| They want to force Muscovites to pay for documents they don’t need The capital's authorities have come up with another project to voluntarily and forcibly empty the wallets of Muscovites. At yesterday's meeting of the Moscow City Duma, deputies considered the bill "On a passport for an apartment", introduced by Gennady Lobok - it provides for the introduction of a new document for housing in Moscow, which would reflect all the "consumer characteristics" of the apartment: from its explication plan to information about the placement hidden electrical wiring. According to legislators, Muscovites simply need such documents, and therefore every tenant will not mind paying for the production and receipt of a passport for their home.
Similar passports are already being issued to all new residents in the capital. Investors today sell most apartments without interior decoration, and sometimes without interior walls, so new owners immediately begin redevelopment and renovation. In order to somehow control this process, which sometimes results in serious consequences for buildings as a whole, the capital’s authorities obliged builders to compile all technical information into an apartment passport, in which the future tenant will have to reflect all changes made to the layout and engineering infrastructure. However, if the mayor's office, without any laws, can force investors to spend money on certification of new buildings, then the Moscow City Duma went further and decided to oblige all Muscovites to order apartment passports from authorized organizations at their own expense.
Actually, this is what Mr. Loboc wanted to propose to his colleagues, but he could not clearly formulate his idea on paper. The preamble of the document states that the law regulates relations arising in the course of its implementation, and in the explanatory note the author does not very convincingly explain the need for the adoption of this document by “the absence of appropriate norms in federal legislation.” As a result, Mr. Loboc was unable to answer the main question: how to oblige all Muscovites to line up to receive these passports, if all technical information for each apartment is contained in the Bureau of Technical Inventory, and any changes are registered there in accordance with a separate law “ About the redevelopment of apartments in Moscow." The papers available today are quite sufficient to carry out transactions for the purchase and sale of housing and register these transactions with the justice authorities. Colleagues explained to Mr. Lobok that the Moscow City Duma cannot oblige the homeowner to obtain any additional documents, since civil legal relations are regulated exclusively by federal legislation. An apartment passport introduced by a subject of the federation can only be a non-binding, purely voluntary information and technical document. The metropolitan authorities can force only municipal housing tenants to pay for this stupid certificate from their own pockets, who certainly do not need such a passport - since they do not have any rights to redevelop apartments. The deputies had questions about the authorized organizations that Mr. Loboc plans to attract to implement the certification program for each apartment, and about the cost of their services.
However, despite such criticism, the bill was not consigned to the wastepaper basket. Recognizing that an apartment passport is still a useful thing, and most importantly, it has already been introduced by the mayor for new Muscovites, the deputies passed the bill in the first reading, deciding to slowly think about how to force the townspeople to fork out money without conflicting with federal legislation to a completely unnecessary document.
