On Wednesday, the Moscow City Court recognized the arrest of the Moscow notary Fail Sadretdinov, previously justified in the case of the murder of the editor -in -chief of the Russian version of the Forbes magazine Paul Khlebnikov , and now the accused in a new criminal case of apartments.

" The decision of the Zamoskvoretsky court of the city of Moscow dated May 12, which has been chosen by a preventive measure in the form of detention, in relation to Fail Sadrendinov, to leave without change, and cassation complaints are not satisfied," said the judge, announcing the decision.

Sadretdinov’s lawyers asked to free their client from custody. "Sadretdinov was detained only on the basis of the severity of the prosecution. On May 5, he was acquitted by the jury by the jury, on May 6 was present at the announcement of the acquittal, and the rest of the time he was at the addresses that the investigation had in court," his lawyer Elena Lipzer said in court.

According to the lawyer, in the intentions of Sadretdinov there was no desire to hide or influence witnesses, since he did not even know about the initiation of a new criminal case against him on May 6. The Lipzer pointed out that the passport that Sadretdinov has is expired and cannot serve as the basis for the statement that he could hide.

Sadretdinov himself, who participated in court through a video broadcast from the investigative insulator, said: "I visited the Moscow City Court twice during this period. I intended to lie down on inpatient treatment, since chronic diseases were aggravated in the pre -trial detention center. I informed the head of the notarial chamber about all my actions. This is a mockery."

In turn, the prosecutor insisted on the refusal to satisfy complaints, indicating that the preventive measure of Sadretdinov was elected legally and reasonably. "The court made a correct and reasonable decision, taking into account the data on the personality of the accused," said the prosecutor. The court agreed with the arguments of the prosecutor, refusing lawyers, Interfax reports.

Zamoskvoretsky Court of Moscow on May 12 authorized the arrest of Faily Sadretdinov. The court granted the request of the Moscow prosecutor’s office to detain Sadrendinov, whom the prosecutor’s office accuses of fraud with apartments (part 3 of article 159 of the Criminal Code of the Russian Federation). The decision of the Zamoskvoretsky court notes that Sadretdinov, having a passport, may hide from the court and investigation. “Having studied the case file, the court concludes that the investigator’s request for the imprisonment of Sadretdinov is subject to satisfaction,” the judge said, emphasizing that he was accused of committing serious crimes.

Earlier, on May 5, the jury was acquitted by Fail Sadretdinov and two natives of Chechnya - Kazbek Dukuzov and Musa Vakhaev, who were accused of the murder of journalist Paul Khlebnikov. All three on this day were released from custody in the courtroom. On May 6, the Moscow City Court, on the basis of the acquittal of the jury, justified all three accused in the case.

A new criminal case against Sadretdinov was opened on May 6, and on May 11 the notary was detained by investigators of the Moscow prosecutor's office. According to the prosecutor's office, Sadretdinov, using a fake will, through fraud, took possession of one of the apartments in Moscow, belonging to the deceased civilian. The study of the hereditary case of the deceased made it possible to identify a false testament certified by Sadretdinov, emphasized the prosecutor's office.
