Representative PACE was not allowed to meet with Khodorkovsky

The Chairman of the Meshchansky Court of Moscow, Alexander Lukashenko, refused to issue permission to date with Mikhail Khodorkovsky and Plato Lebedev to the representative of the Parliamentary Assembly of the Council of Europe (PACE) to Sabina Loithoizer-Shnarrenberger , a source in the judicial authorities told Interfax.

According to the existing procedure, when the case was referred to the court, permission to date with the accused can only be obtained in court. With the relevant request, the representative of PACE appealed to the philistine court of the capital, who will consider the criminal cases of the ex-head of the NK of Yukoku Khodorkovsky and the head of the MFI Menatep Platon Lebedev.

However, she was refused the meeting. The Chairman of the Court was motivated by the fact that the representative of PACE is not included in the circle of persons who, in accordance with criminal procedure legislation, can count on visiting prisoners in prison - close relatives, lawyers, priests and consuls (if the prisoner is a citizen of a foreign state).

The visit of Sabina Loytkhoyzer-Shnarrenberger will last from May 24 to 27. According to her, she arrived in Moscow to carefully familiarize themselves with the situation around the arrest and criminal prosecution of a number of Yukos company leaders.

"I intend to independently, objectively and impartially evaluate this situation. Only after considering all the details of the case I can provide my report to the Human Rights Committee," she said.

Her conclusion according to the results of meetings in Moscow will be announced only after they are granted the Committee on Human Rights of the Council of Europe.

“Already for tomorrow I have planned meetings with the Deputy Minister of Justice of the Russian Federation, Deputy Prosecutor Governor of the Russian Federation. I will also talk with representatives of the Russian State Duma Committee,” the representative of Pase said.

As for the rest of the program of her stay in Moscow, Loitherozer-Schnarrenberger said that she was under development.

Moskalenko noted that, in accordance with the law on detention, the suspect and the accused on the basis of the written permission of the person or the body, in the production of which is the criminal case, may be provided no more than two dates per month with relatives and other persons up to three hours each.

In her opinion, the representative of PACE "at least as a" other person "could be allowed to Khodorkovsky in order to be able to adequately illuminate the situation that has developed in this case."

The refusal to the representative of PACE in a meeting with Khodorkovsky and Lebedev, according to Moskalenko, was caused by the fact that "they simply did not want to allow a special -lines."

“I am sorry that our judicial authorities are solving these issues in this way,” the lawyer said. “It seems to me that this is a big serious mistake. But if the authorities have something to hide, so they are hiding. If they had nothing to hide, then they should have missed,” Moskalenko remarked. “If the authorities constantly violate the law on this case, then they characterize themselves,” the lawyer added.
