
The Council of the Republic - the Upper Chamber of the National Assembly of Belarus - approved the inclusion of articles on extremism in the Criminal Code of the country. This was reported by BelTA. Earlier on Monday, the bill was adopted at once in two readings by the lower house of parliament - the House of Representatives.
The new law in the Criminal Code includes Articles 361-1 (creation of an extremist association) and 361-2 (financing of an extremist association). Criminal liability is not provided for participants in such associations. As explained, speaking at the Council of the Republic, the chairman of the KGB Valery Vakulchik, "ordinary members can fall under other articles of the Criminal Code." “For example,” he remarked, “a window broke,“ this is an article for hooliganism. ”
Earlier on Monday, Vakulchik also performed in the House of Representatives. “Our criminal law does not contain a single norm providing for responsibility for extremism,” he complained in his speech. “This is a concept in the current Criminal Code.”
What are the sanctions of "extremist" articles of the Criminal Code, is not specified.
The same law in Article 130 of the Criminal Code (inciting racial, national or religious enmity or razor, up to 12 years of the colony) is introduced a new composition - inciting social enmity or razor.
At the same time, adjustments are made to Article 17.11 of the Code of Administrative Offenses of the country (manufacture, distribution or storage of extremist materials). Now it also provides for liability for the replication of such materials, and not only included in the corresponding list. The authority to draw up protocols under Article 17.11 now, along with the KGB and the Ministry of Internal Affairs, also receive the prosecutor's office and customs.
Another short story stipulated by the bill introduces criminal liability for any handling of Molotov cocktails.
Finally, the new document also introduces article 361-3 into the Criminal Code (participation in armed conflicts abroad). Now the Code provides for liability only for mercenaries - the new article will allow criminal cases to volunteers. Criminal liability is also introduced for recruiting and preparing participants in foreign conflicts, as well as for financing or other support for their activities.
