The mechanism for transferring objects of the scandalous developer to new companies is not determined at the end of last year, the capital's officials determine the new investors on the objects of the scandalously known company LLC "Vyudorok". According to the Decree, the Moscow government of December 28, 2005 became the company CJSC M.O.R.E.-Plaza, CJSC Garantatatkapal, Vesta-II CJSC and CJSC Trust No. 26. Old investment contracts between the city and the “Wedeck” should be terminated until January 4, and until January 11, 2006, the administration should submit draft agreements with new investors. However, these points are still not executed. The matter was complicated by the fact that there were never similar precedents in the city, and no one knows how to legally draw up new contracts correctly. At the same time, as the new developers explained at a meeting with the First Deputy Head of the Department of Urban Planning Alexander Kosovan, held on January 13, the general director of the Wordea Alexander Zaychuk ignored all the agreements and did not answer phone calls. In this regard, it was impossible to sign the contract or get construction documentation from the old developer.
They also encountered legal problems in the district administrations. As the head of the prefecture of the Eastern District of Moscow, Nikolai Evtikhiev, explained, the question arose of what to do with the money paid earlier by the "trowel" in the form of fees.
“In addition, the Popamilian list of private investors is not indicated anywhere,” adds Anastasia Antonycheva, a member of the initiative group of deceived shareholders of the “Wedeck”. “And as a result of the apartment, not everyone may get.” According to Igor Grigoryan, the general director of the Inkvarttstroy real estate company, the receipt of apartments can be guaranteed only if the registration of housing under construction is carried out in the municipal housing department. “In addition, this measure will exclude the situation with double sales,” he added.
It is also not clear to the equity holders of "Wedak" how to formalize relations with new developers. Deputy General Director of M.O.R. - Plaza "Mikhail Mikhailov proposes to make a tripartite agreement by including their company in the old agreement:" In this case, the agreement "Wordeka" with the city and with individuals will remain in force. " True, this option is still only in development.
However, the other day the situation seemed to have moved from the dead point. Representatives of new builders managers managed to get in contact with the leadership of the "Wedesk", and the missing Zaichuk was also found. According to Mikhail Sitnikov, CEO of Trust No. 26, in the near future their company should receive the necessary documentation from the old developer. However, you should not count on a quick solution to the issue. “You need to figure it out, work out the legal sides,” he added.
There was a replacement of "social initiative"
At the meeting of the Moscow Region, the meeting was identified at the Ministry of Construction Complex of the Moscow Region for the construction of residential buildings built by the “social initiative”: the residential complex in Zheleznodorozhny will complement LLC “VE EM Pi Real Estate”, objects in Lyubertsy are ready to take on Areal LLC, and two houses in Mytishchi-Domstroy-1 LLC. However, this is a very small part of all the objects of the company. In total, she built about 400 objects, collecting about $ 1 billion from individuals. At the same time, about a quarter of all objects of “social initiative” is located in the suburbs. With equity holders of other objects in the regional government, they do not want to communicate at all. “We are sent to the court, where we must prove that we invested in purchasing an apartment for housing, and not for profit,” said the shareholder of Social Initiative Sergey Korolev, who invested the money in the construction of a residential building in Tuchkovo near Moscow.
