Remember, we fit in a little with one boy from Tyumen - a teacher at a local university, fired from his job for political reasons (he took part in a rally of local anarchists)? So, in accordance with our current excellent legislation, Andrei Kutuzov was fired quite correctly, even if at the time of his dismissal the verdict in his case had not yet entered into legal force.
It's all about the amendments to the Labor Code, which were adopted by our deputies under the influence of what seemed crazy from the outside, but in fact a very conscious fight against pedophilia.
Tk, art. 65: "...a certificate of the presence (absence) of a criminal record and (or) the fact of criminal prosecution or the termination of criminal prosecution on rehabilitative grounds, issued in the manner and in the form established by the federal executive body exercising the functions of developing and implementing state policy and legal regulation in the field of internal affairs - when applying for a job related to activities, the implementation of which, in accordance with this Code, other federal law, is not allowed to persons who have or have had a criminal record, are or have been subject to criminal prosecution" (paragraph introduced by Federal Law dated December 23, 2010 N 387-FZ).
So, teaching activity in the Russian Federation was beyond the presumption of innocence. What won’t you do for a “child’s tear”!
In essence, we are talking about legislative regulation of political persecution. Grab an unwanted teacher, start a fake case about some kind of robbery or "weed" - and hello to your career. The case may fall apart, but the fact itself is already enough to prevent the now former teacher from accessing students on completely legal grounds. The case of the philologist Kutuzov is only the first sign.
This “case” shows how such laws are pushed through under the guise of a false propaganda campaign. And until you yourself are faced with the practical consequences of such laws, you will not even guess about them. It would seem how the fight for the “child’s tear” is connected, especially considering that it was waged on behalf of the president, and the fact that when applying for a job they require another piece of paper from you and, based on what is written there, they may be refused in the right to work? I believe that there may be many such amendments that legitimize the sluggish securitization of society. We just rarely encounter such things ourselves. Rarely yet.
In the case of the philologist Kutuzov, the notorious center “E” - the political police - played an important role. As it turned out, his activities fit well into the “fight against pedophiles.” I believe that there are many other laws passed in recent years under the guise of large-scale propaganda campaigns that expand the powers of this police department. The recent elections on December 4 stopped one such campaign - against "homosexual propaganda".
It is obvious that securitization in terms of expanding the powers of the political police also has a sectoral nature. I don’t like the book by Soldatov and Borogan about the history of the FSB, but it nevertheless presents several interesting and little-known stories. This is how journalists describe the emergence of Center “E”: “On September 6, 2008, Dmitry Medvedev, who had just been elected president, signed a decree on changes in the structure of the Ministry of Internal Affairs. In place of the Department for Combating Organized Crime and Terrorism (DBOPiT), the Department for Combating Extremism was created, and already on April 23, 2009, its leader, General Yuri Kokov, announced that the new structure was fully ready for work. Similar changes affected all regional departments of the Ministry of Internal Affairs. Thousands of experienced operatives, accustomed to dealing with bandits and terrorists, were targeted at the new enemy. Nurgaliev explained that the department for combating organized crime was disbanded because the mafia no longer poses a great danger. “There will be no new criminal revolution... The crime rate is decreasing... It can be stated that the era of criminal wars is in the past. However, the true reason for the reform was different. April 15, 2009. year, Yuri Kokov, head of the established Department for Countering Extremism (DPE), speaking at a public forum, explained: “The operational situation may become more complicated in the context of the development of a global crisis and the deterioration of the socio-economic situation.” He was supported by Alexey Sedov, head of the Service for the Protection of the Constitutional System and Combating Terrorism of the FSB: “It is necessary to take into account the consequences of the global financial crisis as a catalyst for a possible intensification of terrorist activity and the growth of extremist manifestations, including violent forms on the part of various kinds of “dissenters”, non-systemic opposition, sides of youth and students." At the same time, statistics show that extremism, compared to organized crime, poses an incomparably lesser danger. According to official data from the Main Information and Analytical Center of the Ministry of Internal Affairs, the number of crimes committed by members of organized criminal communities investigated in 2008 amounted to 36,601. At the same time, only 460 crimes of an “extremist nature” were registered during this period. It turns out that there is little to combat Due to the number of non-serious crimes, the authorities mobilized the structures of the former Department for Combating Organized Crime and Terrorism, which previously included the Operational Investigation Bureau (ORB at the State Administration) for federal districts, “T” centers (for combating terrorism), as well as regional Organized Crime Control Departments. Today, Centers for Countering Extremism (the so-called “E” Centers) have been created throughout the country on the basis of former Organized Crime Control Departments. In addition, a legal vertical is being built to combat extremism: extremist departments are being created in the prosecutor's offices and in the Investigative Committee. Of course, all these people need to be occupied with something - at least, reporting to the Ministry of Internal Affairs has not been canceled."
So, first: for the sake of fighting mythical extremism, we abandoned the targeted fight against organized crime, and therefore against the notorious corruption, since today organized crime, and even banditry, are unthinkable without corruption accompaniment. Secondly, the fight against “extremism”, from the point of view of the apparatchiks of the “E” center, probably “does not work” because “the legal framework is imperfect.” After all, the political demand is obvious, and since it exists, it means there must be a “phenomenon” that is being fought against. If few criminal cases have been opened, it means that operational workers, on the other hand, do not know how to isolate this phenomenon. This means that it is necessary to both change laws and sharpen the practices of political persecution. In fact, the state apparatus is inventing a crime - the securitization of heterogeneous social practices into a new phenomenon of “extremism”. Truly creative work, to say the least.
If the second is more or less a matter of time and the creation of a tradition of law enforcement, then the first point is not so simple. After all, you cannot take an anti-social law and directly adopt it. There will be too much screaming from the so-called human rights activists. Therefore, it is necessary to move carefully, blinding society in advance and neutralizing opponents with a wall of propaganda. The securitary genesis of the illegal abolition of the presumption of innocence was successful under the shadow of the “fight against pedophiles.” It turned out that everything in our country is teeming with them, but we had no idea! Repurposing the Organized Crime Control Department - it’s surprising that the status of one of the most important intelligence services can be changed by an industry decision! - passed amid loud cries of victory over organized crime and due to the reactivation of the old propaganda myth about the “dashing 90s.” It is especially sad that the declared “fight against corruption” turned out to be reduced by presidential decisions to empty chatter - there is simply no one to fight it.
In a conversation with hasid, I heard the opinion that Center “E” is turning into an independent intelligence service. This is true to some extent - in any case, judging by the way this body - the political police - intimidates society, such a conclusion is not difficult to draw. However, practice shows that the status of an independent intelligence service would not hurt Center “E” at all. Because in this case there is a chance that he will be subordinate to Moscow along his vertical line. Nowadays, within the structures of the Ministry of Internal Affairs, Center “E” operates within the framework of general subordination, and depends directly not on Moscow, but on whose “administrative property” the former police are located in the region or city. For example, Center “E” received informal instructions to seize the servers of a social games forum in one region on the eve of the December 4 elections directly from the political leadership of the region.
The prospects for the securitization of society depend on the dynamics of the social norm and the degree of tolerance in society towards certain social anomalies. Yesterday “pedophiles” came under fire, tomorrow they may become “gays”, and those who “need it most” - social activists - are always under pressure. Abnormal. Soon all kinds of new “abnormals”, of which there will be more and more (numerically and qualitatively) as a result of the administrative creativity of the “E” center, will have only two choices: power and zone.
