Investigation of the FBK: The repair of the Omsk barracks is not to blame, responsibility on the Ministry of Defense

The "Corruption Foundation" published an investigation about the circumstances of the tragedy in the village of Svetly near Omsk. The company "Remexstroy" was only a performer over whom there were several customers, so it cannot be considered the only culprit of what happened . Perhaps the collapse occurred precisely due to the dilapidation or emergency state of the building, and not the poorly completed work. The reason, most likely, was a conspiracy to minimize the cost of work. The repairs estimate did not include the requirements for the reconstruction or strengthening of the building.

Due to the collapse of part of the barracks on the night of July 13, 23 conscripts were killed, later another died in the hospital. The Investigative Committee opened a criminal case under the articles "negligence", "Violation of safety rules in the conduct of construction work" and "Exceeding official powers." Two suspects were detained in the case: Oleg Ponomarev, the head of the 242nd training center of the Airborne Forces and Alexander Dorofeev, General Director of Remexstroy , which performed the repair of the barracks.

Oleg Ponomarev partially pleaded guilty, noting during a court session, which is an accomplice in the crime. He is ready to answer for the death of his paratroopers, but asked the court to give him time to say goodbye to the dead and look into the eyes of their mothers. Without restraining his tears, the colonel apologized to relatives, the radio correspondent Anna Travnikova reported from the courtroom on July 15.

The collection of signatures in defense of Oleg Ponomarev began on the Change.org website, the petition of its release almost gained the number of signatures for consideration - 2.5 thousand.

"Ponomarev O.Yu. - a real Russian officer who took guilt on himself, because in his life there are such concepts as honor, dignity, respect for the uniform, the power of the word. Colonel Ponomarev took himself to the" accomplices "because he personally experiences this tragedy, because he is a real paratrooper. He knows the sacred meaning of the vestibule and blue. That's why he pleaded guilty ... But the most interesting thing is that not the head of the 242 Airborne Forces, Colonel Ponomarev O.Yu. signed a protocol on the settlement of soldiers to the barracks! Colonel Parkhomenko, and not Ponomarev O.Yu, signed the protocol.

So far, official law enforcement agencies are engaged in the collapse of the collapse, the investigation conducted the Fund for the fight against corruption . The author, lawyer of the FBK Lyubov Sobol , spoke about the results of Radio Radio:

- We came to the conclusions that the company Remexstroy LLC, which is now represented by us as responsible for the tragedy, is rather "beating boys." This company, in our opinion, is naturally crazy. According to the history of recent years, she won several contracts for construction in parts of the Ministry of Internal Affairs and the Ministry of Defense. She received them illegally. In order to get contacts for construction, the total cost of which is more than 2 billion rubles, it brought another dummy company, arranged a “linden” competition. The second company, "repairing", belonged to the same founder as "Remexstroy" - Dorofeev, and they took these construction contracts, and then performed work, what quality - it is unknown. And therefore, we believe that this company is crazy.

Everything that was built on the territory of this barracks, instructions and quality control of these works are a fully responsibility of the Ministry of Defense

But in this tragedy, not only them are to blame, and the responsibility should apply to the Ministry of Defense of the Russian Federation in connection with the following. “Remaxstro” during the repair of the barracks were subscribers. They were a subscribing organization for construction. Initially, other organizations were supposed to be fulfilled by the contract, which were in the department of the Ministry of Defense, which ordered repairs in the barracks near Omsk. This repairs were carried out by the general contractor - the company "Special Instrust engineing under the special construction of Russia". She gave these works for a subcontract. And then this other company, the subsubricious contract, which is also a subordinate to the Ministry of Defense, gave the work to Remexstroy. That is, they were the final performers.

"Remuxstroy" could not perform the volume of work that differs from the defense of the Ministry of Defense. That is, everything that was built on the territory of this barracks, instructions and quality control of these works are a fully responsibility of the Ministry of Defense of the Russian Federation. Judging by the local estimates and documentation, which we watched in the public domain, the work that Remexstroy performed could not lead to the collapse of the barracks. These works concerned the cosmetic repair of the building. We have a version that we are currently checking. According to her, the barracks required overhaul and reconstruction, but these works, in connection with the corruption component, were transferred along the chain. As a result, the company, which actually carried out them, received less funding and received a task for cosmetic repair of the building instead of making a complete reconstruction of the load -bearing beams and so on.

- What is the mechanism of the scheme you identified with fake firms at the auction and is this often happening? How are such frauds are generally possible?

- At these auction was not a front company. At the maximum initial price of bidding, their only participant took the contract, that is, at the maximum cost received contact "Remexstroy", there were no other participants. And there is a reason to believe that they could not be there, that is, everything was initially done to obtain a contract with the name of this company. And we have a suspicion that this company was in conspiracy with the organizer of the auction due to the fact that an independent construction company that would come to fulfill the state order would not have enough information.

These bidding went illegally, since they did not have a complete description of the volume of work. There was no working design documentation, and without it it is impossible to build anything. There was only information of the local estimate, where an approximate list of those building materials that would be required to carry out repairs were outlined, but there were no complete drawings, sketches and documentation there. If we look at the whole story of Remexstroy - the company of Dorofeev, which is now arrested, then we will see that in most trading she participated with a late company. The scheme was very simple. Another company came, they allegedly arranged a reduction in price, arranged linden competition, and then one of the firms executed a contract.

Naturally, the customers should have seen this and understand who comes to them for auction, what kind of firms, to whom they belong. This information is easy to find. Just like us, this could do this in the Ministry of Defense. There is nothing original and cunning. This was done to report that there were auction, that we did not bring our company, but it came as a result of some kind of open competition. This, of course, was not there.

-The head of the suspects has so far included the head of the 242nd training center of the Airborne Forces Oleg Ponomarev and the head of the company that carried out repairs,-Alexander Dorofeev. Do you think that these people are to blame?

- I believe that on the charge of these people the investigation does not need to stop and law enforcement agencies must disclose all this chain. For some reason, people are accused now who are in the chain we identified only in the lower positions. They did the work that they were lowered from above, but no one talks about the responsibility of higher bosses. This is the same company "Special Institute of Engineering under the Special Construction of Russia", the same Ministry of Defense. And according to the legislation of the Russian Federation, the General Customer is responsible for the activities of subcontracting organizations. That is, just higher organizations should be responsible for "Remexstroy". It was they who were supposed to monitor the quality of these works, they are looking at what they produce at the facility, and if they did not follow the fact that some technologies were not observed, it is they who should be responsible. Therefore, of course, it is necessary to check not only the activities of the final performers. The search exclusively "beating boys" in the form of small construction crooks, I believe, will lead to the fact that the system will not make any conclusions and similar tragedies, unfortunately, can be repeated.

- Is it possible that in relation to other buildings, the repair of which was carried out by Remexstroy, an examination will be carried out ?

This information is easy to find. Just like us, this could do this in the Ministry of Defense. There is nothing original and cunning here

- It has already been announced that there would be an indication of checking these buildings and buildings for high -quality repair and examination of what was done or not done at these facilities. But discussing this, we are leaving for another plane, because the conclusion of our investigation is that we need to look not at the work that were carried out in this building, but at those that were not carried out, but should have been carried out in this barracks.

That is, "Remuxstroy" in accordance with the local estimates that we discovered, carried out only cosmetic repairs. They said that they had to substract the walls and change the windows, and, possibly, Remexstroy completed them qualitatively. There could be some kind of imperfections, but this did not affect the collapse of the barracks. For example, the emergencyness of the building itself could influence the collapse of the barracks and that those required reconstruction work was not carried out. For this segment, the Ministry of Defense and precisely those general contracting organizations that constituted work documentation for construction are liable for this segment.

Why didn't they order reconstruction? Why didn’t they order the construction of a new barracks if this one was dilapidated?

That is, Remexstroy and other organizations were only performers of what they ordered from above. Now we will all be told that we should check the quality of work. This is correct and good, but this is not enough, because we must check, including the task. That is, we must find out if all the work ordered. Why didn't they order reconstruction? Why didn’t they order the construction of a new barracks if this one was dilapidated? And why didn’t they order the strengthening of the load -bearing beams of this barracks, but ordered only wall plaster? We must go deeper, ask other questions, forcing law enforcement agencies to dig on and look for the actual reasons for the collapse of the barracks.

- We really hope that the corresponding conclusions will be made that a high -quality investigation will be conducted and all the perpetrators will be found. Not only the final performers, but also the customers of this repair, those who were supposed to monitor the quality of work. We hope that conclusions will be drawn and the tragedy will be exceptional in nature, the same events will not be repeated in the future. But now, the public should put forward a strict demand for the Ministry of Defense and for law enforcement agencies to identify the actual reasons for what happened near Omsk, ”Lyubov Sobol believes.

About a month ago, the Corruption Fund also published an investigation into the circumstances of the state contract for the repair of all buildings and structures of military towns of the Ministry of Defense of the Russian Federation . The amount of the state contract is 27 billion rubles. The fund revealed two violations: the contract was concluded earlier than the release of the state procurement, and the terms of work in the state contract were illegally extended for a year. During the trial, the Federal Antimonopoly Service recognized the fact of violations. Now the contract will be terminated through the court if a new order of the government is not urgently adopted.

The head of the Ministry of Defense, Sergei Shoigu, apologized today before the families of the victims.
