Deputies of the Arkhangelsk Regional Assembly will receive one -time payments after the termination of their powers. After several years of proceedings, they defended this right in the Constitutional Court. At the same time, when determining the amount of “weekends”, legislators were obliged to take into account the socio-economic situation and the capabilities of the regional budget. But, knowing the natural "modesty" of our folk chosen ones, we can confidently assume that a hundred thousand rubles will not be limited to ...
Recall that in 2009, local parliamentarians adopted a law on guarantees to persons replacing the state dollars of a constituent entity of the Russian Federation, including regional deputies. According to the accepted norms, upon termination of authority, they were supposed to be a one -time payment in the amount of two monthly salaries. The prosecutor’s office challenged these provisions in the Arkhangelsk Regional Court, noting during the process that the deputies exceeded the authority. The regional court did not support the prosecutor’s office, but the Supreme Court agreed with the supervisory authority, the decision of the regional court canceled and recognized the disputed clause of the regional law as invalid. The deputies went to the end and turned to the highest judicial authority.
On April 5, the Constitutional Court of the Russian Federation put an end to this issue, emphasizing that "the monetary payment allows to protect the rights and legitimate interests of the deputy in the period after the surrender of the deputy mandate, thereby ensuring his independence in the exercise of deputy powers." At the same time, adding that “when establishing the amount of payments, the legislator of the constituent entity of the Russian Federation must comply with the balance of the private interests of citizens and public interests of the constituent entity of the Russian Federation, as well as take into account the socio-economic situation and the possibilities of the budget of the subject of the Russian Federation”.
In addition, the Constitutional Court obliged people's representatives to foresee the grounds on which the receipt of “weekends” is excluded. Thus, this payment cannot be applied upon termination of deputy powers as a result of offenses allowed by the deputy, for example, in connection with the entry into the legal force of the conviction of the court.
