The State Duma approved the law on the procedure for the redemption of land from state property of the State Duma, adopted in the third, final reading a law clarifying the conditions and procedure for acquiring rights to land plots located in state or municipal property. According to the chairman of the Committee on Property Viktor Pleskachevsky, the approved legislative initiative occupies a central place in the land legislation and complements a number of legislative acts that make up the legal framework of the entire land reform in Russia. The main goal of the document, the deputy explained, to complete the process of "merging" of land and buildings, structures and structures located on them into unified real estate objects, as was proclaimed in the Land Code of the Russian Federation.
The law enshrines the exclusive right to privatize land or the acquisition of the rights of their lease for the owners of buildings, buildings, structures. For legal entities and individual entrepreneurs, a tough term of completion of the re -registration of the right of permanent unlimited use for the right to rent or redeem of land in property - until January 1, 2010, for owners of linear objects - until January 1, 2013, has been established. Another important point in the law is the implementation of the President of the Russian Federation on the limitation of the maximum price of the land plots redeemed before January 1, 2010 for the owners of buildings, structures and structures. For all owners, this price is 2.5% of the cadastral value of land plots. For Moscow and St. Petersburg, it is set to up to 20% of the cadastral value, RIA Novosti reports.
Pleskachevsky noted that in order to prevent the possibility of speculation of land in Moscow and St. Petersburg, the law introduced the norm on the possibility of the state authorities of these cities of the federal significance for the reconstruction of the former and the construction of new buildings in such areas. He added that an extremely important legislative innovation can be considered a provision that removes the restriction for the owners of buildings for the acquisition of land plots that have been on the right of renting, regardless of when the lease of these land plots was concluded - before or after the day the land code of the Russian Federation enters into force. "Accepting this law, we are trying not only to correct the mistakes of the early 90s, but also to sharply reduce dependence on officials, on authorities as landlords, as well as to sharply increase the creditworthiness and competitiveness of enterprises, and therefore the countries as a whole," the head of the Duma committee said.
