| The bankruptcy of a defense plant is unlikely to help creditors get their money back The Far Eastern defense enterprise Vympel may soon be declared bankrupt. The bailiffs of Amursk (Khabarovsk Territory) seized the real estate of the enterprise, which still regularly supplies the troops with ammunition. Having verified the validity of the demands of the Solikamsk Ural plant and having failed to reconcile the debtor with the creditor, the arbitration court of the Khabarovsk Territory decided to satisfy the applicant’s demands and collect from the defendant the principal amount of the debt of 4.5 million rubles. for a carload of chemicals shipped to the cartridge plant back in 1998.
The main reason for the deplorable state of affairs at the defense enterprise is the failure of the Ministry of Defense to fulfill its obligations to pay for government orders (136 million rubles). And the company now operates virtually for free. Trying to get their money back, defense industry workers repeatedly turned to federal structures, but this did not help.
According to experts, the supply of new cartridges to the Russian army today is less than 5% of the requirement. Vympel is the only ammunition plant in Russia where world-class technologies are used in production.
The prospect of bankruptcy forced the management of Vympel to look for ways to pay off the debt. Patrons place special hope in export contracts. But so far the court has only been presented with correspondence, from which it follows that the plant will soon have money to pay off the debt. After settlement of the deal with the DPRK, Vympel expects to pay off the debt to the Solikamsk plant with a one-time transfer.
Now it's up to the lender, which is also a financially distressed defense industry entity. If an agreement cannot be reached, Vympel will be declared bankrupt and the seizure of property for sale will begin. Patrons can only wait for a court decision, which could create a legal incident. A bankruptcy procedure will be introduced at the enterprise, but it will be impossible to apply it, since the bulk of the assets (79%) are mobilization capacities, and according to the law they are not subject to alienation.
