Public Foundation "Sensicity" continues to investigate and give public the facts of violation of the principles of a secular state. Repeatedly in the media and on Internet sites, including the Orthodox , there were allegations that the Federal Security Service of the Russian Federation provides state protection to the Patriarch of Moscow Cyril on the basis of a certain decree of the President of Russia. We did not believe that there was such a clear violation of the law on the state , as They are used to the fact that our power is trying to work carefully and prevent written evidence of illegal activity. In addition, in none of the legal framework and on any government or presidential website there are any references to orders for the provision of such protection.

In an effort to understand this, in October 2010, we sent written requests to the President of the Russian Federation, the General of the prosecutor of the Russian Federation and the FSO of the Russian Federation. In addition, we wrote a statement to the Foundation for Human Rights in order to launch parallel requests in the FSO and the Accounts Chamber of the Russian Federation.

Next, we began to receive letters. And each next was more interesting than the previous one.

The first response came from the Accounts Chamber on November 18, 2010. The Director of the Department of Primak said that he sent the letter “ on belonging ” to answer in the FSO. Thus, the Accounts Chamber did not see signs of misuse of the budget and selfless.

The second response came from December 1, 2010 from the Main Military Prosecutor's Office : “ The appeal was aimed at belonging to the organization of permission on the merits of the leadership of the FSO of Russia .” And nothing was alerted.

The third answer was received on December 14, 2010 from the FSO itself . The head of the Center for Public Relations of Raluskov in the second paragraph brought a squeeze from Art. 6, 7 and 8 of the Federal Law “On State Protection” No. 57-ФЗ : “... The federal state protection authorities carry out the state protection of the President of the Russian Federation, the chairman of the Government of the Russian Federation, representatives of the Constitutional Court, the Supreme Court and the Supreme Arbitration Court, as well as the heads of foreign states and governments during the period of their stay in the territory of the Russian Federation ”. The fourth answer was also received from the FSO on January 21, 2011 . Evsenin, head of the legal support department of the FSO, honestly and openly wrote: “ In accordance with Article 80 of the Constitution of the Russian Federation, the Russian Federation decided to provide state protection to the Patriarch of Moscow and All Russia .”

This is a truly unique answer. Firstly, the state for the first time officially admitted that there was a presidential decree that granted the GOS to the head of the public religious organization, who thereby became a “person who replaces the state position.” Those. An infectious act has been signed and still applied.

Secondly, obviously throwing FSO lawyers, who are aware of the precariousness and illegality of servicing the head of the Russian Orthodox Church. They refer to the norms of the Law on Gos. The Khust and the articles of the Constitution, which do not impose the protection of non -state employees in the responsibility of the FSO and do not allow the authority to provide such protection to the President of the Russian Federation.

The FSO link is especially impressive to the 80th article of the Constitution . Many months of attempts to place billboards with the 14th article allowed the participants of the Sanitism Foundation almost by heart to learn our constitution, Article 80 of which declares the President of the Russian Federation the “ guarantor of the Constitution ”, the rights and freedoms of man and citizen. But why does the “ guarantor ” violate the 14th article of the Constitution and the federal law? Why does the “ guarantor of rights ” violate our rights as an absolute monarch, making decisions on inappropriate budget expenditures without any regard to the right?

As far as we know, this secret decree was signed in the early 2000s President Vladimir Putin, whose attitude to the laws of the country and the opinion of citizens is already well known. But after all, the lawyer President Dmitry Medvedev, who does not get tired of talking about the need to build a rule of law, is well aware of how the state serves the head of the Russian Orthodox Church.

Why have they been covering a violation of the law for more than ten years? Because this illegal activity fades in comparison with other government scams? After all, it was worthwhile to drag an amendment through the manual Duma into the law on the state-guard and put an end to Article 9 after the words “... can be provided to other persons”! And then there would be no formal violation.

We are not against the FSO. We do not agree that the really necessary special service, the authorities, who believed in its permissiveness, impunity and eternity, uses illegal goals and so awkwardly substitutes.

We will demand from the President and the Prosecutor General of the investigation on the fact of the illegal provision of state protection to the head of a religious organization, many years of inappropriate use of funds allocated to finance the activities of the FSO, and prosecution of officials who connected the violation of the rights of Russian citizens.

It would be better if this FSO guarded the airports!
