The Strasbourg Court issued the verdicts on the cases of Trepashkin and Skuratov, the European Court of Human Rights (ECHR) on Thursday simultaneously satisfied the complaints of the former FSB officer, the scandalously known lawyer Mikhail Trepashkin and former Prosecutor General Yuri Skuratov. Although the first was serving a sentence in the camp and recently served several months with asthma in Kartsere, the court ordered Russia to pay 3 thousand euros to Trepashkin, and Skuratov, whom the authorities deprived of the right to elect into the State Duma four years ago, awarded 8 thousand euros. In the case of Trepashkin, the ECHR admitted that Russia violated the 3rd, the most unpleasant article of the Convention for the Protection of Human Rights for any country, which says: "No one should be subjected to torture, nor inhuman or humiliating dignity or punishment." According to another article, which refers to the right to freedom and personal integrity, the ECHR rejected the complaint. Two more complaints of Mikhail Trepashkin remained in Strasbourg.
As one of the defenders of Trepashkina, Elena Lipzer, told the correspondent of Gazeta, "this is only the first complaint, it does not concern the justice of the sentence, but only the events of the fall of 2003, when Trepashkin was contained in the monstrous conditions of the Dmital Dmital Directorate of the Dmitry."
Trepashkin was arrested on October 22, 2003, when he was traveling to Dmitrov. According to lawyers, a gun was thrown into the car. This happened a few days before Trepashkin, as a representative of the victims from the terrorist attack on Guryanov Street in September 1999, was supposed to take part in court over Adam Decushev and Yusuf Krymshamkhalov.
Since Trepashkin, suffering from fourth degree bronchial asthma, was then thrown into a tiny pledged camera, the European Court recognized this as a violation of the 3rd article of the European Convention on Human Rights (creation of inquisitive conditions). Trepashkin tried to place in the most difficult conditions of detention in the chamber. For example, he managed to convey a sealed envelope, full of lice, which he gathered in a Volokolamsk pre -trial detention center.
Mikhail Trepashkin himself, in writing, answering a question to the “newspaper” through the mediation of lawyers, said that after the expected release in December, he intends to achieve rehabilitation and restoration of the status of a lawyer. “Once in places of imprisonment, I faced the fact that there were at least 30% - innocently convicted, and 70% received punishment that was clearly inadequate to the deed,” the newspaper Trepashkin told the correspondent.
Yuri Skuratov won his case in the European Court on Thursday. Unlike Trepashkin, Strasbourg judges were more generous with the former prosecutor general and awarded the Russian Ministry of Finance to pay him 8 thousand euros for the fact that the authorities, in fact, deprived him of the right to elect into parliament. In 2003, Skuratov refused to register as a candidate in the State Duma elections - as the plaintiff claimed, under a completely far -fetched pretext. The Strasbourg court yesterday stated that Russia violated one of the articles of the European Human Rights Convention - the right to free elections.
“I am satisfied,” Yuri Skuratov said on Thursday to the correspondent of newspapers. The money, according to the prosecutor general, will go to pay for the services of a lawyer. “It was important for me to challenge the fact that I was put up as an unskilled lawyer who allegedly violated the legislation, filling out documents during registration,” he emphasized in an interview with the newspaper. “As for the amount of compensation, I output from the legal practice of European countries, which does not know the assessment in the monetary equivalent of honor and dignity.” Commenting on the decision of the European Court against Trepashkin, Yuri Skuratov admitted that he was unfamiliar to the details of the case. “But I think that the principles are more important for him,” the former prosecutor general emphasized.
