The Saratov Regional Court sentenced the leader of the National -Bolshevik party Eduard Limonov (the real name of the writer - Savenko) to 4 years in prison.
The court found him guilty under Article 222 of the Criminal Code of the Russian Federation - illegal acquisition, storage, transportation of firearms and ammunition.
Another leader of the NBP, the founder of the Limonka party newspaper, Sergei Aksenov, who also held in this case, was sentenced to 3 years 6 months in prison.
Six Kalashnikov assault rifles and cartridges for them were acquired by four activists of the National Bolshevik party, who also appeared before the court.
NBP activists were convicted of different terms
NBP activists Dmitry Karyagin and Vladimir Pandelik were convicted of 2.5 years in prison, and Nina Silina was sentenced to 2 years and 4 months in prison. Oleg Laletin received by the court sentenced for 2 years and 3 months of imprisonment of the swing. These four NBP members, which are part of different regional parties, were found guilty of illegal acquisition, storage and transportation of firearms and ammunition.
The court sentenced the “below the lower limit” to all the defendants, provided for by the articles of the Criminal Code, by which they were found guilty. At the same time, the court noted that "the serious consequences of the case could not occur, since the unlawful activities of the defendants were controlled by law enforcement agencies long before their detention." The court attributed this fact to exceptional circumstances.
As follows from the sentence, Dmitry Karyagin, Vladimir Pandelk, Nina Silina and Oleg Laletin (young people 26 - 29 years old), at the direction of Eduard Limonov and Sergey Aksenov, acquired six Kalashnikov and more than 150 rounds of cartridges for them. However, in March 2001, they were detained near Ufa and Saratov.
The court removed the majority of charges from Limonov and Aksenov
At the same time, the Saratov Regional Court on Tuesday lifted from the leader of the National-Bolshevik party Eduard Limonov and the founder of the newspaper Limonka, Sergei Aksenov, the majority of accusations. In the morning, the charge was removed under Article 280 of the Criminal Code of Russia - an attempt to overthrow the state system.
The court also “confirmed” Limonov’s accusation under Article 205 of the Criminal Code of the Russian Federation - preparation for terrorism, under Article 208 of the Criminal Code of the Russian Federation - an attempt to create illegal armed groups for which they had previously charged.
Aksenov and Limonov lifted the wine in the acquisition of explosives. The court classifies the acts of the defendants as a crime committed in an organized group, that is, provided for in CT. 222, part 3, Criminal Code .
Commenting on the removal of guilt from Limonov under the article “Trying to overthrow the state system”, Judge Vladimir Matrosov explained that the fault of Limonov and Aksenov was not proven, since they did not call publicly to overthrow the authorities, and all the materials in which this topic was discussed were distributed secretly.
As the court indicated, the investigation was based on these accusations by the so -called project of creating the “Second Russia”, which was published in the NBP -Info - a closed party of the party. This project provided for the creation of the National Bolshevik army, which the investigation regarded as illegal armed formation.
Meanwhile, according to the court, the accusation "overestimated the significance" of NBP-info ballots. As the court notes, the prosecutor refused to charge Limonov and Aksenov of the preparation and distribution of the NBP-info, in one of which the project of the creation of the Second Russia was published.
Limonov and Aksenov themselves claimed that the closed Bulletins of the NBP-info were preparing Alexander Burygin, who subsequently died. In addition, Limonov said that he did not write a single material in the NBP-Info.
According to the court, the fact of the acquisition of weapons is not evidence of the training of terrorist attacks, which, according to the investigation, the National Bolsheviks were going to organize in Kazakhstan. The accusation in this part is “not convincing”, since the investigation has not established “place, time and method of planned terrorist acts,” the sentence emphasizes.

Limonov’s lawyer Sergei Belyak hoped that his defendant would be given a conditional term.
The court, chaired by Judge Vladimir Matrosov, pleaded guilty to the defendants in the acquisition and storage of weapons. This is confirmed by material evidence and testimonies of witnesses, SARBK reports.

Eduard Limonov’s lawyer Sergei Belyak is satisfied with the verdict, who issued the Saratov Regional Court of his client. After the sentence was announced, Belyak said that he was pleased with the court verdict, since the court excluded the main charges against his client, in particular, the accusation of preparing for terrorism.
Meanwhile, according to Belyak, "the court could apply conditional condemnation" to all defendants. Belyak considers the “excessive” appointed to Eduard Limonov and his second client - the founder of the Limonka newspaper Sergei Aksenov - punishment. As Belyak noted, Limonov "60 years old, and 32-year-old Aksenov is sick with tuberculosis."
In this regard, the defender did not exclude that he would file a cassation appeal to the Supreme Court of Russia, in which he would ask to replace the real term of imprisonment appointed by the Saratov Regional Court to conditional conviction. Sergei Belyak also said that Eduard Limonov had already left half of the period appointed by the court of 4 years and could count on parole.
The state prosecutor Sergei Verbin, in turn, also does not exclude that the verdict of the Saratov Regional Court, issued by the NBP leader and five activists of the organization he head, will be protested. After the announcement of the judicial verdict, Verbin told RIA Novosti that the issue of submitting a cassation submission to the Supreme Court of Russia will be resolved "only after a thorough study" he "text of the sentence.
“The court issued such a sentence, this is his right,” said Verbin. He emphasized that the investigation revealed and warned the NBP “at a very early stage” committed by activists. “It was prepared in a fairly good organization and conspiracy. This could not but affect the possibilities of investigators to collect evidence of their guilt,” the state prosecutor emphasized.
According to Verbin, investigators "were primarily guided by the need to prevent a crime at a very early stage." Otherwise, the prosecutor believes, "the situation could be lost."

The prosecutor demanded 14 years in prison for Limonov
