The Presidium of the Supreme Court of the Russian Federation on Wednesday, September 2, recognized as unlawful to the extension of the arrest of the General of the Federal Service for Monitoring the Illegal Turnover of Drugs (FSKN) Alexander Bulbov, accused of illegally listening to telephone conversations.
According to RIA Novosti, the investigation of the investigation to extend the Bulbov period of detention for another three months was sent to the Moscow City Court for a new consideration.
We will remind, earlier with a cassation protest to the Supreme Court, Deputy Prosecutor Grin addressed the Supreme Court, who considered that on November 12, 2008, the Moscow City Court illegally extended the general detention of detention until December 15, 2008. The Prosecutor General’s Office recalled that in the case file there is no decision to institute criminal proceedings directly against Bulbov.
According to the law, the prosecution of a citizen is prohibited without the initiation of a criminal case against him, that is, a citizen cannot be detained without a decision to institute criminal proceedings against him. Grin believes that in this way, Bulbov, as well as three more defendants in the case - the former and current drug police Donchenko, gvev and Gusev - are in the pre -trial detention center on illegal grounds. Grin asked for the resolution of the Moscow City Court to cancel, and the investigator’s request to be sent for a new consideration. The Presidium of the Supreme Court granted his performance.
In addition, the decision of the city court was disputed by the defendants in the case and their defense, only they insisted on the release of the accused from the guard. So, Bulbov noted that his criminal prosecution is “custom -made and is revenge for working in the FSKN in the case of the smuggling of furniture in the shopping centers“ Grand ”and“ Three Whales ”and Chinese smuggling.
General Bulbov himself said that he had already familiarized himself with the materials of the criminal case "and did not find in it a single document that would give the investigation the opportunity to detain me and detain me." “There is no guilty evidence,” the general claims.
The court decided to satisfy the complaint of the defendants in the case and their protection partially to cancel the decision of the Moscow City Court, but not to release the accused from the guard, but to send the investigation to the investigation for a new consideration.
The head of the anti -corruption committee, Kirill Kabanov, in an interview with Gzt .ru, called this event a landmark.
“You can’t call it routine, this is a landmark event. He was subordinate to the Office of the Department of the Department and the Office of Operational and Technical Events, that is, wiretapping, external observation of those who documented a very definite activity. This is a completely anti -corruption case, and the decision of the Supreme Court is a response to Medvedev’s initiatives to combat corruption, ”Kabanov noted.
Recall that back in May 2008, Medvedev signed a decree "On measures to counteract corruption." There are prescribed the powers and procedure for the work of the Council on Countering Corruption, which was created "in order to create a system of counteracting corruption in the Russian Federation and eliminate the causes that generate it."
Then Medvedev, commenting on this decree, stated that “enough to wait” and “we must do something”, since corruption in Russia turned into a systemic problem. Commenting on the results of the meeting, Naryshkin noted that the decisiveness with which the president is ready to fight corruption "instills optimism." In turn, Chaika said that it does not exclude the tightening of criminal legislation to combat corruption, including the introduction of confiscation against legal entities and individuals.
Recall that General Alexander Bulbov was detained on October 1, 2007 at Domodedovo Airport. According to the case file, the general paid $ 50 thousand per month for illegal listening to telephone conversations to an employee of the Ministry of Internal Affairs Mikhail Yanykin, who is also undergoing the accused in the case. According to the investigation, since January 2003, Bulbov collected $ 4 thousand per month from merchants. In total, Bulbov was charged with 35 episodes of crimes.
The general himself claims that he and his subordinates followed the instructions of investigators in cases of smuggling of furniture and Chinese goods. According to Bulbov, the criminal prosecution against him was organized by persons involved in the case of "three whales".
