
Yuri Budanov in Ulyanovsk wants to have mercy contrary to his desire. The former colonel withdrew the statement of pardon after he learned about the reaction in society to this step. However, the Ulyanovsk commission on pardon issues, which two weeks ago satisfied Budanov’s petition , insists on his ground: to have mercy, but leave in the colony.
This is an unprecedented incident in the history of the Russian system of punishment - to invite the state to maintain the non -combatant. The presidential administration is openly outraged by the arbitrariness of the Ulyanovites: to mercy contrary to the desire of the convict simply illegally,the newspaper Gzt.ru reports.
On September 15, it became known that the Ulyanovsk commission on pardon issues was satisfied with the petition of the ex-colonel Yuri Budanov, convicted of the murder of the 18-year-old Chechenka Elsa Kungaeva. The possible pardon of Budanov caused a great public outcry. On September 20, the Governor of the Ulyanovsk Region Vladimir Shamanov signed a request for the pardon of a former colonel. The colonel was offered to have mercy, returning him the title and all awards.
Further, this document was to be considered by Vladimir Putin. As many observers noted, any of its solutions would be extremely unpopular and would cause a negative reaction of either supporters or opponents of Budanov.
After these events, spontaneous demonstrations began in Chechnya: everyone, from ordinary residents of the republic to the leaders of law enforcement agencies, were outraged by the decision of the Ulyanovsk. The First Deputy Prime Minister of Chechnya Ramzan Kadyrov made sharp statements, accusing Russia of double standards and promising that, if Budanov was pardoned, the Chechens themselves will deal with him. Thus, Kadyrov was ambiguously made to understand that it could even be about blood feud. Some Russian politicians and human rights activists joined the Chechens.
As a result, the former colonel facilitated the task of the head of state and on September 21 himself withdrew his petition for pardon, motivating this by the fact that he "as a result of the prejudice of the media will be difficult to get to work, ensure the accommodation, maintenance and safety of the family."
Budanov also joined the Governor, which was rushing with the conclusions, presenting the commission of the regional prosecutor's office in connection with a violation of the pardon : firstly, Budanov did not pay the deceased girl the entire amount of material damage (only 11,000 were paid from the 338,777 rubles appointed by the court), and secondly, the commission did not take into account the entire severity of the deed. Actually, the prosecutor’s office had in mind that the crime was not committed in wartime and against a girl who was detained not with weapons in her hands and who, of course, did not show any resistance.
But the commission on the pardon of the Ulyanovsk region, after the meeting on Wednesday, upheld its decision in force, not paying attention to either the protest of the prosecutor's office or the statement of Budanov himself. The press release, published immediately after the meeting, gives the reasons for the decision.
These are “thousands of appeals of military personnel and other citizens of Russia,” and the fact that Budanov “sincerely pleaded guilty”, and that “left in places of imprisonment a significant sentence of the assigned punishment”, and the fact that “the wife and six -year -old daughter are without a permanent place of residence and livelihoods,” and “parents are disabled people with disabilities”. As for the presentation of the prosecutor, it, according to the commission, "sets out the grounds interpreted as mandatory, while in the Regulation on the procedure for considering petitions for pardon in the Russian Federation they are advisory in nature."
But Budanov’s opinion was taken into account by the members of the commission. And they offered him in case of pardon to stay in the colony. Let us explain that in case of pardon, the convicted person is exempted from criminal liability and, by law, cannot be contained in places of imprisonment. But this is not the main thing.
The main thing was reminded of the Presidential Administration: the Regulation on the procedure for consideration of petitions for pardon in the Russian Federation provides as a prerequisite necessary for the pardon procedure, the presence of the convict for pardon. The application for a review of the mercy of pardon means, thus, the termination of this procedure.
Such a statement by Budanov, as you know, is available. That is, the subject of consideration is absent. By the way, documents on the pardon of Budanov did not enter the administration of the President of the Russian Federation, as reported in Ulyanovsk, and the chairman of the Ulyanovsk commission on pardon Anatoly Zherebtsov, according to one of the members of the commission, intends to leave his post in the near future.
