In the market of special services, which is shaky, but still divided between the FSB, the Ministry of Internal Affairs, the Investigative Committee, the Federal Drug Control Service, the Federal Customs Service and the prosecutor's office, there is another player that is insultingly deprived of authority - the bailiff service (FSSP). They can operate within the limited framework of enforcement proceedings, which are initiated only after the relevant decision (verdict, decision) of the general civil or arbitration courts. Bailiffs do not have the right to operational measures, access to personal data, not to mention investigative functions. There are only small units of power support, bargained from the state during the period of noisy raider seizures. That is, if according to the concepts - not a law enforcement structure, but some kind of underdog, unable to earn at the level of senior comrades.
And now a law has appeared in the Duma that can somehow improve the situation in the direction of “weighting” the FSSP. Its necessity is publicly motivated by the fact that judicial decisions in Russia are chronically not enforced - debtors either successfully hide from bailiffs, or they are simply sent. The bailiffs on this occasion declare: we lack the powers and opportunities. That is why intricate innovations appear, balancing on the verge of illegal ones: either debtors are entered into the border stop lists, then they are dragged to the military registration and enlistment offices, then a priest comes to them with a censer and a sermon.
But this real problem also has a crafty side. Firstly, very often government agencies or large corporations become debtors who do not comply with court decisions, and bailiffs, accompanied by their special forces and police, do not visit them. Even though they have the power to do so. And secondly, the speed and effectiveness of the recovery also very often depends on the motivational part that the bailiff has in his pocket.
That is, the problem is not unambiguous, but the task requires a systematic solution. It is just the bailiffs who do not offer it, but only ask for additional fiscal and operational powers.
How does all this threaten respectable citizens?
There are now a huge number of personal databases of Russian citizens on free sale, which are sold by employees of the FSB, the Ministry of Internal Affairs, and so on. Private security companies, competitors of businessmen and criminal structures are happy to use these bases. Now employees of the FSSP can become operators in the market for such services.
But this business is not as profitable and not as dangerous for ordinary citizens as the one that can develop if bailiffs get access to the databases of cellular companies. The most important thing here is not phone numbers and not the content of SMS messages (although passwords for accessing various accounts are sometimes sent with their help), but billing.
What it is? This is information automatically supplied to the telephone company's database by cell towers. With its help, you can find out where and at what time a citizen is (with an accuracy of several tens of meters), with whom he calls up and when, restore the usual route of his movement and the address of his actual residence. That is, a mobile phone is a kind of “beacon” that transmits information about you from a cell tower to a tower. Access to billing is a gift to killers. If it becomes possible to shoot billing online, then not just a gift, but a giant bonus. (Yes, the law does not directly mention this, but the law does not detail at all what personal data of a citizen, in what form and in what way will become available to bailiffs. And what is not prohibited is allowed, isn't it?)
Now various divisions of the Investigative Committee are investigating several cases, from the materials of which it follows that police officers and the FSB sell such information to criminal structures. Now FSSP employees can also be added?
One can object to this: access to this information is possible only by a court decision. But how do they sell? How?
Firstly, the judge on duty does not delve into the content of those batches of requests from the investigative and operational bodies that he stamps without actually looking. Secondly, anything can be entered into the lists provided to the judge.
It's done like this. Officer X. receives an order for wiretapping or billing of citizen Y. The officer enters Y's number in the application along with other numbers actually involved in the criminal case that he or his colleague accompanies (the latter for a separate amount). A paper comes to the court: a criminal case (in our case, an executive case) is being processed by such and such a unit, as part of the investigation of which the phone numbers of persons who may be involved in this crime (in our case, malicious debtors) have been established, we ask the court to issue permission for wiretapping (removal of billing). And attached is a long list of phones, among them - paid. The judge makes a decision. Order completed. And who the customer is: a jealous husband or a killer, nobody really cares.
