The Medvedevsky District Court (Orshanka) at a meeting held on June 10, decided to return the case of the case of 26-year-old Samvel Asatryan to the prosecutor's office.

Recall that the trainer-teacher of the Orsha children and youth sports school is accused of evading the draft for military service. At the same time, Samvel Asatryan had already served in the army, since until recently he was a citizen of Armenia.

Six meetings have passed since the end of March. One of the first requirements of the defense was the request for the return of the case to the prosecutor. According to the legal support of representatives of the “soldiers' mothers of St. Petersburg” who exerted a resident of Mari El, it is not clear how some evidence, for example, the agenda, appeared in the case. In the case file there was no information about how they joined the case. The conscript of Samvel Asatryan did not have the results of a medical examination.

Since 2013, Samvel Asatryan has been working as a coach at a sports school in Orshanka. After receiving Russian citizenship and registration, he began to receive summons from the military registration and enlistment office for military service in Russia.

He managed to marry and make a child Samvel Asatryan mistakenly considered that since he served in Armenia, he should not serve in Russia.

Last spring, he turned to the military enlistment office with a request to submit an offer to the draft commission on the need to release him from the draft, attaching an Armenian military ticket, but was refused. On August 1, 2013, the law “On Military Duty and Military Service” was amended, according to which only citizens who have served military service in another state are exempted from the draft, while Russia should have relevant agreements with such countries. At the moment there are only two of them - with Tajikistan and Turkmenistan.

In the fall of 2014, the young man tried to call again, but he, repeatedly stating that he had already served, did not appear on the summons. Having regarded such actions by Samvel Asatryan as evasion, the military commissariat transferred information to the Investigative Committee, which, having interviewed all the same employees of the military enlistment office, opened a criminal case against the teacher. At the same time, the suspect managed to achieve guilty, and the case in March was transferred to the Medvedevsky District Court for a hearing in a special order, that is, without a trial.

During the consultation with the lawyers of the “soldiers' mothers of St. Petersburg” it turned out that in the actions of Samvel Asatryan there was no corpus delicti: in the fall he was not subject to an draft in the army, and in the spring, despite his demands to free from the service, he regularly appeared on the summons.

Since the accused is a pedagogical worker, his call is illegal in the fall, since for this category of citizens other deadlines for the implementation of military duty - from May 1 to July 15, ”the human rights activists explained earlier.
