| United Russia took up the task of complying with the legislation on compulsory motor liability insurance State Duma deputies continue to make attempts to toughen responsibility for failure to comply with the law on mandatory “motor citizenship”. Three members of the Committee on Constitutional Legislation and State Building, members of United Russia: Alexander Moskalets, Vladimir Pligin and Alexander Kharitonov, developed draft amendments to the Code of Administrative Offenses. They propose introducing fines for insurers who unlawfully delay or understate payments under compulsory motor liability insurance, as well as increasing fines for car owners who do not want to purchase policies or have lost them. At the same time, for a trip without a policy, it is proposed to remove the license plate from the car. These amendments may be considered in the first reading as early as March, Mr. Pligin said. According to him, the bill will be finalized over the summer, and could be finally adopted during the autumn session of the State Duma. Insurers believe that the amendments of the deputies are meaningless, since compliance with the legislation is already monitored by Rosstrakhnadzor and the traffic police.
Amendments by deputies of the Volgograd Regional Duma are being prepared for the second reading in the State Duma, which propose introducing fines for insurance companies that do not pay compensation for “automobile insurance” on time. For each day of delay in insurance payments, the company, according to the document, is proposed to be fined an amount equal to 1/150 of the Central Bank refinancing rate of the total amount of late payments. Also a year ago, the introduction of administrative liability for insurers was proposed by deputy Viktor Pokhmelkin, who is not a member of any faction, but his amendments received negative feedback from the government, as they required additional budget expenditures. In addition, the State Duma is currently considering amendments from Federation Council member Sergei Shuvalov, who also proposes to remove license plates from cars for violations by their owners of the law on compulsory motor liability insurance and to double fines for drivers who have forgotten their insurance policy.
United Russia first of all proposes to fine officials of insurers by 40-50 minimum wages, and the companies themselves - by 400-500 minimum wages for unlawful refusal to pay under compulsory motor liability insurance, evasion of payment, underestimation of its amount, failure to comply with the established payment deadline (by law -- 15 days) and other violation of the rules of OSAGO. Cases of these administrative offenses, according to deputies, should be considered by the head of Rosstrakhnazor and his deputies.
The deputies did not forget about car owners. For those of them who violate the law on compulsory motor liability insurance, the amendments provide for increased penalties by two to three times. For car owners who do not insure their liability, the fine is proposed to be increased from 500-800 to 1 thousand rubles. For comparison: the average cost of an MTPL policy in 2005 was 1,880 rubles. If the car is driven by a driver who is not included in the MTPL policy, United Russia offers to pay a fine of 500 rubles, and not 300 rubles, as now. And for a policy forgotten at home or lost - 150 rubles. instead of today's 50 rubles. In addition, the deputies propose to prohibit the operation of the car in case of any of the above violations, i.e. remove the license plate from it.
Insurers consider the new draft of the deputies unnecessary and meaningless. “The insurance market already has a strict control system - this is Rosstrakhnadzor, which, in case of violation of the law, can issue warnings, suspend or confiscate licenses from companies,” says Igor Ivanov, deputy general director of RESO-Garantiya. “When there is such a strong method of influence, it makes no sense to develop a system of fines.” According to him, tightening fines for car owners is not the most effective way to force people to buy compulsory motor liability insurance policies: “Small amounts of fines will not scare anyone; Until fines are increased significantly, the most effective way will remain for traffic police officers to monitor the presence of a compulsory motor liability insurance policy during roadside checks.” Gyuzel GUBEYDULLINA | |
