
On Wednesday, the Morskhorsud will consider the defense of the head of the MFI Menatep Platon Lebedev to the bourgeois court to appoint him an independent medical examination, Interfax reports.
On August 19, the Meshchansky court of Moscow refused to satisfy Lebedev’s defense to conduct a special medical examination. The presiding judge Irina Kolesnikova said that the appointment of a medical examination is not within the competence of the court.
“The Criminal Procedure Code does not provide the court with the possibility of a medical examination to the defendants. This decision is not within the competence of the court, but is the competence of the institution that contains Lebedev - the Sailor Silence,” the judge said.
The defense of Plato Lebedev provided the court with a number of conclusions of independent experts, in particular, a medical expert from the UK, who, on the basis of a map of the accused, found that "Lebedev has signs of liver cirrhosis or the initial stage of liver cancer."
"The conclusions of medical experts from the pre -trial detention center, who allegedly monitor the state of our client are contradictory. In reality, there was one examination, and this is clearly not enough for the concept of his state of health," said Lebedev’s lawyer Evgeny Baru.
He recalled that Plato Lebedev has four chronic diseases.
The Prosecutor General’s Office accuses Platon Lebedev and the ex-head of Yukos Mikhail Khodorkovsky under seven articles of the Criminal Code of the Russian Federation. In particular, they are charged with theft by fraud, tax evasion of both an individual and a legal entity, forgery of documents and non -compliance with the court decision.
