Amendments to the Code of Administrative Offenses (Code of Administrative Offenses) are going to accept the responsibility for doping in the fall of this year. Such a need has matured due to an endless series of doping scandals with the participation of famous Russian athletes who undermine the image of our sport and country in the international arena. However, until recently, disputes continued, what punishment should be introduced for doping - administrative or criminal? And who to punish - athletes, coaches, doctors or sports functionaries? As a result, according to Svetlana Zhurova, they stopped on the mildest version.
“We propose to introduce administrative responsibility for the use of forbidden drugs not for athletes, but for coaches and doctors who contribute or do not impede violation of anti -doping legislation,” Zhurova told the Sports Information All Sports . - The athlete who came across doping is punished so enough, because he loses the opportunity to engage in his profession for several years. At the same time, I do not know a single case that his personal coach or doctor be punished for the athlete’s positive doping. I will never believe that the coach and the doctor do not know about the prohibited manipulations that the athlete conducts. And in the event that this is proved by the relevant competent authorities, they must bear administrative punishment.
The FSB was already investigating some high -profile doping affairs, in particular, a scandal with the leaders of the Russian national biathlon team Ekaterina Yuryeva and Dmitry Yaroshenko. However, no serious measures to the culprits of these incidents under the current legislation cannot be applied. The maximum that awaits the doctor who fed athletes with doping is dismissal. Moreover, most of the dismissed quickly finds work in other teams or sports. Coaches are sometimes disqualified for up to two years, but this usually means only a ban on working with the national team. As for sports functionaries, these are elected leaders. The only way to punish them for a doping scandal is to put on members of the federation with the help of a state car and resign how this happened with the ex-president of the Russian Biathlonist Union Alexander Tikhonov last spring.
The appearance of an article on doping in the Code of Administrative Offenses will expand the possibilities to combat this evil, but not dramatically. The list of sanctions provided for by the Code - a warning, an administrative fine (for citizens - not more than 5 thousand rubles, for officials - not more than 50 thousand rubles), deprivation of a professional license, in exceptional cases - administrative arrest up to 15 days. Most likely, doping affairs will be given to the competence of the peace, which today are already littered with divorce proceedings, lawsuits about car accidents and other civil lawsuits. It is not necessary to count on that in this situation in the fight against doping in Russia, there will be no breakthrough.
The lack of radicality in the anti -doping projects of the State Duma is caused by the fact that former athletes mainly work on them. The Parliamentary Committee on Physical Education and Sports is headed by the Olympic figure skating champion Anton Sikharulidze, and the deputy chairman of the State Duma Svetlana Zhurova is the Olympic champion in riding aid. It is difficult for people who lived most of their lives in sports to get rid of the stereotype that a positive doping test is a disaster, but not the fault of the athlete and his mentors. Therefore, the experience of Western Europe and the United States, where the use of prohibited drugs is qualified as fraud and passes through criminal articles, is ignored in our country.
The recommendation to introduce criminal liability for the use, sale and distribution of prohibited stimulants five years ago issued to all civilized UNESCO countries. Criminal liability for doping is provided in countries such as France, Italy, Finland, Greece, the USA and China. For example, in Italy, for the use of forbidden drugs, you can get up to three years in prison. It usually does not reach such an extreme, but sometimes the very fact of the appearance of carbines in the house of the perpetrator in a doping scandal is enough to forever discourage him to achieve sports victories dishonestly. In addition, in most Western countries, common doping drugs are equal to drugs and for their implementation can be obtained in jail for a very substantial period.
States practicing criminal liability for doping proceed primarily from the fact that people who give the athlete doping (doctors and coaches), and those who authorize these decisions (functionaries), and the athletes who agree to take prohibited drugs, all of them do a criminal conspiracy to deceive the public, judges and their rivals. In addition, information about the use of doping leading athletes jeopardizes the life of thousands of amateur athletes, who thoughtlessly follow the example of their idols, not having the opportunity to adequately evaluate the results of stimulants and constantly under the control of doctors.
