
The Moscow City Court confirmed the legality of recovery from the recording companies in favor of the leader of the Leningrad group Sergey Shnurov more than 5 million rubles, lawyer Vadim Uskov, representing the interests of the musician in court, said on Wednesday. Thus, the court rejected the cassation complaints "S.B.A. Muzik Pabling" and CJSC "S.B.A. Production", in which they asked to cancel the decision of the Basmanny Court of Moscow, RIA Novosti reports.
On June 14, 2006, the District Court recognized that these companies violated the copyright and adjacent rights of Shnurov to receive remuneration for the use of his works. In this regard, the court decided to recover with "S.B.A. Muzik Publishing" One million 83 thousand 106 rubles 20 kopecks, and with CJSC "S.B.A. Production" - 4 million 12 thousand 861 rubles of 72 kopecks, the lawyer said.
The reason for the trial was the suspension of payments of the author's reward to the leader of the St. Petersburg group. "From January 1, 2003, the recording companies stopped paying Shnurov money, but at the same time they continued to use his albums and tracks," Uskov explained. The court considered these actions of the defendants unlawful.
In the lawsuit, the leader of the Leningrad also insisted on terminating the contract with CJSC S.B.A. Musik Publishing "On the transfer of copyrights for seven of his albums (five albums plus two discs with bonus tramas). It was, in particular, about the albums "Mat without electricity" and "Pirates of the 21st century." However, in this part, the court left a lawsuit.
“According to the court, the company must pay the author’s reward to Shnurov, but the fact of a non -payment of five million is not a significant violation of the contract, so it should not be terminated,” Uskov said. He added that the plaintiff and his defense have not yet decided whether they would continue to demand to terminate the contract in court.
