For the first time in Russia, the creator of "Malicious computer programs" was convicted in Russia

The City Court of the Proletarian District of Saransk condemned a resident of the capital of Mordovia Andrei Ersyykin to one year in prison according to article 273 of the Criminal Code of the Russian Federation "Creation, use and distribution of malicious computer programs."

According to the state prosecutor Yevgeny Maksimochkin, for the first time in Russia a citizen was convicted under this article.

The investigation established that the program created by Ersyykin allowed to change and reset the data on revenue, which were stored in the fiscal memory of cash registers, as well as change the date and number of purchases, RIA Novosti reports.

The distribution of the program was prevented by employees of the department for investigating crimes in the field of high technology of the Ministry of Internal Affairs of Mordovia. They bought a processor from Ersyykin for $ 300 and after he demonstrated the program in his work, he was detained.

The lawyer of the defendant Sergey Pronchatov built a defense at the statement that the term "computer" was not applicable to the cash register. However, the court recognized the arguments of the defender insolvent. The lawyer intends to appeal the court decision.

In early February, in Moscow, a man was detained for a crime under the same article. True, he did not create, but distributed "malicious computer programs."

For four months, a 24-year-old resident of Krasnogorsk near Moscow traded in the Mitinsky market compact disks, when loading which customers “flew” programs.

According to the representative of the Central Internal Affairs Directorate, he attracted his victims with low prices. “How many people fell on his bait to establish the investigation,” he said.

On this fact, a criminal case was also instituted under part 1 of Article 273 of the Criminal Code of the Russian Federation ("creation, use and distribution of malware for computers"), which provides for a punishment of imprisonment for up to three years and a fine of 200 to 500 minimum wages.
