A certain young man lost his foot on the battlefield and was forced to overtake the thresholds of different cabinets in order to get the wrong blessings due to him by law. Once, in the process of this upholstery of thresholds, he faced an unexpected situation: he was put under his nose “Appendix to“ Order of the Ministry of Health of the Russian Federation dated 01.29.97 No. 30 ”, Resolution of the Ministry of Labor and Social Development of the Russian Federation dated 01.29.97 No. 1. Classification and temporary criteria used in the implementation of medical and social examination.” And in this document there was a paragraph: “1.5.2. Restriction of the ability to independently move: 1 degree - the ability to independently move at a longer time spent, the fraction of the execution and reduction of the distance; 2 degree - the ability to independently move using auxiliary means and (or) help from other persons. ”
“That's it, young man,” they told him, “you have a typical first degree.” Can you go on a prosthesis? So they came to us. Well, of course, slowly, with a look. So this is the very first degree: "with a longer time spent, the fraction of the execution and reduction of the distance." And what a prosthesis, so on a prosthesis - this does not mean "using auxiliary means." The prosthesis is not a wheelchair. So you cannot claim a second degree, with all the ensuing.
This story is genuine. Indeed, a couple of years ago to find out, “whether it is possible to understand the prosthesis as an auxiliary means”, a linguistic examination was carried out. This is just one of the many situations when lawyers resort to the help of linguists [1] . It sometimes comes to the curiosity. So, one politician, who was called in the press “a person with an unconventional sexual orientation,” went to court, demanding at the same time a “sex-linguistic examination”. In another case, experts needed to find out whether the phrase “little -known actor” defended information about this actor contains.
It happens that the two parties entered into an agreement, and then it turns out that some condition in it is formulated ambiguously. One of the counterparties says: here, you owe us two million, and the other pokes in the same line of the contract and objects: no, you owe us two million. And here you won’t even figure out a half -liter, here you need a linguist. Say, it is often incomprehensible, this or that clarification in the text of the contract or law to the entire proposal or only to its part refers - and meanwhile the price of the issue can be very high.
I will give an example [2] . The question is whether the air carrier should pay the passenger, rested on the discrepancy between the cause of the flight delay in two documents. To figure out whether the lack of serviceable aircraft and the elimination of technical malfunctions are identical in terms of expressions, they turned to the linguists. And this is how they answered.
The question breaks up into two. Firstly, it is necessary to determine whether these expressions are the result of a "intra-linguistic translation." Obviously, there is no synonymous transformation (elimination of a malfunction - repair), nor a grammatical transformation (elimination of a malfunction - eliminate the malfunction). So the combination of the lack of serviceable aircraft and the elimination of the technical malfunction are not language synonyms (elimination is an action, absence - the situation, etc.). Their literal language meaning is completely different.
The second question is more complex and more significant: is the circle of situations that are determined by the expressions under consideration. Maybe they always indicate the same state of affairs, although they describe it from different sides? - Indeed, in some cases, both expressions - the lack of serviceable aircraft and the elimination of a technical malfunction - imply the following situation: the plane has broken, there is no serviceable aircraft, the malfunction is eliminated. And the speaker, explaining the reason for the delay in the flight, can describe the situation in all three ways.
However, the lack of serviceable aircraft does not always imply the elimination of technical malfunction, and vice versa. First, consider the expression of the absence of serviceable aircraft. Firstly, it does not mean anything about what this situation itself is caused: whether the plane is suddenly broken down, or by the fact that the carrier has too few aircraft to provide all its flights, or by the fact that all serviceable aircraft are for some reason in another place. In addition, having heard about the absence of serviceable aircraft, it can be assumed that there are still faulty aircraft (although if you reasoned logically, it is not necessary at all)-but it does not follow from this that someone repaired them (that is, it was eliminated by technical malfunction). On the other hand, what, in fact, does the expression be eliminated by technical malfunction? - That the plane was put for repairs. But it does not at all indicate that the carrier has no other, serviceable aircraft. Perhaps he simply for some reason considers it right to repair a faulty plane, and not replace it with others.
So, the mark of the lack of serviceable aircraft on the airline does not exclude the fact that the malfunction was eliminated, but does not indicate this. So, expressions of the absence of serviceable aircraft and the elimination of technical malfunction cannot be considered identical in meaning. Return the money to the passenger! The last phrase is, of course, a joke. The question of money is not within the competence of the linguist. Just a linguistic analysis leads to a kat to a decision.
Disputes in the field of patent law are very typical. For example, your company is refused the registration of a trademark on the grounds that a trademark has already been registered “similar to the degree of mixing”. Or you managed to register a trademark, but representatives of another company “hit” you, claiming that your name is too similar to their, which has long been recognized. It’s not enough just to say: “Well, what are they similar? They are not even similar at all-unless just a little, but not to the degree of mixing! ” You can hardly justify your position in court without the help of a linguist, which will analyze the phonetic and graphic appearance of both names, their morphemic structure, grammatical structure, semantic content, associative potential, etc. - and will really objectively evaluate the degree of similarity. For example, some time ago, the magazine "Health" had such a claim to the journal "Health from Nature", which was able to fight off only with the help of a linguist.

A large number of requests for linguists gives rise to the application of the Federal Law of the Russian Federation “On Advertising”. So, in accordance with Art. 16 Advertising of tobacco and tobacco products should not “... create the impression that ... smoking is important for achieving public, sports or personal success or to improve the physical or mental state.” In general, the law “On Advertising” does not allow the use of “terms to excellent degree in advertising texts, including by using the words“ most ”,“ only ”,“ best ”,“ absolute ”,“ only ”and the like, if it is impossible to confirm them documented.” Of course, it is difficult for a non -linguist to interpret the concept of “the term to an excellent degree”. For example, in an advertisement for Peter I cigarettes, it was said about the unique taste of selected tobacco. The question is, is there any “terms to an excellent degree” in this expression, that is, is the law “On advertising” is not violated here?
The specialist explained that “terms to excellent degree” should be understood as those language expressions in which the idea of the superiority of this product over all other goods of the same type is concluded. This is the main (so -called superlative) meaning of excellent degree in grammar. In our case, there are two adjectives expressing an assessment of product quality: unique and selected. To answer the question posed, you should analyze their meaning and use. The unique is "one of a kind, exceptional" [3] . However, sometimes unique can be understood in the sense of “best”, for example, unique quality, unique whiteness, a unique effect. That is, it is assumed that all other products of the corresponding class do not reach such high quality or such an obvious effect. But the fact is that the quality of the product or the effectiveness of some means can be evaluated on a single scale. However, since different people have different taste addictions and there is no single scale to assess the taste of tobacco, a unique taste cannot be interpreted as “the best taste”. This expression means "peculiar, differing from others in taste." Thus, this phrase does not claim that the taste of Peter I cigarettes is better than that of all other cigarettes, but it is argued that it differs from the taste of other cigarettes.
The word selective dictionaries is determined as follows: “selected from among others, as the best in quality; First -orient, excellent " [4] . However, these interpretations are too laconic and do not completely reflect the semantic specifics of this word. For example, they say: selected grain, selected apples, selected troops; cf. I ... looked at the boxes with the inscription "Kilka selected Astrakhan" (M. Bulgakov, Theater Roman); Apparently, they had a breeding seed material, good, selected, so the crop was received at that time for a peasant completely unthinkable: 30–35 centners of wheat from tithe (N. Khrushchev, Time. People. Power. Memories); He set off with selected Cossacks along the street (D.V. Davydov, the diary of partisan actions of 1812). At the same time, it is absolutely impossible to say a selected watermelon, a selected table, a selected general. The fact is that the word selective assumes that there are mass or many objects, of which only those that meet quality standards are selected, so that as a result it turns out to be a mass or many, but already of higher quality. The selected army consists only of soldiers selected according to certain parameters. Selected grain, perhaps, is no better and no worse than another type of grain, but better than the same grain before sorting. The selected one cannot be called a single object, only a lot (mass): one cannot be called the selected one soldier (one grain), no matter how good they are. Well, what is selective tobacco? - The word selective does not report the merits of the variety itself, it can be better or worse than other varieties, but selective tobacco consists only of qualitative fragments of this variety.
Thus, the expression unique taste of selected tobacco does not indicate the superiority of the taste of this variety of tobacco over the taste of tobacco of other varieties, or the superiority of this tobacco variety above other varieties. But in order to draw this conclusion, it is not enough just to use vocabulary interpretations (this could be done without an expert-linguist). Previously, they had to be clarified. And such a need arises quite regularly.
Especially often a linguistic study is necessary in criminal cases of slander, insulting, inciting interethnic growth and in civil cases of protecting honor, dignity and business reputation [5] . Moreover, the specific tasks that are set before the linguist can be completely different. For example, in a civil case on the protection of honor, dignity and business reputation, the plaintiff believes that the defendant extended false information about the plaintiff performing immoral or illegal actions, and this information is presented “in the form of approval”. Note that for opinions, assessments, assumptions cannot be judged: we have freedom of speech. If only these opinions and estimates are not expressed in an obscene form - then this is already criminal.
Thus, from the linguist it is required to establish whether there is a negative in the text, related to the plaintiff, whether they are expressed in the form of allegations of the facts that have taken or allegedly taking place and whether the plaintiff committed immoral, and possibly unlawful actions. To establish whether the information reported is true or false - this, of course, is no longer a linguist. Separation in the text of statements from opinions is often non -trivial task, and without the help of a linguist cannot be resolved. To do this is not always easy, even when it comes to interpreting one word. Most words are ambiguous, and often different meanings suggest an absolutely different interpretation of the statement, and therefore its legal qualifications. And how to prove that one meaning of the word was meant, and not another? In most cases, this allows you to establish a context, since the meanings of a multi -valued word differ in their constructive, compensatory, stylistic, intonation and other properties. I will give a few examples.
One of the publications about a certain official said that he works for the Caucasus Center. The experts needed to establish in which of the values in this case the word was used to work. That is, whether it is a conscious, purposeful, possibly paid activity, or the verb to work simply means activity that objectively brings to someone to benefit (cf.: Time works for us). The court’s decision on whether this phrase contains the statement or the opinion of this question depended on this question, which, in turn, influenced the outcome of the whole case. It turns out that the second value of the verb to work (time works for us) is not realized in combination with the names of persons. Therefore, here the word works can only be interpreted as targeted activity.
Another example. It was about publication, in which, in particular, it was reported that the plaintiff shouted bad words. The plaintiff believed that he was accused of using obsceneity, and the defendant claimed that he had in mind just evil words. In the “objections of the essentially set claim” there was an indication of the ambiguity of a bad word (with reference to Ozhegov’s explanatory dictionary). However, the defendant did not take into account the circumstances that different meanings of a multi -digit word are realized in various contexts, and in combination of bad words the word bad is understood the only way - as “obscene”. In the Russian language, there is even a word badger, which denotes an obscene abuse.
In cases of insult, it is often necessary to prove that this or that statement is indecent - otherwise the accused can say: they say, you see the obscene in everything, but I did not mean anything like that. And how to prove this if the statement does not contain obscene scan? In one of the television programs about Yu. Luzhkov, the television journalist S. Dorenko said that he, Dorenko, "infringed on dignity to him (Luzhkov)." The phrase sounded indecently, to which G. Krylova, Luzhkov’s lawyer pointed out. In the following programs, Dorenko tried to create the impression that Krylova sees obscenity where she is not, that the very word “dignity” in relation to Luzhkov, she allegedly understands exclusively in an indecent meaning. Moreover, this was done again in an offensive, indecent form: “Luzhkov’s lawyer insisted at least twice that the word“ dignity ”in application to the mayor of Moscow cannot mean moral qualities. As applied to the mayor, the word “dignity”, apparently, means such a variety of some indecency, which the mayor’s lawyer knows about, even saw anyone. ” Further, Dorenko ranged the same thought: “It is not for us to judge. The principal Luzhkov, undoubtedly, could show the lawyer what they call him dignity. Or at least describe it something. And it may very well be that Krylova has reason to evaluate this something with the mayor as a completely vulgar little thing. But I am categorically against me to be attributed to awareness in their secrets of this kind. It also seems inappropriate to me that the lawyer makes it clear to the judge that the judge is also in the know. The fact that, as you saw now, the lawyer tells the judge that you, they say, is your honor, and you yourself understand what an abomination is, this is the very dignity, the mayor has. ”

Meanwhile, a linguistic analysis shows that G. Krylov was right, but did not have linguistic argumentation. The fact is that in the expression “infringed on his dignity” S. Dorenko used the form of a dative case to him. In Russian, it is impossible to say, for example, “he caught his honor”, “wounded his pride” (there should not be “him”, but “him”), but they say, for example, “it scratched his cheek”, “pinched his finger”. Therefore, the expression “infringed on his dignity” suggests that we are talking about part of the body. And since the word “dignity” in the Russian language has the conversational meaning of the “male genital organ”, the phrase has an exceptionally indecent meaning.
Of course, in a small article it is impossible to affect all issues related to a linguistic examination, in particular, questions about the development of uniform criteria for expert assessment, on the scientific substantiation of linguistic examination, etc. I will dwell on only one problem that seems to me the most significant for society.
Бывает, что потребность в лингвистической экспертизе вызывается не только оценкой спорных текстов, но и функционированием самих правовых норм. Дело в том, что многие российские законы сформулированы так, что применить их буквально очень трудно.
Рассмотрим, например, в каком значении слово пропаганда используется в ч. 1 ст. 46 закона «О наркотических средствах и психотропных веществах». Под пропагандой наркотических средств там понимается «деятельность физических или юридических лиц, направленная на распространение сведений о способах, методах разработки, изготовления и использования, местах приобретения» этих средств. Это понимание кардинально отличается от общеязыкового значения слова пропаганда. Ср.:
ПРОПАГ`АНДА , -ы; and. [от лат. propaganda — то, что следует распространить]
1. Распространение и углубленное разъяснение каких-л. идей, учения, знаний среди широких масс населения или круга специалистов. Научная, научнотехническая п. Антиалкогольная п. П. в области физкультуры и спорта. П. новой технологии производства.
2. Политическое или идеологическое воздействие на широкие массы; органы и средства такого воздействия. Коммунистическая п. Буржуазная п. Партийная, предвыборная п. Агитация и п. Вести пропаганду, заниматься пропагандой [6] .
Таким образом, в языке слово пропаганда понимается более широко и относится в первую очередь к распространению взглядов, воззрений и т. п. А в ч. 1 ст. 46 закона это понятие трактуется более узко, его содержание ограничивается только распространением сведений. Но это только в ч.1! В ч. 2 той же статьи сказано: «Запрещается пропаганда каких-либо преимуществ использования отдельных наркотических средств…» Здесь затруднительно применить то определение пропаганды, которое дано в ч. 1, следовательно, скорее всего, имеется в виду языковое значение слова пропаганда, т. е. углубленное разъяснение, в данном случае, преимуществ использования отдельных видов наркотических средств.
В принципе, наличие у слова терминологического значения (более узкого, чем значение общеязыковое) — нормальное явление. Однако в данном случае вводится не просто более узкое, но искажающее самый смысл слова значение. При этом в других контекстах (скажем, в сочетании пропаганда расизма) это слово употребляется в законодательстве в общеязыковом значении. Да что уж говорить, если разночтение, как мы видели, возникает даже в пределах одной статьи закона! Поэтому, как можно заметить, при обсуждении того или иного казуса даже юристы постоянно сбиваются с одного толкования слова пропаганда на другое.
С лингвистической точки зрения интересно проанализировать и Постановления Пленума Верховного суда Российской Федерации, регулирующие применение ст. 152 Гражданского кодекса РФ о защите чести, достоинства и деловой репутации. До недавнего времени действовало Постановление от 18 августа 1992 г. № 11 «О некоторых вопросах, возникших при рассмотрении судами дел о защите чести и достоинства граждан, а также деловой репутации граждан и юридических лиц (в редакции Постановлений Пленума Верховного суда от 21 декабря 1993 г. № 11, от 25 апреля 1995 г. № 6)». В нем, в частности, говорится: «Порочащими являются также не соответствующие действительности сведения, содержащие утверждения о нарушении гражданином или юридическим лицом действующего законодательства или моральных принципов (о совершении нечестного поступка, неправильном поведении в трудовом коллективе, быту и другие сведения, порочащие производственно-хозяйственную и общественную деятельность, деловую репутацию и т. п.), которые умаляют честь и достоинство гражданина либо деловую репутацию гражданина или юридического лица». Заметим, что упоминание о производственно-хозяйственной деятельности здесь заключено в скобки, в ряду других разъяснений. Из этого следует, что сведения о производственно-хозяйственной деятельности можно счесть порочащими, только если речь идет о незаконных или аморальных действиях. Никакие утверждения, например, о том, что тот или иной банк находится на грани банкротства, не могут, согласно букве этого постановления, порочить его деловую репутацию. Это я про тяжбу Альфа-банка с «Коммерсантом». Летом 2004 года «Коммерсант» опубликовал статью о том, что у банкоматов Альфа-банка выстроились очереди. Альфа-банк подал в суд — и выиграл. Вопреки тексту Постановления, которое полностью исключало такое решение. Его просто проигнорировали. Это напоминает старый анекдот: — Куда ты едешь, там же кирпич! — А, я этим знаком не пользуюсь.
Прежнее Постановление давно ругали, нового ждали с нетерпением. И вот — свершилось! Однако что же мы читаем в Постановлении Пленума Верховного Суда РФ от 24 февраля 2005 года № 3 «О судебной практике по делам о защите чести и достоинства граждан, а также деловой репутации граждан и юридических лиц»? А вот что: «Порочащими, в частности, являются сведения, содержащие утверждения о нарушении гражданином или юридическим лицом действующего законодательства, совершении нечестного поступка, неправильном, неэтичном поведении в личной, общественной или политической жизни, недобросовестности при осуществлении производственно-хозяйственной и предпринимательской деятельности, нарушении деловой этики или обычаев делового оборота, которые умаляют честь и достоинство гражданина или деловую репутацию гражданина либо юридического лица». Итак, утверждение о неудачном менеджменте и грозящем банкротстве по-прежнему репутацию не порочит. Однако интереснее другое. Как мы помним, согласно старому Постановлению порочащими считались ложные сведения о совершении аморальных или незаконных действий. Теперь же порочит человека и многое другое, и, что особенно замечательно, — утверждения о неправильном поведении в личной, общественной или политической жизни. Про незаконные поступки все понятно — для этого существует Уголовный кодекс. С аморальными поступками, конечно, сложнее. Полного согласия на этот счет в обществе нет, даже если мы ограничимся десятью заповедями. И все же у всех нас есть какие-то общие представления о морали. Большинство людей согласится, что безнравственно бросать детей, забывать родителей, предавать друзей. А вот как быть с неправильным поведением? Что значит — неправильное? Вот, например, ходить зимой без шапки — правильно? А когда девушка ночью возвращается домой по неосвещенной улице — разве это правильно?
Думаете, придираюсь? Judge for yourself. Недавно некий чиновник подал иск о защите чести и достоинства из-за того, что в газете про него написали «прошмыгнул». Случай совершенно анекдотический. Но вчитаемся в новое Постановление — и что же получается? Прошмыгнуть — значит пройти или пробежать быстро, стараясь быть незаметным. Согласитесь, когда солидный человек, должностное лицо, прошмыгивает куда-то там во время встречи с народом — это неправильно. А если про судью написать, что он зевнул или почесался? Это ведь тоже неправильное поведение!
В общем, похоже, поправки вносились в спешке и непродуманно. Нечего и говорить, что лингвистам этот текст предварительно не показывали.
Недавний скандал вокруг иска журналистки Ирины Ароян к певцу Филиппу Киркорову также должен был бы привлечь внимание к букве, т. е. формулировкам, закона. Напомню, что летом 2004 года на пресс-конференции Ф. Киркоров обматерил журналистку И. Ароян. Журналистка обратилась в правоохранительные органы, и Киркорову была вменена ст. 130 Уголовного кодекса РФ (Оскорбление). Ф. Киркоров представил суду лингвистическое заключение, выполненное А. Н. Барановым, научным сотрудником Института русского языка им. В. В. Виноградова РАН, из которого следовало, что высказывания Киркорова, скорее всего, под статью «Оскорбление» не подпадают. Дело Киркоров все равно проиграл: судья отказался принять экспертное заключение лингвиста, высказавшись в том смысле, что мы сами, мол, знаем, что эти слова значат. А вокруг лингвистического заключения разразился скандал. Вот заголовки некоторых газетных публикаций: «Эксперт: Киркоров ничего особенного не сказал»; «Игры сквернословов. Охамстве в контексте высокой лингвистики»; «Институт РАН “изобрел” для Киркорова специальные нормы русского языка».
Разумеется, все это полная чушь. Эксперта, доктора филологических наук А. Н. Баранова, никто не спрашивал, относятся ли употребленные Ф. Киркоровым матерные слова к нормативной лексике. Для этого, действительно, экспертлингвист не нужен. И без юриста, и без лингвиста ясно, что сквернословие в общественном месте — это хулиганство. Но речь-то шла не о статье «хулиганство», а о статье «оскорбление». Понятие «оскорбление» определено в законе, и именно этим определением, согласно общим нормам права, нужно руководствоваться. А мы уже убедились на примере слова пропаганда, что в законе слова могут использоваться в значении, далеком от общеязыкового. И иной раз расшифровать толкование понятия, данное в законе, и соотнести это толкование с конкретной ситуацией может только лингвист. Как же определяет «оскорбление» ст. 130? А вот как: «Оскорбление, то есть унижение чести и достоинства другого лица, выраженное в неприличной форме». Если внимательно прочитать эту экспликацию, становится очевидно, что оскорбление как уголовное преступление имеет два признака: во-первых, высказывание самим своим содержанием должно унижать честь и достоинство другого лица и, во-вторых, оно должно иметь неприличную форму. Например, если человека называют б****, все равно, в прямом или переносном смысле, — то это, в смысле УК, оскорбление, поскольку это слово а) указывает на аморальное поведение и б) непристойно. А вот как быть с высказыванием Киркорова «Мне по х**, что вы напишете»? Форма-то неприличная, спору нет, а вот смысл? Это высказывание означает «Мне безразлично, что вы напишете». Разве этот смысл унижает честь и достоинство? А одной неприличной формы, в соответствии с процитированным толкованием, недостаточно для статьи «Оскорбление». И разве лингвист виноват, что законодатель именно так определил понятие оскорбления? Пригласил бы его, лингвиста, когда обсуждалась новая редакция УК! Лингвист сказал бы ему, что очень легко переформулировать экспликацию слова оскорбление так, чтобы под нее подпадало то, что произнес Киркоров. Например, «имеющие неприличную форму высказывания, жесты, рисунки и т. п., которые по своему содержанию или по самой своей фор ме направлены на унижение чести и достоинства другого лица». Ведь, судя по комментариям к УК, законодатель подразумевал что-то в этом роде. Но пока-то мы имеем дело с тем, что написано в законе сейчас, так что извините.
Когда поп-звезда хамит журналистам, это, как сказано в анекдоте, беда, но не катастрофа. А вот катастрофа, по-моему, если председатель Комиссии по правам человека при президенте России говорит, что «есть вещи, к которым с чисто профессиональной “принципиальностью” подходить аморально». Именно так, судя по газетным публикациям, сказала Элла Памфилова. Одно из важнейших прав человека состоит в том, чтобы его судили по закону, причем желательно именно с профессиональной принципиальностью, а не руководствуясь революционным правосознанием, не по понятиям и даже не по совести. А уж от эксперта (химика ли, патологоанатома ли, лингвиста ли — все равно) в первую очередь требуется эта самая профессиональная принципиальность, а не моральный пафос. Закон несовершенен? Так надо его поправить — в будущем. Но следование букве закона — это, по-моему, единственное, что может уберечь нас от полного хаоса.
Элла Памфилова еще сказала (судя, опять же, по газетным публикациям): «Даже когда говорят, что “ваше мнение мне безразлично”, — это оскорбительно. Как же нужно извратить здравый смысл, чтобы подвести научную базу под доказательство того, что в словах “мне по х**, что вы там напишете, как и вы сами”, нет ничего обидного?!» Конечно, есть обидное! Но в ст. 130 УК РФ нет ни слова про обиду. И лингвиста про обиду не спрашивали. А что до оскорбления, то не все, что звучит оскорбительно с точки зрения русского языка, является оскорблением в соответствии с той же ст. 130 УК. Если меня спросят: «Ты диссертацию сама писала или нанимала кого-нибудь?» — я сочту такой вопрос оскорбительным, но не уголовно наказуемым.
История с Киркоровым очень печальна. Газеты, разумеется, с гиканьем и улюлюканьем кинулись смаковать пикантную ситуацию. В результате в обществе сложилось впечатление, что Институт русского языка Российской академии наук разрешил посылать женщин матом. Даже большинство моих и А. Н. Баранова коллег, которые тоже судили о деле по газетам, остались в убеждении, что заключение Баранова абсурдно. Один коллега даже прислал мне по электронной почте сообщение: «Позор!» Он заклеймил меня заодно с Барановым, поскольку я по радио пыталась объяснить, что Баранова не спрашивали, хорошо ли ругаться матом и хамить женщинам.
Между тем содержательная сторона дела осталась за пределами обсуждения.
Нормы закона формулируются небрежно. Лингвисты к оценке формулировок, насколько я знаю, не привлекаются. А ведь чем более туманно и неоднозначно написаны законы, тем больше простора для произвола и коррупции.

[5] Объем статьи не позволяет мне рассказать обо всех типах лингвистической экспертизы. Так, особый тип исследования — это автороведческая экспертиза. Очень часто бывает нужно установить, адекватно ли пересказ передает смысл исходного текста. В делах о клевете приходится выяснять, идет ли речь в спорном фрагменте текста именно об истце. Лингвистическая экспертиза бывает также необходима в делах о недобросовестной рекламе, неэтичной конкуренции и т. п.
