The Kirovsky District Court held the fifth hearing in the case of the murder of student Anna Apatchenko. The court sentenced the defendant Nikolai Kovalevich.
Speaking with his last word, the young man said that he fully admits his guilt and repents of his deeds. Previously, he also apologized to the mother of the murdered girl.
The court sentenced Nikolai Kovalevich to 10 years of imprisonment in a maximum security correctional colony with restriction of freedom for a period of 1 year 6 months. The term of imprisonment includes the year spent by the defendant in a pre-trial detention center. In addition, he will pay Anna’s mother two million rubles as compensation for moral damage.
“The court came to the conclusion that the defendant should be sentenced to real imprisonment in a maximum security colony with restriction of freedom after. The court did not identify any exceptional circumstances that significantly reduce the degree of public danger of the crime,” the judge said when announcing the verdict.
The victim’s side also insisted on compensation for moral damages in the amount of five million rubles. During the trial, Nikolai Kovalevich agreed that his actions had caused his mother suffering, but left the amount of compensation at the discretion of the court.
“Taking into account the requirements of reasonableness and fairness, his lack of a place of work, his young age, the court considers it necessary to partially satisfy the demands of the victim, collecting two million rubles in her favor,” the judge said.
After the end of the court hearing, Nikolai Kovalevich’s lawyer said that he would appeal the court’s decision, but did not give any additional comments.
According to the victim's representative, Anna Apatchenko's mother may also file an appeal.
“The court did not satisfy the request of the victim to exclude Nikolai Kovalevich’s confession from the case. This evidence allows us to reduce the term of imprisonment by a third. As for material compensation, this amount is quite adequate according to the prevailing judicial practice in the Tomsk region,” said Alexandra’s lawyer Apatchenko.
Anna's mother, in turn, said that she considers this crime to be a murder with particular cruelty.
“I don’t need moral compensation, it can affect the term. If he wants to be released on parole for good behavior, then he will have a statement of claim behind him, he won’t be able to just get out and that’s it,” said Alexandra Apatchenko.

At the first court hearing, Anna's mother asked the court to impose the most severe punishment and regard this crime as murder with particular cruelty. On the third, Nikolai Kovalevich apologized to the mother of the deceased Anna. The defendant pleaded guilty to the charges.
