From the editorial office. On May 8, President Dmitry Medvedev made amendments to the State Duma to the Constitutional Law "On the Constitutional Court of the Russian Federation", which provide for a new procedure for the appointment of the leadership of the KS. Already on May 22, the State Duma adopted this bill in the second and third readings. To comment on the essence of this law, as well as its place in the context of political transformations of recent years, we asked Andrei Medushevsky, one of the leading Russian specialists in constitutional law.
We asked Andrei Nikolayevich about whether these amendments were steps to further strengthen the vertical of power, as well as how they correlate with Dmitry Medvedev's declarations about democracy.

Russian magazine: Why did President Dmitry Medvedev need a reform of the Constitutional Court? Do you agree with the opinion that in this way the authorities are trying to strengthen the executive power at the expense of the judicial?
Andrei Medushevsky : This reform continues those trends in the interpretation of the Constitution that have been outlined since 2000. Their essence, indeed, is the centralization of management, its rationalization and bureaucratization in the name of the convenience of the executive branch. In this sense, the Medvedev reform completes the process begun by other reforms: reformatting the post -Soviet political space (new electoral legislation, the regulation of political parties and public organizations); the transition from the decentralized version of federalism to a more centralized (creation of parallel administrative-territorial division, the introduction of the Institute of Plenipotentiary Representatives, the end of the president with the right to dissolve regional legislative assemblies and the transition to the actual appointment of governors); Correction of the mechanisms of the separation of powers (by creating a powerful government party in the lower house of parliament, a change in the order of the formation of the upper house and creating new alternative Extracts Institutes - the State Council and the Public Chamber, which are the institutes of the directed selection of social initiatives). The content of reforms is the construction of a controlled democracy, their technology is the actual change in the constitution without a formal revision of its text .
These methods have been repeatedly used by the modern political regime in a number of directions, the constitutionality of which was called into question. In this context, the interpretation of new initiatives of the authorities is possible: according to the bill put forward (and already approved by the Duma) to the bill, the chairman of the Constitutional Court will not be elected by the judges themselves (as now), but to be appointed by the Federation Council on the proposal of the president. In parallel, it is supposed to extend the term of office of the chairman of the Constitutional Court from three to six years by analogy with the powers of the heads of the Supreme and the Higher Arbitration Courts. This reform does not imply amendments to the Constitution (it is carried out by amendments to the Law “On the Constitutional Court of the Russian Federation”), however, it may have serious consequences for the political structure: it cancels the existing procedure according to which the chairman of the Constitutional Court, his deputy and judge are chosen by the judges themselves at a closed plenary session with a secret vote. Note that exactly, on an alternative basis, the current chairman of the Constitutional Court was elected. This procedure, which is an element of the separation of powers, is critical in the conditions of acute political confrontations and the discrepancy between opinions within the court itself. Otherwise, we receive a Constitutional Court, which is less capable of critically evaluating the constitutional initiatives of other branches of government, and its solutions on acute issues become more predictable. In general, I believe that the reform is aimed at strengthening centralization and at the establishment of more than lousing control by the executive branch in the system of separation of powers .
RG: That is, this is a continuation of the course to strengthen the vertical of power?
A.M. : Yes, of course, if I mean the vertical of the executive branch. This course entered into the final stage with the adoption of the Constitutional Constitutional Amendments of 2008, implemented, despite the previously declared principle of immutability of the Constitution. If until recently this course was carried out without a formal change in basic legislation, then at present the object of revision has already become the last. The declared “adjustment” of the Constitution and a number of important laws affected three fundamental spheres of regulation of the political system. Firstly , the prerequisites were created for expanding the political role of the ruling party: all parties who won the regional elections are granted the exclusive right to nominate the candidates of governors and members of the Federation Council, which, with the current balance of power, unambiguously gives the solution of these issues to “United Russia” (which has the majority in 83 of the 85 legislative assemblies of the constituent entities of the Federation and, therefore, receives additional opportunities to form the upper house and the extension of the upper ward and Governor's corps). Secondly , cosmetic changes in the parliament-the government-the president, which, without changing the existing configuration of the authorities with the absolute predominance of its presidential component, are aimed at giving it a certain flexibility and external resemblance to parliamentary systems. Amendment to Art. 103 and 114 On the annual reports of the Government before the Duma does not lead to the emergence of a responsible government and does not mean a transition to a full-fledged dualistic (presidential-parliamentary) system. Thirdly , extremely important amendments were adopted (in paragraph 1 of Article 81 and Clause 1, Article 96 of the Constitution of the Russian Federation) on the increase in the term of powers of the President and the State Duma, respectively, from four to six and five years (the need to renew the presidential mandate did not receive convincing legal justification, but was based only on pragmatic arguments of an economic and social nature).
The overall result of the constitutional transformation is the creation of a system of limited pluralism, in which all the main institutions of power are subordinated to external political will and purpose. This design of power, as a comparative experience shows, becomes possible in the existence of a number of premises: limiting federalism (and, accordingly, the transformation of the upper house into an incompetent institution); weakening the role of independent political parties and public organizations with the parallel establishment of the dominance of a disciplined and bureaucratized ruling party in parliament as a support of the existing power vertical; limiting the mechanisms of separation of powers (in particular, the judiciary) in favor of one of them - executive; The expansion of delegated powers of the latter, especially in critical and extreme situations. Finally, the key phase of reform is the expansion of the prerogatives and terms of powers of the presidential authority (in some cases gravitating to the unlimited execution of prerogatives by one leader or group of leaders). In the event that if the functions of the leader of the dominant party and the president are united in one person, a phenomenon arises, a expressive name of the imperial presidency in the literature (a model that has become widespread in developing countries). As this analysis shows, we have already come very close to this model , although perhaps we have not reached all its attributes completely.
RG: But what about the conversations about democratization, about the fact that it is necessary to just a little weaken the notorious centralization?
A.M.: Usually, talk about democratization appears when it begins to be limited. The official explanation of the reforms is as follows: the course on democratic transformations remains unchanged, but it needs to be adjusted - “ it is necessary to regain control of the country ”. Indeed, with the collapse of a one -party dictatorship and the revolutionary adoption of the 1993 Constitution, a rupture of legal continuity arose. Old institutions and norms no longer existed, new ones were not formed, and there was a very sharp struggle on the issue of the fundamental principles of organizing the legal system, the state system and choosing a political development vector. This struggle revealed the fundamental discrepancies of political forces both in relation to the very new Constitution and the principles and norms laid down in it - the interpretation of human rights, private property, federalism, the division of powers, the prerogatives of the presidential authority and the organization of the judiciary. The achievement of consent on these issues turned out to be a very difficult matter, went with great difficulty and determined the content of the transition period. It made a certain stage of post -revolutionary stabilization, the meaning of which consisted in the development of the foundations of the legal system (all basic codes); suppressing trends to separatism (who really took up the destructive nature), as well as the economic and political isolation of the regions; building public service at all levels of administrative management. These parameters of systemic self -regulation were manifested especially clearly after 2000 and were accompanied by the development of trends to establish a regime of limited pluralism - controlled democracy or authoritarianism.
However, with the end of the transition period (which was repeatedly mentioned officially), serious doubts appeared in the advisability of continuing this course. If the tasks of post -revolutionary stabilization are solved, then the preservation of previous political trends can lead to the consolidation of authoritarianism in one of the many historical varieties (from Bonapartism to the imperial presidency). In this regard, the existence of opposite interpretations of the concept of “ ending ” of the transition period draws attention: for some it means establishing a democratic system in accordance with constitutional norms, for others - a restoration movement to the previously super -centralized model of the state structure. At the same time, samples of the latter are seen in archaic institutions of the past - from the surrogate institutions of Soviet nominal constitutionalism to the state structure of the imperial period. It is clear that the ideas of supporters of restoration, who, like Bourbons, “have not forgotten anything and have not learned anything,” have little in common with modern ideas about constitutionalism, liberal democracy and parliamentarism. Unfortunately, however, it is this restoration interpretation of the transition period that turns out to be in demand (or at least seems to be such by the media). But its adoption and legal execution would mean the rejection of democratic ideals and the completion of the entire post -Soviet constitutional cycle by the restoration of the authoritarian regime .
RG: That is, you think that Medvedev’s amendments are not what we need now?
A.M. : I think that this is by no means moving forward, but rather a continuation of the course that has been outlined earlier, its logical and formal conclusion. One of the key issues in this dispute is judicial reform. The formation of a democratic system is impossible without the implementation of the principle of separation of powers (with all the nuances of the interpretation of this concept in theoretical literature), since it is the most effective guarantee of tyranny. In modern democratic states, regardless of the form of government, it is constitutional justice that acts as an arbiter in resolving constitutional disputes and determining the constitutionality of the adopted laws. Therefore, any attempts to reform this institution that lead to a change in its position in the system of separation of powers, and even more restricting its independence, cause anxiety and should become at least the subject of a serious social discussion . The fact is that the Constitutional Court (according to the 1994 law) was significantly limited in its powers: it is not a guarantor of the constitution (unlike many Western countries); It cannot begin consideration of the constitutionality of laws on its own initiative, finally, does not have a prerogative of the consideration of the actual circumstances of the case (and only the legal component). According to the recent explanations, the Constitutional Court (unlike, for example, from its German counterpart) also does not have a prerogative of considering the constitutionality of amendments to the constitution (cannot consider them even before they became law and after they became part of the Basic Law). But if this is so, what should be the position of the court in the case of “unconstitutional constitutional amendments” and will it not be silent to mean indirect adoption of a certain political position? Does this not mean by the court the well -known doctrine of “political issues” (self -removal from their consideration on the basis of the fact that they are not the competence of the judiciary) or even the presumption of the constitutionality of presidential decrees? Finally, what considerations can the court of the court of previous legal positions can justify? In the 2005 Decree on the issue of the constitutionality of the new procedure for the authority of the head of the region, in which the court revised its decision in 1996, it was stated that the legal positions formed " in the system of previous legal regulation " may be clarified or changed " taking into account specific social and legal conditions ." How expanding can the use of this motivation for solutions be and should not be understood as the beginning of the formation of a new concept (known as the doctrine of “necessity”)? The explanation of these issues is not facilitated by the latest statements by the chairman of the Constitutional Court on the advisability of protecting the " elements of authoritarianism present in the management of the country ."
In this context, it is obvious that the proposed changes to the law “On the Constitutional Court” are a step towards the implementation of the principle of separation of powers . Of course, the procedure for the formation of institutions of constitutional justice is not the same in different countries, however, by general recognition, the model in which various branches of power participate in one form or another, in particular, the judicial community itself, is optimal. The proposed changes finally eliminate even the modest role of the judicial community in the formation of this institute, which it still possessed (in the form of the right to election by judges of the chairman) and actually give a solution to this issue to the president (especially, given the current state of the Federation Council and the above prospects for the next review of the procedure for the formation of this institution). The result may be a refusal to divide the authorities and the integration of the judicial branch into a single power vertical under the control of the executive branch (which took place in the Soviet period). It should be noted that critics of the modern “judicial counter -reform” generally see its main manifestation in limiting the independence of judges precisely by the expansion of the powers of the chairmen of the courts. The judiciary is under very stringent control of the executive branch, which casts into question the effectiveness of the relevant constitutional norms. This development vector is really able to lead to the establishment of imaginary constitutionalism.
RG: What is "imaginary constitutionalism"?
A.M. : The concept of “imaginary constitutionalism” means that the constitution formally remains unchanged (and acting), but in practice the political regime is increasingly limited by legal institutions, and the adoption of key decisions is actually derived from the control of constitutional norms. This effect is achieved by virtue of the three features of the system: firstly, the constitution itself is built in such a way that it gives priority in solving key issues of the presidential power-the head of state, which stands over the system of separation of powers, coordinates their activities, but at the same time has important legislative prerogatives (indicated law) and heads the executive vertical of power (the list of its powers in this area remains open, which gives exceptionally broad opportunities for the delegation of powers); Secondly, it contains a number of gaps and uncertain provisions, which, if necessary, can lead to an expansion interpretation of these powers in favor of the executive branch (the so-called hidden or “sleeping” powers of the presidential authority); Finally, thirdly, it does not exclude the possibility of a significant change in the meaning of constitutional norms through their interpretation, which reserves not only and not so much behind the judicial authority as in fact for the presidential (since it is the “guarantor of the Constitution”).
A.M. : Yes.
A.M. : Yes.
What is it connected with?
