ECHR went to serial sentences

In Strasbourg, on Thursday, decisions on business immediately made 13 plaintiffs from Russia on Thursday by the European Court of Human Rights (ECHR) announced its decision on cases of at once 13 applicants from Russia. The complaints of Madina Akhmadova (she was awarded compensation in the amount of 46.25 thousand euros), Larisa Askharova (47.65 thousand euros), Raisa Bersunkeeva (39.7 thousand euros), Louise Musikhanova (58.5 thousand euros), Lyubov Gandaloeva (37.65 thousand euros) and Milan Tagirova (10.5 thousand euros), euros, euros, euros, euros) Whose husbands, after they were detained by the Russian military in 2001-2003, went missing, and the husband of Gandaloeva Alawdi was found dead.

In addition, the court will consider the claims of relatives of Arthur Bersonkayev and Adam Ilyasov, about which nothing is known since 2002. The plaintiffs argue that the local authorities did not take measures to an effective investigation of the disappearance, and that in their cases several articles of the European Convention on the Protection of Human Rights and Fundamental Freedoms were violated at once. The ECHR awarded these applicants 39 thousand euros.

Thus, the court admitted that Article 3 was violated by the Russian authorities, stating that no one should be tortured either inhuman or humiliating dignity or punishment; Article 4, which states that no one should be kept in slavery or forced condition; Articles 5 and 13 - on illegal deprivation of liberty and effective protection by the state. At the same time, the Ilyasov family, who added a statement to all these articles that the Russian Federation violated the 2nd article of the Convention on Life, stated that “there were no evidence that Adam is dead”, and therefore, Ilyasov did not receive compensation for this item.

One of the truths, Madina Akhmadova, told the correspondent of the newspaper that victory in the ECHR can be considered only moral. “Our material costs were much more significant than the money won. Our family spent a lot on attempts to find my husband Musu. I was very nervous, and, apparently, on this basis I started oncological problems, I had to do the operation, which was also worth the money, ”says Madina.

In addition to a series of Chechen affairs, the ECHR was today considered the case of Chinese citizen Gao Chunmanny, professor of the Department of Biotechnology and Food Technology of the Chemical and Technology Faculty of the University of Qinghua in Beijing, who lived until last year in Russia. GAO has long -standing relations with Russia. Back in September 1956, he entered the Leningrad Technological Institute named after the Lensovet and graduated in March 1962. In 1996-2000, he came to Russia several times on long business trips.

In 2000, the professor left China due to the risk of persecution on the basis of his belonging to the Falungun movement, a follower of which he has been since 1994 and which is prohibited in the PRC. In March 2003, the Office of the UN Supreme Commissioner for Refugees was officially recognized by the fact that Gao needed asylum.

However, in May 2007, employees of the Department of the Federal Migration Service (FMS) in St. Petersburg, despite the status of GAO, despite the fact that he was already married to a Russian citizen, forcibly deported him to China, and his wife had no information about her husband’s location for a long time. As the human rights activists noted, his expulsion coincided with a visit to Russia by a delegation of young lawmakers in China, which were adopted at a high level in the State Duma and the Federation Council.

However, the court considered the arguments of GAO not convincing enough and considered that there were no violations of the European Convention from Russia. As a result, the lawsuit of the disgraced Chinese professor was not satisfied.

But the ECHR made a positive decision on the affairs of two more Russians - Nikolai Bakhitov and Vladimir Belashev. Bakhitov is now serving a sentence of imprisonment for a period of 13 years in the Ryazan region for robbery and murder. Belashev, who was accused of terrorism for the explosion of monuments to Nicholas II and Peter I in St. Petersburg, is serving a 11-year term. The court agreed with the arguments of the plaintiffs that the investigation against them was conducted impermissiblely for a long time, which violates the right to proceed the case within a reasonable time, which is guaranteed by the 6th article of the European Convention. Belashev awarded a compensation in the amount of 10.22 thousand euros, Bachitov - 2.7 thousand.
