Lawyer Anuar Dikinov, defending the famous human rights activist and former KGB officer Ruslan Nakhushev, has prepared a complaint to the Nalchik City Court. The defense attorney is going to demand that the decision of the prosecutor of Kabardino-Balkaria Yuri Ketov to initiate a criminal case against Mr. Nakhushev for aiding terrorism be declared illegal (Article 205 of the Criminal Code of the Russian Federation). On November 4, 2005, Mr. Nakhushev was interrogated at the FSB Directorate of the KBR, after which he disappeared. The prosecutor's office qualified the disappearance of the human rights activist as a kidnapping and instructed operatives of the Ministry of Internal Affairs and the FSB to organize a search for him. However, at the end of last year, the human rights activist began to be wanted not as a kidnapping victim, but as a criminal. “I was not allowed to see the materials of the case initiated under Article 205,” Mr. Dikinov told Kommersant. “And I learned that Nakhushev was now being sought as a criminal from police leaflets with his photograph posted around Nalchik. They reported that he was wanted as an organizer and participant in an illegal armed group (IAF) that committed an attack on law enforcement agencies in Nalchik on October 13. I asked the FSB investigator in charge of Nakhushev’s case for clarification, and he said that he had indeed been put on the wanted list - but not. for participation in an illegal armed group, but as a suspect in aiding terrorism (charges were never brought. — Kommersant) the investigator said that he had nothing to do with the wording written in the leaflets, that the police officers “overdid it.” Lawyer Dikinov believes that this circumstance cannot but be taken into account in court when considering his complaint. Let us recall that the reason for initiating a criminal case against Mr. Nakhushev was publications in local and federal media, which claimed that he not only defends the rights of Muslims in the Kabardino-Balkaria, but is also closely associated with the leaders of the terrorist underground in the republic. The Ministry of Internal Affairs of the KBR, meanwhile, believes that Ruslan Nakhushev was not kidnapped, but is hiding from investigation with his friends in Moscow or Kazakhstan.
