| Rossvyaz is against the privatization of Tatarstan Pochtasy The Kazan authorities decided to privatize Tatarstan Post. The Federal Communications Agency (Rossvyaz) calls this step contrary to the Constitution and intends to seek its reversal in court. This was stated recently by the head of Rossvyaz, Andrei Beskorovainy.
The dissatisfaction of the federal regulatory body was caused by the decision of the Ministry of Land and Property Relations of the Republic of Tatarstan, which on July 26 adopted a resolution on the privatization of the state unitary enterprise “Tatarstan Pochtasy Post Office”. According to the resolution, the state-owned enterprise was transformed into OJSC Tatarstan Pochtasy. The resolution also approved the transfer act for the transfer of property, rights and obligations of the State Unitary Enterprise UPS "Tatarstan Pochtasy" to the open joint-stock company "Tatarstan Pochtasy", the charter of OJSC "Tatarstan Pochtasy" and the privatization plan for the enterprise.
“The initiative of the republican authorities contradicts the Concept of restructuring of federal postal organizations,” said Andrei Beskorovainy. “We intend to seek the reversal of the decision to privatize Tatarstan Post in court.” State Unitary Enterprise UPS "Tatarstan Pochtasy" is classified as the property of the Republic of Tatarstan in accordance with the agreement between the Russian Federation and the Republic of Tatarstan dated February 15, 1994 "On the delimitation of areas of jurisdiction and mutual delegation of powers...", as well as the Agreement between the governments of the Russian Federation and Tatarstan on property issues dated June 22, 1993. “These regulations contradict current federal legislation,” says Mikhail Yakushev, head of the legal department of the Ministry of Information and Communications. “ In accordance with Article 71 of the Constitution of the Russian Federation, information and communications are under the jurisdiction of the Russian Federation along with federal energy systems and nuclear energy.”
In addition, according to Mikhail Yakushev, Tatarstan Pochtasy OJSC, being the property of a constituent entity of the Russian Federation, actually violates the requirements of the federal law “On Postal Services”, according to which state postal organizations can be founded only on the basis of property located in the federal ownership, and exist only in the form of a Federal State Unitary Enterprise or Federal State Institution.
The privatization of Tatarstan Pochtasy also diverges from the strategy of creating a single national postal operator - FSUE Russian Post. It already includes departments of the Federal Postal Service of 83 regions. And the creation of Tatarstan Pochtasy OJSC may delay the completion of this process indefinitely.
“The authorities of Tatarstan, with their decisions, deal a blow to ordinary residents of the republic,” says Mikhail Yakushev. -- Tatarstan Pochtasy OJSC does not have a license to provide postal services and will have to apply for one.
