Megaisk as a megaby business
The second week in the court of London examines Berezovsky’s lawsuit against Abramovich for $ 5.5 billion. And everyone is wondering why Boris Berezovsky needs it? Answer: For the sake of money.
Boris Berezovsky is a businessman. And this process for him is a means of making money. We invest so much in lawyers (very expensive), so much at the exit. If there was nothing but moral satisfaction at the exit, Berezovsky would not have done it.
The second thing that can be seen in this process that Berezovsky is an amazing strategist. A person has a strategic vision of the situation, and he plans not for years, but for decades (unlike, by the way, from the current Kremlin). What do I mean?
Boris Berezovsky claims in his lawsuit that he sold his share in ORT and Sibneft for the sake of freeing the dear friend Glushkov. This, to put it mildly, is doubtful. It’s not that Berezovsky was not capable of wide gestures, but that Boris Berezovsky is ready to lose billions of dollars for a friend, it is difficult to believe, especially since after the sale of ORT Glushkov was not released. Well, if you change the share of a friend, then you can somehow formalize the process.
Then the question: for which Boris Berezovsky and Badri Patarkatsishvili sold their shares in ORT (for $ 175 million), Sibneft ($ 1.3 billion) and Rusale ($ 450 million), if they did not want to sell for this money? Why didn’t they immediately contact the London court? Like, they are selected!
The answer is that Berezovsky did not have any legal reasons for going to court. According to the old Soviet habit of a Jew, a Jew, who writes a house, a fur coat and a car, Berezovsky recorded all his shares of Sibneft and Rusal to Abramovich, and he himself admits that the agreements that he owned 50% of Sibneft with Patarkatsishvili and 25% of Rusal were exclusively oral in nature.
Unlike Mikhail Cherny, who had at least some, at least on a napkin, a note that Deripaska pays him $ 250 million. At the expense of his share and undertakes to redeem the rest under such and such conditions, Boris Berezovsky did not have any.
The only papers confirming the share of Berezovsky in Sibneft and Rusal are papers on the sale of this share. Without these papers, even in the English court, which is being versed in the merits of the case, there would be nothing to talk about.
For example, Abramovich paid 1.3 for Berezovsky and Patarkatsishvili for Sibneft, although they asked for 2.5. Imagine that Berezovsky filed a lawsuit against Abramovich in May 2001.
And this lawsuit appears in an English court with its precedent law. The court asks: who belongs to the company? Answer: Abramovich. All shares - this is recognized by Berezovsky himself - formally posed at Abramovich since August 1997. Financed the Berezovsky company? No? Has controlled? No. Then what is the meaning of claims? Helped when creating? But Abramovich does not deny this. Well, helped. But the shares - since 1997 - Berezovsky did not have in this company.
We move on. 2001. Berezovsky, for example, says: "And Putin took all this from me for political reasons." Court question: who is Putin? Who did he take away from? In 2001, there is neither planted Khodorkovsky nor poisoned Litvinenko, nor the murdered Politkovskaya. Well, NTV took it away, but there is a difficult story, a loan, this still needs to be proved.
Court question: who is Berezovsky? In 2001, he is not an oppositionist and not a fighter for freedom. He is the godfather of the Kremlin, who was thrown out of the Kremlin.
What do I want to say? What exactly this claim gives us the answer to the question why all the previous ten years Boris Berezovsky portrayed a policy. In order to justify the lawsuit.
Boris Berezovsky is a brilliant strategist, and at the moment when he quarreled with Putin, his strategy consisted of several points. Firstly, to sell your shares at any price in order to formally consolidate the presence of your share in Sibneft and Rusal. Secondly, to secure the reputation of the fighter with Putin number one. And thirdly-wait, because the worse, the better. The more Putin selects companies, the more precedents the lawsuit will be.
Note: Putin never turns away from friends. This is not a dignity, this is exactly the psychology of the mafiosi that turned Russia into the estate of Putin's roots.
Berezovsky helped Putin become president. Let him exaggerate the size of help, let him substitute Putin, used his name - there are many people who substituted Putin no less than Berezovsky (for example, Sergey Pugachev) and, at best, were distant from the reigning person. If Berezovsky had not woven about the explosions of houses, did not finance Rybkin, did not throw the Duma ticket on the table with the words “Putin is a grave of democracy”, he would simply sit in London - he could continue to do business in Russia.
Quiet, normal. Not superpowers. The problem is that Berezovsky cannot do normal business. He can only do super -business, strategic business, megaprojects. He made Super -Business in proximity to power when he was delayed, he decided to make Super -Business in the fight against power. This court is super -business.
There is, for example, Vladimir Gusinsky. A person who made an absolutely brilliant media project and whom the authorities cut on take -off; Two years would, and Gusinsky would become a Russian meridoc and would be inaccessible both in capital and sustainability. Gusinsky was never a friend of Putin. NTV was selected from Gusinsky. Gusinsky was closed to prison. But Gusinsky "did not exacerbate." And he continues to do business in Russia - this is a well -known fact. Gusinsky chose a strategy - to do business.
Berezovsky chose another strategists - to make a war. The Winner Takes it All. During the performance of this strategy, he many times seemed a joke and a demagogue, the Frigian cap on Berezovsky looked like a clown. But it turned out that joking is a strategy and investment in Rybkin and Litvinenko can bring him 5.5 billion dollars.
Berezovsky’s lawsuit has very high chances. Because there is a simple fact: Berezovsky had promotions, threatening Berezovsky action. Highly moraine moans such as "What pennies did you bought` `Sibneft ''?" They do not belong to business. The Russian state did not file a lawsuit against Berezovsky and Abramovich in the London court on the incorrect privatization of Sibneft.
So the lawsuit, I believe, will win Berezovsky. The question is different - in the amount of compensation. Because here Berezovsky has several weak positions. For example, he writes in the lawsuit that ORT brought losses - before privatization - in the amount of $ 200 million per year. Question: How could the share in the enterprise that inflicter the losses cost $ 175 million, for which he sold it, and even more so 300 million dollars, which he wanted?
In 2001, 50% of the same shares were purchased from Badri and Berezovsky for $ 1.3 billion. Berezovsky says that he asked for 2.5 billion. Question: If 51% of Sibneft shares were bought at a collateral auction for $ 100 million, how could they cost 2.5 and even 1.3?
And it is possible that the London court will say: yes, Boris Abramovich, you have taken a business. Nobody argues with this. Bloody mode. Fucked for a penny. You wanted 2.5, and you were given only 1.3. But you yourself say that you did not manage the company. Neither the center was invested. Bought for 100 million. Well, here we believe that you were inflicted moral and material damage to 50 thousand dollars. Take a lot to get.
