan was infected with HIV is still unclear.
