| Krasnoyarsk deputies intend to sue RAO UES of Russia Deputies of the Legislative Assembly of the Krasnoyarsk Territory intend to return large blocks of shares of RAO UES of Russia and JSC Krasnoyarskenergo to regional ownership. At the first meeting of the permanent commission on property of the regional legislative assembly in 2001, a corresponding draft resolution was prepared.
Chairman of the commission Vsevolod Sevastyanov is confident that this document will be approved not only by the majority of Krasnoyarsk deputies, but also by their colleagues from other Siberian regions. According to him, during the corporatization and privatization of the Russian energy system, regional and federal authorities agreed that the management of the state stake in local energy companies will be carried out on a parity basis: 25.5% of the shares are managed by Moscow, the same amount is transferred to local administrations. “Until 1998, i.e. before Anatoly Chubais joined the RAO system, this condition was met,” says Mr. Sevastyanov. If the chairman of RAO UES of Russia refuses to return to the previous procedure for managing the state stake in Krasnoyarskenergo, he will face a lawsuit.
In addition, deputies of the regional legislative assembly intend to demand that Anatoly Chubais fulfill one more condition for the privatization of the energy system. According to Vsevolod Sevastyanov, it was assumed that another 30% of the shares of RAO UES, in addition to the state stake of 51%, would be distributed among the constituent entities of the federation in proportion to the amount of electricity consumption. This was not done. The Krasnoyarsk deputy believes that if this condition can be achieved, the Siberian regions would be able to concentrate a fairly significant package in their hands.
The legal service of the Krasnoyarsk Legislative Assembly is already preparing legal claims against the Chairman of the Board of Directors of RAO UES of Russia Anatoly Chubais and the Russian government, since the deputies are confident that the heads of energy companies will not agree to voluntarily transfer the “appropriated” shares to the regional authorities.
