
At the end of December last year, a statement by the speaker Magomed Daudov, better known for the call sign, appeared on the official website of the Parliament of the Chechen Republic (the call sign appeared in those days when Daudov was a member of the gang of the famous action movie Israel Makhmudov, and then the emir of the Kurchaloevsky district). In Daudov’s statement, he directly connected US sanctions and block accounts of the head of Chechnya Kadyrov on social networks (Instagram and Facebook) with the activities of human rights activists and journalists who give public facts of human rights violations in the republic. In conclusion, the speaker of the Chechen parliament openly called for the persecution and reprisal against "these enemies of the people."
On January 9, on the first working day of 2018, the head of the Chechen representative office of the human rights center Memorial Oyub Titiev was detained. Drugs - 206 grams of marijuana were thrown into his car during the inspection.
Titieva was taken to the Kurchaloevsky District Department of Internal Affairs, threatened with the criminal prosecution of his son under the article “Participation in illegal armed gangs” and demanded to sign “confessions”. Titiev refused to give the necessary testimony, indicating that his detention took place in violation of the law - in the absence of witnesses. Then the human rights activist was forced to get into the car, next to him, an employee of the Kurchaloevsky District Department of Internal Affairs sat down. When Titiev arrived exactly to the place where he was detained for the first time, he was again stopped by police officers. Literally a few minutes later the investigation team arrived with witnesses - and a drug package was seized for the second time.
Only due to the fact that the witnesses, both the first and the second detention, were able to transfer this information to the colleagues of Oyub Titiev, the human rights activist was not “disappeared”, his location was established, the Chechen lawyer Aslan Telhigov promptly left for the Kurchaloevsky District Department of Internal Affairs. However, the Telhigov lawyer was admitted to the building of the Kurchaloevsky District Department of Internal Affairs only 10 hours after the illegal arrest of Oyub Titiev. Investigator Salamov, well aware that Titiev’s lawyer was located near the building of the Kurchaloevsky District Department of Internal Affairs, in a hurry carried out the most important investigative actions, which the lawyer did not allow illegally. But - they were attended by all the same witnesses and police officers who detained Titiev and knew very well where drugs came from in his car.
The very next day, Moscow lawyer Peter Zaikin entered the defense of Oyub Titiev. Titiev’s colleagues, hired Zaikin, perfectly understood that sooner or later, pressure from the local security forces would be exerted on the Chechen lawyer. These assumptions were confirmed.
From January 10 to 23, investigator Salamov conducted only a couple of investigative actions with Oyub Titiev. Faced with the enemy, lawyer Zaikin, who was procedurally superior to him, Salamov decided to slow down the investigation. For the first time in many years of work in Chechnya, Zaikin was installed external observation and demonstrative surveillance - on cars with clearly “left” numbers.
On January 18, investigator Salamov, informed that Peter Zaikin flew to Moscow on this day, unexpectedly appointed investigative actions for January 19. From a senior source of Novaya Gazeta, in the central apparatus of the FSB of the Russian Federation, information was received that on this day a provocation was being prepared against the lawyer Zaikin in Chechnya. The New Gazeta and the Memorial PC quickly published this information, and the next day the investigator Salamov canceled the planned investigative action without explanation.
But as soon as the lawyer Peter Zaikin left Chechnya, pressure began on the Chechen lawyer Oyub Titiev - Aslan Telkhigov. As a result of this pressure, Telhigov’s lawyer was forced to escape beyond the borders of the republic and leave the case of Oyub Titiev.
At the moment, its whereabouts are unknown. According to the information received by the Chechen lawyers, to all members of the Bar Chamber of Chechnya, a request came, in an ultimatical uniform, obliging to notify the leadership of the chamber about the whereabouts and phones of Aslan Telkhigov. Also, the “new” became known that he was looking for the Ministry of Internal Affairs of Chechnya.
Immediately after the forced departure of Telkhigov, on January 24, from Chechnya, the investigator Salamov appointed investigative actions with Oyub Titiev, for which Oyuba was deported from the Grozny pre -trial detention center in the police department of the Kurchaloevsky district. Investigator Salamov refused to inform Peter Zaikin, who was at that time in Moscow, what kind of investigative actions, and even in the absence of lawyers, he intends to conduct. Lawyer Zaikin urgently flew to Grozny.
At 11 hours on January 25, a consideration of an appeal was appointed in the Chechen Supreme Court to choose a preventive measure for Titiev (earlier the court appointed him two months of arrest). However, the meeting was disrupted. The human rights activist was not taken to the court building, which is an unprecedented violation of the priority of the court over the investigation, on this day no investigative actions with Titiyev could be carried out. Where he is located, no one knew. Such information was also not provided to the court. The judge of the Supreme Court of Chechnya Madayev, which was clearly preoccupied with this emergency, did not postpone the meeting the next day. He ordered Oyub Titiev, wherever he was, to the court by 17 o’clock. He also summoned to a meeting of investigator Salamov. Lawyer Zaikin urgently drove in search of Oyub. However, it was not possible to find out anything about his whereabouts from investigator Salamov.
Human rights activists and journalists who arrived from Moscow announced an alarm and published information about the strange disappearance of Titiev, for which the FSIN of Chechnya, who had previously observed the laws of the Russian Federation, has been responsible for the fate of him in the Terrible pre -trial detention center.
Only after the rising noise, Oyub was still taken to the building of the Supreme Court of Chechnya-without visible traces of violence. It also became known that the investigative actions appointed by Salamov did not take place with Oyub Titiev. Why then were Titieva exported to the ROVD of the Kurchaloevsky district? Investigator Salamov refused to clarify this strange situation.
A source of Novaya Gazeta in the leadership of the Ministry of Internal Affairs of Chechnya said that the investigation in the case of Oyub Titiev is supervised at the highest republican level. The first deputy Minister of Internal Affairs of Chechnya Alaudinov is responsible for the result.

The head of Chechnya Kadyrov actively exerts pressure on the investigation, calling Titiev in all his public speeches. Such actions of Kadyrov, the head of the region, representative of the executive branch, rudely contradict the Constitution of the Russian Federation, namely Article 10 (on the separation of powers) and Article 49 (on the presumption of innocence). In the last performance of January 31, Kadyrov, representing the security forces of the new commander of the North Caucasus District of the Russian Guard, offends Oyub Titiev and speaks contemptuously in the female gender, as previously previously spoke about the murdered homosexual Zelima Bakaeva:

In a situation where Kadyrov, without waiting for the results of the investigation, has already pronounced the verdict to Oyub Titiev, the investigation itself demonstrates signs close to panic. For the investigation of this case - quite an ordinary for Chechnya - a whole group was created: "Due to the complexity of the investigation and a large amount of investigative actions." Chechens were strengthened by employees of the Ministry of Internal Affairs of the Russian Federation, seconded from different regions. The reason is clear: the second -better local people know the laws of the Russian Federation, and all hope is on them. Alas, it did not help.
On January 26, an identification was to be held. The witness, who, apparently, testified about how Oyub Titiev allegedly acquired 200 grams of marijuana, had to now identify him. In the absence of “grateful” testimonies of Oyub (namely, on such confessions, the vast majority of sentences on criminal, including “narcotic” articles in Chechnya) was based on such conference, this witness was extremely important for the investigation.
On January 26, Titiev and two statists were brought into the investigator’s office. The investigator Agabekov (Dagestan) conducted an identification. He suggested that all three put on the same black T -shirts and turn to face the wall.
- Mr. investigator! - the lawyer Zaikin grinned. “Have you forgotten about slippers?”
Unlike two statists, Oyub Titiev, under arrest in the pre-trial detention center, was not shod in boots, but in rubber slippers. It is according to this detail that the prepared “witnesses” very often “identify” the right person.
Investigator Agabekov sighed heavily, took out his boots and handed them to Oyub Titiev. They were two sizes smaller, but Titiev squeezed into them, realizing how much it now depends on these boots.
When the witness Amadi Baskhanov was introduced into the office, he first stared at the feet of the people lined up in front of him, among whom he was supposed to identify Oyub Titiev.
The following is recorded in the confrontation protocol: “To the question whether the persons who were presented to identify previously were identified before, and if I saw, when, under what circumstances, Baskhanov, Amadi Ramzanovich, examined the presented for identification and stated that he could not identify anyone.”
But actually the matter was not entirely true.

To begin with, witness Baskhanov looked and behaved extremely strange. This is how his lawyer Zaikin describes:
“The witness, in my opinion, had all the signs of drug intoxication. The pupils were huge, the size of a rainbow shell. He moved very slowly. He stood, swaying, he did not react to the investigator. The investigator repeatedly asked him questions, but there were no answers from the witness. He did not know Oyuba, it was quite obvious. He tried to focus on the legs of the identified, as if looking for a clue.
The witness was dressed in an expensive, obviously from someone else's shoulder, a leather jacket and at the same time into torn pants and gifted shoes without laces. His hair was dirty to such an extent that they rolled up and hung like icicles. From the witness stinked as if he had not washed for several weeks. It was obvious that only the appearance of Kurchaloeva operas leads to his senses. Seeing them, the witness shuddered and made an attempt to hide in a corner.
When the investigative actions ended and the opera came after the witness, he first pressed into the wall, and when they dagged him “got here!” He turned and laid his hands on his back with the usual gesture, as if he had spent a long time in the cell. ”
Despite the full fiasco with identification, the senior investigator Agabekov issued the protocol of the investigative action in full accordance with the law. All those involved in the investigative action are the accused, his lawyer, investigator, witnesses, witness and statists (only 8 people) got acquainted and signed on the protocol, on each of his page. And the next day, the report of the already former investigator Agabekov appeared, from which it followed that he committed an official crime, as he falsified the recognition protocol ... in favor of Oyub Titiev.

“I asked Baskhanov AR:“ Does he recognize any of the three persons presented for identification? ” Baskhanov looked at them, was silent for a long time and did not answer my question. Then the second time I asked Baskhanov the same question. However, Baskhanov continued to be silent and not to answer my questions. I suggested that Baskhanov did not recognize anyone, so he announced the end of the investigative action and began to print the recognition protocol on the computer.
At this time, Baskhanov pointed out with his hand and said that he identifies a face standing on the left side closer to the window, like Titiev Oyub, whom he saw in Grozny under the circumstances in the interrogation protocol. At this time, I had already printed out the recognition protocol, in which I indicated that Baskhanov did not recognize anyone. I gave all those present to familiarize and signature this printed protocol of identification. After getting acquainted, all participants put their signatures. No applications and petitions were received from anyone.
After the signing of the recognition protocol by all participants, already in my office, I realized that I had incorrectly conducted an investigative action, and therefore I was informed by a report to the head of the chief ... "
In these incredible explanations of the investigator there is one curious detail. Investigator Agabekov realized that "he carried out the investigative action" incorrectly ", after identification," being in his office. " What exactly happened to the investigator Agabekov in this very office and was converted to recognition in a serious crime, namely, in the falsification of the protocol of the investigative action, one can only guess. Immediately after an unsuccessful identification, the investigation group, headed by investigator Salamov, was disbanded. A new group was created, led by a whole lieutenant colonel, the head of the OMVD of the Kurchaloevsky district of Hanochok (also not a Chechen, only one investigator Salamov remained in the investigation group). It is the head of the investigative department of the Kurchaloevsky District Department of Internal Affairs Hanochok that is now trying to disavow the result of the already consistent and irreversible by the law of investigative action at the cost of bringing his own subordinate to the criminal article.
“Identification is a unique investigative action, it can only be carried out once. The negative result is fixed and becomes the problem of the investigation.
