The court continued to consider the civil lawsuit of the Prosecutor General about the confiscation of property of Colonel Zakharchenko

Colonel Dmitry Zakharchenko called the claim of the Prosecutor General's Office about the confiscation of his property absurd and spoke about his salary and that his parents purchased 13 apartments in the capital themselves.

On November 20, the Nikulinsky court of the capital continued to consider the civil lawsuit of the Prosecutor General's Office on the confiscation of the property of Colonel Dmitry Zakharchenko and his family members in favor of the state. We recall the policeman who worked in the anti -corruption headquarters of the Ministry of Internal Affairs of the Ministry of Internal Affairs of the Ministry of Internal Affairs of the Ministry of Internal Affairs. In total, Zakharchenko’s property is estimated in the amount of about 9 billion rubles, which the Prosecutor General expects to replenish the budget.

Right during the meeting on November 20, it became known: the mother and sister of Zakharchenko, who, along with many acted in this civil process, left the country. Before her departure, neither the mother nor the sister of Zakharchenko had ever visited the civil process, entrusting it to their lawyers.

But on October 20, the meeting was attended by video conferencing from the pre-trial detention center Dmitry Zakharchenko himself and his father Viktor Zakharchenko, who had previously insisted on his personal presence.

With a lawsuit Zakharchenko was completely disagreeable. According to him, having got acquainted from the media with the performance of the prosecutor at the last meeting, he saw that he "distorted the facts."

“This is a lie, a reservation and slander,” said Zakharchenko. - There is not a single evidence in the case file that I was the actual owner (13 apartments - ed. ). I never had this property. Which is confirmed by the testimony of all the owners of this property. There are no audio conversations in the case file in which I would ask for property registration for third parties.

Zakharchenko insisted that his relatives and acquaintances acquired the apartments.

- To say that I went to everyone like Santa Claus with a bag and distributed property - well, there is no such thing in nature! It's absurd!

At the same time, Zakharchenko noted that he was officially accused today of taking a bribe from an “unidentified person”.

- And for 15 months this person cannot establish! And they did not bring any more accusations to me. 92 thousand rubles that were seized during my personal inspection in my office is my official salary. And the prosecutor said that it was "illegally received funds." It is enough to request a certificate from the place of my work.

The prosecutor at these words wrote something into the phone.

The main defendant often repeated that the claim of the Prosecutor General’s Office “is a lie for my discredit”.

-There is no evidence in the case file that I have obtained funds and values ​​from illegal sources. There was no court sentence. The owners of the apartments - my relatives - were not fictitious owners. They were owners by law. And their rights are now violating and trying to throw it out into the street, since they are my friends and relatives. I met in absentia in absentia. Let us now also discuss his property.

I moved to the theme of the gold ingot found in the apartment of the sister of Zakharchenko. The accused denied involvement in the purchase of a ingot.

“I didn’t buy it, I didn’t buy it,” Zakharchenko asked the court to demand documents from the investigation about who really bought an ingot.

According to Zakharchenko, his father Viktor Zakharchenko, who is now in the Sailor's Sailor SIZO, was taken hostage to the Investigative Committee.

- My parents and sister were always law -abiding people, were never prosecuted. Parents had a farm, they had cash (I did not delve into the details), they invested, engaged in entrepreneurial activities.
There was always prosperity in the family ...-said Zakharchenko Jr.. - The prosecutor at the previous meeting was surprised that my parents earned a subsidiary farm. And I’ll tell you this: in the first grade everyone comes equal, everyone has equal opportunities, but not everyone works and achieve fives. Also, people come to Moscow: who works, works, and someone just sits still ...

Zakharchenko claimed that his native aunt - his mother’s sister - also engaged in entrepreneurial activity, only in Ukraine, and often advised her sister on these issues.

The prosecutor Bochkarev had questions to Zakharchenko:

“The court will judge us whether I had reason to formulate this lawsuit or not,” the prosecutor noted. - Here I have a question. You are like a reasonable person. Lawyer. You have three formations. But the tax authorities do not confirm the availability of such funds for the purchase of real estate.

“Thank you for such tall words about me,” Zakharchenko said. “At the last meeting, as I read from the press, you called me a“ criminal, ”Zakharchenko answered the question in the way that this is the right to report to the tax office, but not the obligation of citizens. And he repeated: neither he nor his relatives committed illegal things.

- But so that people do not say, they do not believe them. This is a lawless lawlessness, ”he summed up.

“I'm ready to trust you,” the prosecutor answered. “And even adjust the lawsuit ... if you told me the truth.” How did it happen that you were registered on Michurinsky Prospekt, and lived in the apartments on the Prechistenskaya embankment?

- I periodically stopped in different places. This is talking about what? The fact that if a person has nowhere to live, he has to huddle, wander. I lived in the apartments of my relatives who sheltered me. My father lived on the Prechistenka. I sometimes spent the night there, recently I lived on Yakimank with my daughter and Semynina Marina (the mother of the child - ed. ) - according to Zakharchenko, his wanderings depended on the relationship with Semynina. - When there was a good relationship, I lived on Yakimanka. When they spoiled, I was forced to wander.

According to him, in the apartments on the Prechisten, he visited when his father asked for this. "My father asked me:" The son of the fields flowers. " And what about this?!

“The servant on the Prechistenka said that you are the owner and you paid for their services,” the prosecutor said.

“I didn’t hire a servant and this is not my servant,” answered Zakharchenko. - The woman herself said in the testimony that she took the money for work from the nightstand and that she saw me only three times in three years. To say that she received money from me is a lie. My father lived in the apartment, they found it and seized his things.

“Your spouses or roommates (they determine this in different ways) in the testimony said that you helped monthly and gave them 100-200 thousand rubles a month ...” the prosecutor said further.

“Now for women,” the accused reacted. - Naturally, I helped from my salary, rarely, but allocated little money for children. Not in such quantities as you called. I do not drink, I do not smoke, I did not visit nightclubs. That I could not give 20-30 thousand rubles for children?! I want to take care of them. But, unfortunately, now I do not have such an opportunity. The accusation generally says that I drank one alcohol for 1 million rubles! This is humorin!

Further on the video, Father Zakharchenko - Viktor Zakharchenko was taken to the video. They announced a break during which the father managed to talk with his son. They did not see each other, but heard.

This is the purchase of vouchers, investing in Gazprom’s promotions ... Both Berezovsky and Abramovich also started with such operations. Of course, I do not equate myself to them. In general, people then lost a lot, but fortunately I was lucky. The amount that allowed me to acquire real estate was formed. As for the financial capabilities of her spouse (she, according to investigators, acquired another 7 apartments in Moscow), then Zakharchenko Sr. described her “very enterprising woman”. However, he, according to him, did not want to say about the details of her entrepreneurial activity.

Then the prosecutor drew attention to the fact that the wife of Zakharchenko Sr., on the contrary, spoke in the investigation that her husband “sponsored” her regarding the purchase of real estate objects.

“Well, during the joint residence we had common finances ...” Zakharchenko Sr. answered slowly. - I was engaged in commercial activities, which brought a certain income.

At the same time, he noticed that he did not submit the declaration "for various reasons."

Zakharchenko Sr. said that he gave the apartment to his granddaughter (minor daughter Zakharchenko Jr.), feeling “his guilt” before his son because he and his granddaughter had no life.

Further, Dmitry Zakharchenko’s father noted that he had several strokes, but he "does not want to cause self -pity."

- Your last workplace? The prosecutor asked.
- Moscow mortgage agency. Bank.
-You really worked there (according to the investigation, he was arranged there as a son and Zakharchenko Sr. simply, without working, received money- ed. )?
“I refuse to answer this question,” the man said.
- Have you received a salary there?
Zakharchenko Sr. did not answer again.
Lawyers supported him, noting that these issues relate to a criminal case, the investigation of which is still ongoing.

The rest at the meeting on this day was again a representative of the Prosecutor General’s Office. He said that Dmitry Zakharchenko, receiving income from illegal sources, made his relatives "beneficiaries of his corruption activity."

- Zakharchenko had to serve the interests of the company and, in accordance with the oath, firmly observe the law. However, he entered the service with the interests of the service and sent his service to enrich his relatives, ”the prosecutor was excited. - And note: the money was not found in me, not from the secretary of the court session, it was found in the apartment of Zakharchenko and his relatives. The materials present information about their income. Isn't this evidence?! They have income almost lower than the subsistence minimum. They could not purchase in Moscow, this is such a high liquid property.

According to the prosecutor, the neighbors of the Zakharchenko family in Rostov during the testimony said that they were not rich and did not differ from others.

An interesting fact for the prosecutor’s office was that in one of the apartments on Lomonosovsky Prospekt, investigators found a “notebook of 12 leaves”.

- It turns out that Dmitry Zakharchenko’s mother kept accounting for these money. She is in the past a teacher in mathematics. All the calculations that were conducted in this notebook are made in a column. And you know, ”the prosecutor turned to the audience,“ we then checked the amounts of the stroke. ” The amounts are fighting. We also conducted an emphasis on an emphasis: this is the handwriting of Mother Zakharchenko.

As for the sister of Zakharchenko-Ms. Obgonova, the prosecutor said that the operatives filmed her in the entrance of one of the houses on Lomonosovsky Prospekt with a bag, in which “202 thousand US dollars were subsequently discovered”.

The investigation also checked the version that the family members “threw” the treasure, which the mother and sister stated at first during the search.

- We received a response from the developers that the house was under a constant video monitoring and security of the choke, the entrance was carried out through electronic keys. Only family members used keys. And that is important-there were no complaints from the owners that they were thrown to them, ”the prosecutor emphasized. - They also did not apply to law enforcement agencies about illegal penetration into the apartment.

The prosecutor also said that during the audit, the investigation found out in the village councils of the Rostov region that the Zakharchenko family never had a subsidiary farm there, which refutes the argument that they earned money, including due to this subsidiary farm.

- Parents Zakharchenko were pedagogical workers.
Father always worked as a director at school, worked on the site. And here they tell us that he was a banking worker! - the prosecutor was indignant.
- I convict all the co -standers in the lie!

In the end, the prosecutor, in confirmation of his words about the “lies”, quoted SMS correspondence between Zakharchenko and his ex-wife Semynina.

- From the correspondence it follows that the relationship between them has deteriorated, since he had another roommate - Yana Saratovtseva. Semynin reproaches him for starting to pay less attention to their daughter and provide material support. And in court, lawyer Semynina says that she had nothing to do with him. The correspondence has a lot of obscene. Semynina wrote that at the same time, Zakharchenko Yana Saratovtseva devotes more time, finances her trips to Europe with a business class, "and we are here with Ulyana (daughter- Ed. ) We save on everything." “You can choke on your apartments and your money,” the prosecutor quoted Semonin, noting that she threatened to stop Zakharchenko’s communication with their common daughter. - Semynina draws attention to the fact that Zakharchenko bought Saratovtseva apartments that she had Cartier bracelets and that he gives her millions, "you are only worried about money, you live for money and is ready for everything for them."

“This is a literal quote,” the prosecutor specified and then brought another quote from SMS correspondence in his opinion. “You still have to thank me for not talking about your apartments to your leadership.”

Having read all this, the prosecutor handed the judge the decision of the Moscow garrison military court, which authorized the wiretap Zakharchenko. The sanction, it turns out, was issued at the beginning of 2013, i.e. Three years before the arrest of Colonel of the Ministry of Internal Affairs.
