On Thursday evening, the arbitration court upheld the appeal of the Voronezh Semiconductor Device Plant (VZPP), postponing the introduction of external surveillance at the enterprise at the request of the tax inspectorate of the Zheleznodorozhny District. According to Kommersant's sources, its owners are no less interested in bankruptcy than the tax authorities; they need to write off the debt from VZPP, where there are almost no assets, and remain with the debt-free subsidiary VZPP-Assembly. True, the owners were not satisfied with the Moscow organization of professional arbitration managers proposed by the tax authorities for external monitoring, whose interests in Voronezh are represented by the deputy general director of the July company, Alexander Botvinyev. In 2001, the Voronezh Semiconductor Devices Plant, specializing in the development and production of microelectronic products, was divided into three enterprises - VZPP OJSC, VZPP-Mikron CJSC and VZPP-Assembly LLC. The reason was the debts of the parent company. Part of the assets of the former giant of the radio-electronic industry was transferred to “successor” enterprises. CJSC VZPP-Mikron bought the AFK-Sistema holding, controlled by Vladimir Yevtushenkov. VZPP-Assembly LLC (the main shareholders are Moscow companies) focused on fulfilling orders from the Ministry of Defense. OJSC "VZPP" was "divided" between Moscow companies affiliated with the shareholders of "VZPP-Assembly" and the general director of the foreign trade company "Energia" Sergei Gorodkov. Now it carries out small orders for the production of energy-saving lighting equipment.

In April 2005, the inspectorate of the Federal Tax Service (FTS) of the Zheleznodorozhny District of Voronezh filed a claim with arbitration to declare VZPP bankrupt and introduce a monitoring procedure at the enterprises. At that time, the debt on mandatory payments amounted to 257 million rubles. General Director Vadim Frolov filed a similar lawsuit. But due to the special conditions of bankruptcy of strategic enterprises (according to federal law, this is possible in “exceptional cases”), both the tax authorities and Mr. Frolov withdrew their claims in April.

However, some time before the tax authorities withdrew their claim, the company filed an appeal to the Voronezh arbitration court against the court's decision to accept the tax authorities' bankruptcy petition. On Thursday evening, Judge Sergei Protasov considered the complaint and satisfied it. Thus, the VZPP bankruptcy case will not be considered for now. Mr. Protasov refused to comment on his decision. The company also refrains from making statements. Meanwhile, as Kommersant learned from sources close to VZPP, an attempt to bankrupt the enterprise will be made again - on the part of its owners, in order to “shed” responsibility for unpaid amounts on the part of the parent enterprise and remain clear of debt obligations "VZPP-Assembly".

According to the source, the company’s management tried to prevent the procedure initiated by the tax authorities, allegedly because the Federal Tax Service recommended the non-profit partnership “Moscow Self-Regulatory Organization of Professional Arbitration Managers” (MSOPAU), whose representative in Voronezh is the first deputy general director of the well-known “anti-crisis” company, to participate in external monitoring. company "July" Alexander Botvinyev, who distinguished himself by the fact that last year he tried to return the withdrawn property from the MUP "Voronezhvodokanal" to the MUP "Vodokanal Voronezh". Apparently, the danger of returning the assets of VZPP OJSC, VZPP-Mikron CJSC and VZPP-Sborka LLC to the “predecessor” enterprise pushed the owners to oppose the bankruptcy procedure.

Alexander Botvinyev reported yesterday that he does not meet the requirements for arbitration managers to participate in supervision at such a strategic enterprise as VZPP. At the same time, the plant management, in his opinion, clearly did not want to participate in the bankruptcy procedure of MSOPAU, the managers of which would not fail to return the withdrawn assets to the “predecessor” enterprise.

At the same time, as the prosecutor of the Zheleznodorozhny district of Voronezh, Vladimir Alferenko, told a Kommersant correspondent, the district prosecutor’s office, at the request of one of the VZPP creditors, whom Mr. Alferenko refused to name, yesterday began checking the validity of the actions of the tax inspectorate, which withdrew its statement of claim for the introduction of external surveillance on VZPP. “We have just started the inspection, and it is too early to talk about its results,” he said.
