Inappropriate compensation

The representative of the victims from the actions of Major Evsyukov doubts the decisions of the Ministry of Internal Affairs, lawyer Igor Trunov, representing the interests of relatives of several dead and injured at the hands of Major Denis Evsyukov, believes that the decision of the Russian Ministry of Internal Affairs to provide material assistance to the families of the victims contradicts the law.

“This borders on a criminal acting act,” he told the correspondent of the newspaper. Trunov emphasized that the Ministry of Internal Affairs is funded from the budget. “The purpose of the Ministry of Internal Affairs is the protection of order and the protection of the population,” the lawyer noted. “It is for them that they are given money. If, instead of buying pistols, they will purchase coffins for this money, then this is an inappropriate spending of budget funds.”

According to the lawyer, the city treasury should compensate for the injured to the victims. This provides for Article 1069 of the Civil Code of Russia, Trunov recalled, which prescribes the procedure for compensating for harm to citizens who suffered as a result of illegal actions or inaction of government officials.

It is not clear to Trunov from what means of the Ministry of Internal Affairs provided material assistance to the victims, which the department informed about on Monday evening. “If these are the employees of the Ministry of Internal Affairs, then this is the help of individuals, not the Ministry of Internal Affairs,” the lawyer believes.

Trunov said that none of the relatives of the dead and the wounded who addressed him confirmed the receipt of material assistance from the Ministry of Internal Affairs.

Its size and character are still unknown. “It is unclear what exactly they helped,” the lawyer explained his thought. “Did they allocate money for funeral expenses?” According to Trunov, even if the victims receive financial assistance, it will not do without complying with legal formalities. “They just don’t give money anywhere,” he emphasized. Remembering cases with the payment of compensation to the victims of the plane crash, the lawyer recalled that the airlines with whom they manage to reach an agreement are always asked to sign a certain agreement: "It says that the victims are obliged not to apply to courts and have no material complaints against the company."

According to Trunov, so far none of the relatives of the dead and injured by Major Evsyukov asked to stop or suspend the preparation of claims for compensation for moral and material damage to the Moscow government, which are planned to be submitted after the May holidays. However, the defender noted that he would understand if this happens. “People have the right to file or not to file claims,” said the lawyer. “A burdock story with our courts does not please anyone, especially after a recent statement by Moscow representatives that the city’s budget is not obliged to compensate for the damage to the victims of Evsyukov’s actions.”

Meanwhile, yesterday, the Investigative Committee at the Russian Prosecutor's Office presented the former head of the Tsaritsyno police department Denis Evsyukov an official charge of killing two or more people from hooligan motives and attempting to kill two or more persons, as well as illegal storage of firearms (part 2 of article 105, Art. 105, as well as Article 222 of the Criminal Code of the Russian Federation).
