Dear Sergey Semenovich!
Today, the Moscow Regional Branch of the Party of the RPR-Parnas filed a statement to the Moscow Prosecutor's Office with a request to conduct a prosecutor’s audit on the facts of illegal detentions on the evening of February 24, 2014 on Tverskaya Street in the area of the National City Hotel and the building of the State Duma of the FS of the Russian Federation of our party, as well as other citizens, unreasonable bringing them to administrative responsibility, violation of the Moscow police and roconicals guaranteed guaranteed The Constitution of the Russian Federation of the rights and freedoms of man and citizen: the right to freedom of movement, expressing their opinion, the right to free and disseminate information, as well as the right to not be subjected to torture, violence, other cruel or humiliating human dignity and the right to receive qualified legal assistance, including from the moment of detention (see Appendix).
Understanding that the Moscow police and riot police are not in your subordination, we nevertheless ask you to express your attitude to the events described as the mayor of the capital of Russia, which, as you stated in an interview with the magazine “Results”, “ultimately is responsible for the order as the only politician at the level of urban executive power.”
We ask you to explain on what basis on February 24, 2014 in the morning on Tatarskaya Street, and in the evening on Tverskoy, mass detentions of people were held? Who gave the police to not let people go to the open meeting of the Zamoskvoretsky court in the case of the so -called "riots on Bolotnaya Square on May 6, 2012"? Why did police officers and riot police selectively grabbed citizens who were peacefully standing on the sidewalk in anticipation of the sentence of the accused to the accused "Prisoners of Bolotnaya", were poured on the asphalt and dragged them to the autozaki?
The same picture was repeated in the evening on Tverskaya Street near the National Hotel, near the State Duma building and in the Camergger Lane. Why is the police demand “not to stand on the sidewalk” is considered legal? Do people have no right to be on Tverskaya Street, which they did not overlap, but simply stood without interfering with anyone? Why were the detainees twisted their hands, why were they dragged along the asphalt, and some were beaten in Avtosaks? Why did OMON employees all as one were without breast tokens and did not explain the reason for the detention? Why, in fact, the police law was violated? On the basis of a filed protocol, citizens underwent administrative arrest.
Do you think that happened in our city in the morning and evening of February 24 on Tatar and Tverskaya streets? We ask you to explain why the police did not defend, but, in fact, opposed us?
Who gave the police and riot police to act in this way? And can such actions help improve the situation in Moscow, the mayor of which you are?
We are sure that not only members of our party, but also many residents of the city of Moscow would like to get the answer to these questions.
The Council of the Regional Branch of the Political Party "Republican Party of Russia - Party of People's Freedom" in Moscow.
Regional branch of the political party
"Republican Party of Russia - Party of People's Freedom" in Moscow
The prosecutor of the city of Moscow
Mr. Kudeneev S.V.
Dear Sergey Vasilievich!
On February 24, 2014, a large number of members of the RPR-Parnas political party were detained in the Moscow Center of Moscow. The circumstances, the nature of the actions of the police in relation to the detainees, both during the detention and in the police departments indicate the illegality and electoral orientation of the police into a certain group of citizens.
So among the detainees were publicly well-known members of the RPR-Parnas party: party co-chair, deputy of the Yaroslavl Regional Duma of Nemtsov B.E., member of the Federal Bureau of the Party Yashin I.V., co-chairman of the Moscow City Branch Schneider M.Ya., Executive Director of the Solidarity ODD Mytyushkin N.L., other members of the party.
The indicated persons were at the address: Tverskaya Street, D.1 near the hotel "National". At the same time, Nemtsov B.E. He gave an interview to media representatives about the sentence of 8 participants in the procession on May 6, 2012 on this day of the sentence. The other detainees stood in different places on the sidewalk near the house at the indicated address and conducted a conversation with their neighbors.
All the detentions took place according to the standard scheme: police officers in the form of riot police in the form of unacceptable tokens ran up to the planned “victim”, not introducing themselves or explaining the reasons, grabbed people standing on the sidewalk and pushed into a police special transport.
Other members of the RPR-Parnas party were also detained in different places of the Moscow Center.
Nemtsov B.E. and Mityushkina N.L. were delivered to the Russian Ministry of Internal Affairs in the Tver district of Moscow. Over 4-hour, the employees of the duty unit did not allow the defenders to the detainees to provide legal assistance, and held those delivered without drawing up the detention protocol.
About one in the morning of the next day Mityushkina N.L. And her defender was provided for familiarization with the issued materials of the case of an administrative offense under Part 1 of Article 19.3 of the KRFOPAP. The protocols are drawn up without the presence of Mityushkina N.L. And the participation in the case of her defender. On the protocols, signatures of certain witnesses were already made, allegedly testifying to the refusal of N. Mityushkina. Signing documents, which did not correspond to the truth. The delivery protocol was drawn up by a police officer who did not detain it and did not deliver it. Police reports are issued by filling out a single template containing fictional events and circumstances. In fact, there is a falsification of the case of an administrative offense, which are evidence in the case.
Similarly, police officers and protocol reports against Yashin I.V, also brought to administrative responsibility under Part 1 of Article 19.3 of the KRFOPAP, were falsified.
Schneider M.Ya. He was delivered to the Russian Ministry of Internal Affairs in the Sokolina Gora region of Moscow without an appropriate entry in the book of the delivered. In relation to him, the case of an administrative offense was opened under Part 5 of Article 20.2 of the KRFOP on the basis of false reports of police officers who did not detain him. A participant in any public event, Schneider M.Ya. He was not, but, therefore, could not violate the established procedure for its implementation. When delivered to the police department, Schneider M.Ya. He was illegally placed in a barred room, where he stayed from about 21:15 to about 2:15 the next day. His personal belongings were seized, and he was deprived of the opportunity to inform his close relatives about his detention. Schneider M.Ya. He spent about five hours on his feet along with other detainees in extremely shy antisanitarian conditions without the right to use the toilet. Similar actions were carried out in relation to other detainees and delivered to the same car carrier along with Schneider M.Ya. In the Ministry of Internal Affairs in the Sokolina Gora region.
Kuznetsov P.S. He was detained almost immediately upon leaving the underground passage, in front of the historical museum, unvaccinated riot police officers who ran him to Avtozak. At Avtosak, under insults, his head was pressed against the dirty iron wall of the car carrier, and his legs were placed as wide as possible with the blows of his legs. Without any witnesses, he was searched for insults, and then he was stuffed with kicks into a car zak. Before his eyes, turning his hands and accompanying his actions with kicks and insults, 11 more people stuffed into a car zak. The detainees were delivered to the Arbat police department, where everyone issued protocols under Article 19.3. To fair questions, what their resistance was, police officers replied that the offense was that they allegedly wanted to break through the cordon. Kuznetsova P.S. They released from the ATS at 00:30, significantly exceeding the legitimate deadlines for the detention, refused to give him a copy of the protocol on the offense under the pretext that he refused to sign it, and forced to sign the obligation to appeal to the court under the threat of leaving the police department at night.
Mityushkina N.L., Nemtsov B.E., Schneider M.Ya., Yashin I.V. They were detained in the range from 19:45 to 20:15. Kuznetsov P.S. - At 18:55.
In addition, from the media reports and the OVD-Info website, we became aware of the detention at the same time, in the same place and the delivery of more than 400 citizens to various Department of Internal Affairs. Moreover, with respect to many of them, the police carried out actions similar to the above.
On the basis of the Federal Law “On the Prosecutor's Office of the Russian Federation”, we ask to conduct an audit on the facts of the illegal detentions of our party members, as well as other citizens who are unreasonable to bring them to administrative responsibility, violating the rights and freedoms of a person and citizen guaranteed by the Constitution of the Russian Federation: the right to freedom, expressing their opinion, the right to freely receive and disseminate information, as well as the right not to be tortured, violence, and violence, other brutal brutal or to the humiliating human dignity and the right to receive qualified legal assistance, including from the moment of detention.
In case of identified violations of the law, please take the appropriate measures of prosecutor’s response in relation to the persons that have made them.*
On behalf of the political council of the Moscow City Branch of the Party of the RPR-Parnas
Sincerely,
T. Lezhnina, co-chair of the regional branch of the political party of the RPR-Parnas in Moscow
I. Kharichev, co-chair of the regional branch of the political party of the RPR-Parnas in Moscow
