Each person has his own torture, said one old, still Stalin's times of ZEK. What torture was chosen for Sergei Magnitsky, why and who “ordered” the 37-year-old lawyer-the New Times sorted out
He became very bad in the morning of November 16. The doctor of the therapeutic department of the Special Medical Unit of the Butyrskaya prison, Larisa Litvinova, recorded that "the stomach was moderately tense." I also recorded the "exacerbation of pain." “I considered that, perhaps, his condition requires a surgical examination,” she told a member of the Zoe Suppan Public Supervisory Commission on November 20.
* * This commission was created in 2008 on the basis of the Law "On Public Control over the Ensuring of Human Rights in Places of Forced Contents". At 14.47 they called an ambulance. Dmitry Kratov, the deputy chief of the pre -trial detention center in medicine, called the Sailor Silence of the SIZO: “We are taking the patient to you. It would be nice to examine him. Pancreatitis. " - "What, he has pancreaticocrosis?" - Olga Alexandrovna asked on the other end of the wire - “No,” Kratov answered. "Why are you driving then?" The woman asked in a white coat.

Sergey Magnitsky. Funeral. Pay attention to your hands
To the sailor's silence of the dying Sergei Magnitsky was brought at 18.30. “With pancrehenecrosis, the process develops rapidly: if you do not do an urgent operation, a person dies in 5 hours,” Timur Huseynov told The New Times. Judging by the picture that Svetova describes, in the hospital of the sailor silence this process was already coming to an end. But neither the surgeon nor the paramedic was in this Monday in the prison hospital. “With pancrehenecrosis, the temperature dramatically jumps, since the intoxication of the body, crazy, dagger pain begins with aggressive ejection of enzymes,” says Huseynov. With such pain, a person turns into a lump, squeezes his legs, tries to squeeze the hell with his hands that is happening inside him. The pain is worsened by reason, fear, despair, horror from the type of jailers. And not a single native face around. “You want to kill me,” he shouted. People in white robes considered that instead of a surgeon it is more useful to call a psychiatric brigade, which “drew a state with soft fixation,” the head of the Sailor Silence of the Sailor Silence of Tagiyev told members of the Public Supervisory Commission. That is, having tied his hands, they deprived the magnetic last protection against pain. Further, as it happens with pancreatic, excitement was replaced by a coma. Closer to 9 pm, Sergei Magnitsky was silent. Neither the jailers in and without and without, nor investigators, nor a judge - no one had power over him.
Order for $ 6 million
Sergey Magnitsky, according to the sources of The New Times, did not plan to kill. An annoying oversight occurred, as they say, overwhelmed.
He was simply “ordered”: a criminal case was opened against him, because there was a serious need for serious people.
Firstly, on June 5, and then on October 7, 2008, he testified to the investigator of the IC Prosecutor's Office of the Russian Federation for Moscow in the case of the abduction of subsidiaries at the Hermitage Capital Management investment fund, which later managed to steal more than 5 billion rubles from the state budget (more details on page 10).
Secondly, the Magnitsky lawyer required an indication for his client, the head of Hermitage Capital Bill Broud. Investigators of the Investigative Committee (SK) of the Ministry of Internal Affairs believed that Sergei Magnitsky was a key link in the organization of the activities of companies that provided the fund billionaire income.
“The money was entered into the FSB Office,” says the knowledgeable interlocutor of The New Times at the Ministry of Internal Affairs. “The price of the issue is $ 6 million. The Chekists supervised the process, and direct implementation was entrusted to investigators of the Investigative Committee at the Ministry of Internal Affairs.”
More precisely, to investigator Oleg Silchenko. It was in his name that he wrote his dozens of complaints and statements (they are at the disposal of the editorial office) Sergey Magnitsky. “Silchenko is a person who is designed to cover someone else's shit,” the lawyer of the Hermitage Capital Management Foundation Vadim Klener characterizes the investigator.
According to The New Times, received from sources in the IC of the Ministry of Internal Affairs, Silchenko is really nothing more than a performer. A completely different person, Deputy Head of the Department of the Ministry of Internal Affairs of the Ministry of Internal Affairs, Colonel Natalya Vinogradova, was responsible for making decisions.
Moreover, it is curious that the bunch of Vinogradov -Silchenko is not the first time in the high -profile affairs, behind which the FSB stands.
In 2007, it was they who fought the head of the Internyus Foundation Manana Aslanmazyan. “Silchenko never made any decisions. Absolutely uninitiated. Such with a smile is taken under the visor and go intelligently to fulfill everything that is ordered to them, ”recalls the lawyer Aslamazyan Viktor Parshutkin. - Vinogradova is a completely different person. Hard, smart, past Soviet school. Then they did not even hide: in the IC of the Ministry of Internal Affairs, Alanmazyan was "leaked to the implementation." The matter was absolutely political. There was no secret to anyone that his customers are tall people in the FSB. ” After the collapse of Internyus, Natalia Vinogradova, at the request of the FSB, was awarded the title of Lt. Col. * * The Constitutional Court of the Russian Federation on May 27, 2008 satisfied the complaint of Manana Aslanmazyan on the constitutionality of the article presented to her, after which her criminal case was terminated. “When my husband was going on, Vinogradova yelled at me and extorted $ 1.5 million,” says journalist Olga Romanova, wife of convicted entrepreneur Alexei Kozlova. -Then the intermediary contacted me with the rank of general of the Lieutenant of the Foreign Intelligence Service Pavel Sharai. In the SVR, he headed the Department of Economic Security. He promised that he would solve all issues and at the same time stated that Vinogradova had all relatives in the FSB. But, as her teacher told me, she had no relatives there. ”
They say that for efforts to promote the case of a lawyer Magnitsky Vinogradov received the title of Colonel: it is true that in no open document there is a name of her.
As during the investigation in the case of the Internyus Foundation, investigators of the Ministry of Internal Affairs of the Ministry of Internal Affairs, working on the Magnitsky and Hermitage case, worked in interaction with the FSB. For example, the editorial office has a report on the discovery “in the actions of Brauder U.F. / ... / signs of a crime under Part 2 of Article 199 of the Criminal Code of Russia”, addressed to the head of the department “K” of the FSB of Russia, at that time Major General Viktor Voronin **. Like most top managers of the Russia Corporation, Lieutenant General Voronin, a native of St. Petersburg, began his career first in the tax police, and then in the State Directorate of Control. He became known for the media thanks to his connections with Vladimir Barsukov (Kumarin), who had just, on November 12, was sentenced to 14 years in a maximum security colony.

This report was compiled even before the arrest of Sergei Magnitsky, in May 2007, and the letter to investigator Silchenko O.F. signed by the head of the department “K” of the FSB - already directly on the day of the arrest of Sergey Magnitsky on November 24, 2008. This letter reported evidence - the presence of a suspected foreign passport and that Magnitsky S.L. “Currently draws up an entry visa at the British Embassy, giving the right to travel outside the Russian Federation.” (In the case of Sergey Magnitsky there is a letter from this embassy that was not issued to him.)

HERMITAGE lawyers in London told The New Times that they knew that it was the “K” management that coordinated the work of colleagues from the IC of the Ministry of Internal Affairs. Moreover, in the summer of 2007, the intermediary (his name of the editorial office is known) organized a meeting of the leadership of the law firm Firestone Duncan, whose client was Hermitage Capital and in which Sergey Magnitsky worked, with one of the Officers of the KO Office - Denis Vasiliev. The meeting took place in the 1st reception in Lubyanka. The conversation was about the companies stolen from Hermitage and claims to Bill Brower. The purpose of the meeting is to try, as they say, to resolve the issue amicably, which, by the way, other participants in the stock trade market were also interested. “The FSB is today the only political resource in the country that remains,” says the intermediary in negotiations. Representatives of Hermitage in London claim that the question of any monetary reward to the FSB officers was not raised at the meeting. “The police stole documents from them, there are arbitrariness, the prosecutor’s office covers where they still had to go, if not to the FSB: it is a strong political body that could bring the problem of the problem to the very top,” the source that was well familiar with the Hermitage case and, by the way, does not experience no sympathy in a conversation with The New Times. “The FSB fully controls our entire law enforcement system,” the current opponent of the Russian authorities, Boris Kuznetsov, who is living in the United States, echoes him.

There is no more hope
On November 12, Sergey Magnitsky was for the first time really surrendered his nerves. On this day, the judge of the Tver District Court of Moscow Elena Stashina satisfied the application of the investigation about the next extension of the "detention of Magnitsky S.L." On November 15, the period of arrest was supposed to expire, and on November 23, a year of its detention was performed. The lawyer of Magnitsky green was the hope that suddenly he, who had not killed anyone and did not crippled, and besides the patient - in the first half of October he was hospitalized in the therapeutic department of the Butyrskaya prison (Camera No. 708) due to the exacerbation of pancreatitis - they would let go home.

On November 12, the court was appointed at 11 a.m., but, according to the lawyer Dmitry Kharitonov, “neither the judge, nor the prosecutor, nor the investigator appeared at the appointed time. An hour later, the second investigator in the case appeared, Oleinik. He went to the judge with a grin, stayed with her for some time, then went out and said: “Well, I brought the materials there,” Kharitonov told The New Times. According to the lawyer, when they got acquainted with these new materials, it became clear to them: they changed the position of protection. Sergey Magnitsky also understood this: he only managed to look at these materials in a convoy whistle in a convoy - his left hand was handcuffed to the battery, and he leafed through the right thing that lay on his knees. “/.../Volume No. 2 of the criminal case No. 311 578 is significantly different from Tom No. 2 of the same criminal case and its other volumes presented to me on October 20, 2009/.../,” Magnitsky wrote in another petition. “I have reason to doubt the honesty of the investigator Silchenko O.F., since he was in the course of court hearings in which his petitions for detention and extending the term of detention were considered, presented the evidence of the testimony clearly fabricated and containing false information for him (Silchenko).
When, finally, Judge Stashin began the process, Sergei Magnitsky filed a request that he was given the opportunity to discuss new materials with lawyers. At first I asked for a day, then an hour - the judge gave 15 minutes. He asked him to let him out of the “cage” so that he could work out materials on the table normally, she refused. She refused to accept certificates of health status, about his children. “Then Sergey announced his refusal to participate in court. I have never seen it on such a nervous platoon before, ”lawyer Dmitry Kharitonov told The New Times.
The next day, November 13, Sergei Magnitsky filed a complaint to the chief of Butyrka that on the eve of “he was deprived of the possibility of eating hot food for more than 24 hours,” since he was “kept for 5 hours in the chambers of the prefabricated department after delivery from the court”, and at night was transferred to a new camera. “I asked to postpone the translation until the morning, not to transfer me to another camera at night, but I was refused this,” he wrote.

On the evening of November 13 - it was Friday - Cabinet called to Sergey Magnitsky paramedic: “Magnitsky appealed to nausea, pain in the right hypochondrium,” said the prison therapist Litvinova, a member of the public supervisory commission Zoe Sveta. “We have experienced paramedics, if there was a sharp state, he would be immediately hospitalized,” said the woman in a white coat.
Mother of Sergei Magnitsky, Natalya Nikolaevna, in an interview with The New Times noticed that at the trial, “Sergey looked exhausted. He lost 18 kilograms ... "
On November 14, when lawyers arrived in Butyrka to meet with their client, they told them: “They will not deliver Magnitsky to you. They will not give you today. ” The appeal to the investigator Silchenko did not give the result: “Nothing terrible happens,” the investigator said to the lawyer Kharitonov. “We will not tell you any diagnosis, because this is our internal business.” Kharitonov immediately sent telegrams-stunts to the Prosecutor General and the head of the Investigative Committee of the Ministry of Internal Affairs.
On November 15, Sergei Magnitsky was in the therapeutic department of the Butyrskaya prison pre -trial detention center. Even in his first leaf, he told his lawyer to this special department: “There are not only doctors there, there are not even guards. They close you and leave. A person will scream, die - no one will help. ”
On the 16th he died ...
$ 230 million case
What did Sergey Magnitsky knew that it was “ordered” as much as $ 6 million, and as a “roof” they chose the “only political body of the country”?
But the fact is that the scammers in the uniform and without, who stole three subsidiaries from the Hermitage Sapital Foundation and then re -register them with comrades with a criminal past, carried out a fantastic fraudulent scheme: they said that the companies had no profit, but paid (paid the Hermitage Capital Foundation), and therefore the budget should return them. And returned! Moreover, in three days: December 21, 2007, the corresponding petition was submitted to the tax inspectorate No. 25 in Moscow, and on December 24, it has already been approved. On December 24, 2007, a similar petition was submitted to the tax inspectorate No. 28 for the same city, and satisfied on the 27th. The amount of 5 billion 400 million rubles, or $ 230 million (certified copies of the refund decisions and banking wiring are at the disposal of the editorial office). The New Times asked knowledgeable people how much time was required in order to get a tax return: there were exactly two options. One: “This is generally impossible in Russia,” said a representative of the financial business. Another: “3 months - and the signature of the Deputy Head of the Federal Tax Service,” says State Duma deputy Gennady Gudkov. On the sophisticated decisions are signatures of the heads of the departments of tax inspectorates No. 25 and No. 28 - five each, but all - no higher than the outcome.
But this is not enough: as the head of the Ministry of Internal Affairs of the Ministry of Internal Affairs of the Ministry of Internal Affairs of Justice Alexei Anichin, a crime associated with a theft of 5.4 billion rubles of budget funds, stated on May 7, was successfully disclosed and sentenced to the organizer of the crime Markelov V.A. One subtlety: a skilled fraudster at the time of the crime worked as a master of reception of lumber DOZ-160 of the Saratov region, and before that he was sitting. For murder. The question is: either he did not sit at all in the camp, but in some high office of some important department with windows to the Kremlin (but then why did he go to work on a sawmill in 2007?), Either someone else was storing a cunning operation in the amount of 5 billion.
By the way: this money was never found, and they did not return to the budget.
So, all this wonderful scheme with the theft of companies and the return of taxes was excavated by lawyer Sergei Magnitsky. For this he was "closed". What is $ 6 million, when an amount is almost 40 at a stake - $ 230 million.
SMS from Michael Carleone
In the case of Sergey Magnitsky, there are a lot of riddles. He was charged with acts by which criminal cases once, in 2003-2004, started and were closed after a lack of a crime. He was arranged in Butyrka torture, which is known among prisoners as a “carousel”, when they are transferred from a camera to a cell, not allowing to take root anywhere, placed in cameras with impossible conditions of detention, gave, according to his mother, the medicines that were contraindicated to him, “lost” the Prosecutor General’s Office and in the pre -trial detention centers, refused to treat and at the end, and at the end of it, and at the end of The ends were brought to death. De facto-killed. And the list of persons responsible for this murder is immeasurably wider than the head of the medical unit or even the head of the Butyr prison, whose heads are likely to fly.
There are also completely strange riddles. For example, on the phone of one of the employees of Hermitage Capital in London from the end of October 2009 and until November 19, SMS messages were held from the same number: +7909-633-55-88. To whom this number owns is unknown is in reserve: they say that one of the law enforcement agencies has.
For example, on October 24, lines came from the well -known song of the prison chansonnier Mikhail Circle: "He goes ... into such darkness ... to the Solikamsk prison ..."
And 8 days before the death of Magnitsky, November 8, this came: “If the story teaches something, then only that anyone can be killed. Michael Carleone. "
Two days after his death, they said: “A lawyer died in a pre -trial detention center / ... / Significant event. Custom articles will not help. Extradition, etc. " Hermitage is sure that this is a label to Bill Brower, they say, we’ll get it in London.
On November 19, an anonymous author spoke about money using a quote from “12 chairs” by Ilf and Petrov: “Come on Dange, Danhi come on. Coins flew. "
However, all these tricks will not add anything to Sergey Magnitsky. He survived. Not broken. And he paid with his life. And there he will be rewarded for his resistance, for it is said - "On his deeds ..."
** Major General Viktor Voronin is 51 years old, in state security authorities since 1981. In September 1998, he was appointed deputy, and in April 2000, First Deputy Head of the Department of the Federal Tax Police in St. Petersburg. The successful career of Voronin in the tax police was largely facilitated by his then leader, Lieutenant General Alexander Karmatsky, who headed the St. Petersburg Department of the Federal Tax Service in those years. The career of General Karmatsky was very helped by close friendship with the head of the St. Petersburg UFSB Viktor Circassian and authoritative businessman Vladimir Kumarin. After the coming to the power of Vladimir Putin and the elevation of Cherkesov to the post of the head of the State Directorate of the State Directorate, Voronin with Karmatsky went to increase. The first headed the FSKN Office in the North-Western Federal District, the second-the Office in St. Petersburg. Of the entire general Trinity, he retained and strengthened his positions over the past years, one Voronin, who on time (in 2006) went to work in the FSB, where he headed the KU Directorate. With enviable regularity, rumors appear that he can be replaced by the director of the FSO Evgeny Murov. Viktor Cherkesov came off the political scene after he allowed himself to publish the famous article "He must not be allowed to turn into merchants." This happened in 2007, and in 2008 he was removed from the post of Director of the Federal Drug Control Service, sending a non -decisive commission on the supply of weapons. General Karmatsky in March 2009 was retired. However, Lieutenant General did not work out in a calm old age. In June 2009, Vladimir Putin held a famous meeting with the security forces, where he stated that the result of the fight against smuggling was landing. "Where is the landings?" - the prime minister asked the security forces. Major General Viktor Voronin, General of Major General, showed himself more than everyone in search of an answer to this question: in September 2009, General Alexander Karmatsky was put on the wanted list. The former subordinate accused the former patron of the roofing of those very smuggled flows.
