The wonderful resurrection of Arkady Babchenko gave rise to a storm of conflicting opinions related to the ethical side of his actions. Leaving aside the reasoning of this kind, we turn to the precedents and their legal basis.
The book of the lawyer Viktor Obraztsov “ Forensics: Selected Works ” gives expressive examples of imitation of murder for operational purposes. Such a staging is used to expose the customer. Most often, the authorities will learn about the order from the performer-non-professional. Not daring to execute the order for one reason or another, he comes to law enforcement agencies.
As a rule, the customer demands that Killer provide him with evidence of a committed murder.
One woman in the suburbs decided to get rid of her husband who was tyranny and through an intermediary ordered his murder for five thousand dollars. The performer bought a gun, but did not find the strength to commit a murder and told about all the police. The Contractor presented a photo of a “corpse” with a gunshot wound in his head (she inflicted a theater make -up artist), a wedding ring and a victim’s passport, and also told in detail how exactly he killed her husband.
Sometimes the customer wants to receive not any, but strictly defined confirmations of the murder. The former employee of the St. Petersburg Bank wished to see the photo of his dead enemy with a nail clogged in the head, similar to the railway crutch, which he specifically handed over for this purpose to the killers. In this case, the press was involved in the operation. She reported the murder of the banker. Photos of a corpse with a nail in the head were shown in a criminal chronicle on television.
The potential victim has every right to refuse to participate in the staging. In this case, her role is played by the understudy. The use of the media does not regulate the use of the media. In Russia, for such a staging - an operational experiment - the presence of an initiated criminal case and the sanction of the court are necessary.
In world practice, at least one case of imitation of murder for political purposes is known. In January 1981, an employee of the Romanian foreign intelligence, Matey Haiduka, who worked in France and engaged in industrial and scientific espionage, received an order from Bucharest to eliminate two political emigrants - writers Paul Goma and Virgil Tanaza. Both seemed to annoy the Romanian leader Nicholas Chayescu with his works. Tanaz, in particular, published a pamphlet in the French magazine under the heading of "King of the Communists by His Majesty Chausko the First."

Haiduk, who never received and did not comply with such orders, decided to surrender to French counterintelligence. The French turned to Homa and Tanaza and received consent to cooperation from them. Since it was not excluded that they were monitoring the actions of Haiduk, a rather subtle operation was developed. At the dent, Haiduk injected the poison of the fountain pen into the cocktail, and the agent of the French counterintelligence, as if tripping over, accidentally knocked over the glass.
The failure looked quite believable, but with the second victim it was necessary to come up with something else. Returning to Bucharest, Haiduka told the chief his plan: hire bandits who will abduct and kill Tanaza. The chef gave the go -ahead. On May 20, 1982, in broad daylight in the middle of Paris, in front of dozens of witnesses, some people pushed Tanaza into the car and took away.
The abduction received wide publicity. Tanaz was not announced anywhere. Naturally, the suspicion fell on the Romanian secret police to the second -University. On June 9, President Mitteran at a special press conference expressed deep concern with the disappearance of Virgil Tanaza, and then canceled the planned visit to Romania.
Today it is known that Mitteran was aware of the counterintelligence operation and diligently played a role.
Tanaz was missing for three months. He spent this time in solitude in Brittany under the protection of the French special services. For three months he asked Matey Haiduk to prepare the shooting of the family.
On August 31, in the Le Matin newspaper, who has seen the true background of the abduction, an article was published that the abduction is imaginary and it was arranged by counterintelligence. On the same day, a press conference was convened in Paris, at which all three presented to journalists: Goma, Tanaz and similar to the young scientist Haiduka, represented by the present as " Mr. Z ".
There are various intricate versions of what happened. One of them is that Matey Haiduk actually tried to recruit the Minister of Defense of France Charles Ernya, about whom in Bucharest they knew that in the past he collaborated with Soviet intelligence. In addition, in February 1982, the bride of the terrorist Ramirez Sanchez (Carlos Shakal) Magdalena Kopp was arrested in France. She gave a confession and was sentenced to four years in prison for trying to commit an attack. Carlos in response arranged several explosions in France. The French authorities knew about the attempt to recruit Ernya, and about Carlos’s cooperation with a second -Uuritate, but Mitteran could not bring such accusations to Chayzesk, and Tanaza was a pretext for breaking up relations with Bucharest.
The Kyiv staging lasted less than a day and also ended with a spectacular access to the press. President Poroshenko did not have to directly participate in the mystification. According to the SBU, a whole series of political killings is prevented.
