
In honor of the 20th anniversary of the adoption of the Constitution of Russia, which will be celebrated on December 12, an amnesty may be declared. The Council for Human Rights under the President of the country has prepared two draft amnesties, which are now in Vladimir Putin.
According to the Internet Gazeta Znak . COM , the first project proposes to free convicts for a period of not more than 3 years for non-violent crimes, women with minor children and children with disabilities, pregnant women, disabled people of the I or II groups convicted with serious diseases who have committed crimes under the age of 18. It is also proposed to give freedom to those who have committed a crime “not entailing irreversible consequences”; having medals and awards; women convicted for up to 5 years; men convicted for up to 5 years and have served a third of punishment; convicts for a term of up to 10 years who have served half the punishment; convicts for more than 10 years of punishment. In addition, those who were convicted of crime by negligence and were sentenced to a period of imprisonment of up to 5 years inclusive or up to 10 years of punishment will fall under this project of the amnesty.
In addition to the above, it is proposed to “terminate the inquiry bodies and courts of the case of the case of irreversible consequences of crimes that have not entrusted the punishment for no more than 3 years of imprisonment of suspects who have committed a crime under the age of 18, suspected of committing non -violent crimes, for which no more than 10 years of imprisonment suspected of crimes, for which are provided for which is envisaged. The punishment is no more than 5 years in prison who took part in the hostilities awarded medals. ”
In addition, this project invites the courts to appoint for crimes for which more than 3 years of imprisonment is laid below 3 years in prison, if "actions have not entailed irreversible consequences." It is also proposed to replace convicts to life imprisonment, which has been in places of imprisonment for more than 5 years, is punished with a 20-year term.
The second project also proposes, “guided by the principles of humanism, mercy and justice”, to free not only convicts belonging to the above categories, but also all patients with tuberculosis of the I or II group, women convicted for a period of less than 5 years in prison, men convicted of up to 5 years of imprisonment and have served at least half a period convicted of a period of up to 10 years in prison, who has served at least three quarters of the term, minors convicted for up to 5 years for the first time. The rest of the categories coincide.
Another difference between the first and second project is that in the second categories of convicts are separately spelled out, the effect of the amnesty on which will not spread.
Thus, the convicts who were previously released under the amnesty will not fall under this version of the project, but who were repeatedly committed, convicted, recognized by particularly dangerous recidivists, convicted who committed new crimes already in places of deprivation of liberty, as well as convicted of torture, infection of HIV, pedophilian crimes, involvement of minors in committing crimes, The organization of the criminal community, the illegal storage or production of weapons or drugs, the organization of prostitution, state treason, espionage, abuse of official powers, violation of the authorized relations in the army, public calls for war, as well as terrorists and their accomplices.
In both projects there are no points under which prisoners in the “swamp case” would fall, although the source of the publication close to the leadership of the Human Rights Council says that in the final document received by the State Duma, there is still such a point.
The 7x7 editors asked social activists from the committee to express their opinion on whether an amnesty is needed in Russia now.

- I believe that in our country it is not necessary to conduct an amnesty in our country, but to solve those zones that were mothballed. Corruption in our country is now at such a level that if you begin to seriously comply with Putin’s proposals to combat corruption, then the existing zones are unlikely to be enough. Another thing is that we must revise the dubious affairs in which we have a bunch of innocent people for the sake of indicators of the work of law enforcement agencies. This is another question, and it has nothing to do with amnesty.

Irina Vinogradova, member of the PMC Komi II convocation:
- In any democratic state, amnesties are held regularly. And by and large, we have not have an amnesty recently. In any state, people are forgiven, extended a hand so that they do not commit crimes next time. And in our country, given the conditions in which the prisoners spend 9-10 years, on the contrary, they become more embittered and go out with the thought of taking revenge. Moreover, they do not care who to take revenge: the employees who put them to society. In our case, we must more often show humanism to those who first committed a crime.
There are people who are forgotten about - these are sick. Recently I was called a woman whose son is in the Kirov region. She asks whether it is possible to transport him here, since he is an oncological patient, he needs help. I told her that she would not think about his translation, but about the parole. Such people remain a little to live. It is necessary to pay attention to the disabled, people with serious illnesses, so that they live the last part of their lives not in prison, but with relatives.

Igor Sazhin, Chairman of the CPC "Memorial":
- An amnesty is always needed. The authorities must take into account that the execution of punishment is a socializing structure, and not punitive, and maybe some part of the people is already in the position that they can be released from further serving the sentence. So amnesties are different at different times! I would amnested some social groups-heavy people with disabilities, people at a very large age, who for 80 years, many children who really lived with their young children, people who have not committed violent crimes against the individual and against property. Of course, I would go according to the scheme of the immediate amnesty of people deprived of liberty, including for political reasons: Khodorkovsky, PR, convicted “swamps” ... As for the “Greenpens”, here I would not talk about amnesty. An amnesty needs guilty people, and the innocent "Greenpses" should simply be immediately released without any amnesty. They are simply not guilty of anything.

Semen Tereshonkov, journalist:
- An amnesty is needed, because there was no sensible amnesty for a long time. We had two to three hundred people out of 800 thousand prisoners. And it is completely incomprehensible who exactly she touched. Amnesty is needed for a long time. If there is a good amnesty now, what I don’t believe in, then it will be good. We have a huge number of people sitting for nothing. The Council for Human Rights under the President, who was developing a project, had a difficult task. On the one hand, the project can be entered in the project “Prisoners of Bolotnaya”, but then those who deservedly received their articles will fall under the amnesty. For example, those who really resisted police officers or attacked them. But I do not think that in the project of the amnesty, the high -profile Pussy Riot , Mikhail Khodorkovsky, Navalny will appear.
